O R D I N A N C E NO. 10208
AN ORDINANCE, repealing Ordinance No. 10185, as adopted September 11,
1997, and enacting a new ordinance in lieu thereof, appropriating Ninety Thousand Dollars
($90,000.00) from the Improvement Fund to be used for the construction of sanitary sewers,
together with repayment of expenses incurred by the District in connection with such
construction project in Subdistrict No. 88030 (Chapel Hill South of Clayton Road) P-21758, in
the City of Town and Country, Missouri.
WHEREAS, participating real property owners in such project have paid to the
District Ninety Thousand Dollars ($90,000.00) for the total costs of said project, and have
contracted with J. Bommarito Construction Company to install a certain sewer system within
and for such Subdistrict, and
WHEREAS, upon satisfactory completion of such project, the District is to pay
over to such contractor from such funds, its installation cost; retain in its Improvement Fund its
incurred expenses, for engineering, survey and inspection, construction staking, easement
charges, and allowance for construction change orders, and return any unexpended balance to
the contributors thereof, pro rata,
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinance No. 10185, as adopted September 11, 1997, is hereby
repealed.
Section Two. The sum of Ninety Thousand Dollars ($90,000.00) is hereby
appropriated from the Improvement Fund to be used for the construction of sanitary sewers,
together with repayment of expenses incurred by the District in connection with such
construction project in Subdistrict No. 88030 (Chapel Hill South of Clayton Road) P-21758, in
the City of Town and Country, Missouri, and any unused portion thereof shall be returned to
the contributors pro rata.
Section Three. This ordinance, being an appropriation ordinance, shall take
effect immediately upon its enactment.
The foregoing Ordinance was adopted October 9, 1997.
