O R D I N A N C E NO. 10271
AN ORDINANCE, appropriating a total of Three Million Three Hundred Thousand
Dollars ($3,300,000.00), to be funded as follows: Three Million Dollars ($3,000,000.00)
from the Operation, Maintenance and Construction Improvement Fund of Deer Creek and
Three Hundred Thousand Dollars ($300,000.00) from the Improvement Fund, to be used for
project costs for the construction of sanitary and storm sewers in Harrison-Brentwood Relief
Sewers Phase I & Phase II (94052), in the City of Brentwood, Missouri; authorizing the
Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a contract with Bates Utility Company for the construction of the
aforesaid sanitary and storm sewers, and to enter into Amendment No. 6 to Contract E-821
with Engineering Design & Management, Inc. for additional engineering services for the final
design of said project.
WHEREAS, the bid for the construction of said sanitary and storm sewers is
Three Million Sixty-six Thousand Three Hundred Forty-six Dollars ($3,066,346.00), and the
cost of additional engineering services and the allowance for construction change orders is
Two Hundred Thirty-three Thousand Six Hundred Fifty-four Dollars ($233,654.00), and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of Three Million Three Hundred Thousand Dollars
($3,300,000.00), to be funded as follows: Three Million Dollars ($3,000,000.00) from the
Operation, Maintenance and Construction Improvement Fund of Deer Creek, and Three
Hundred Thousand Dollars ($300,000.00) from the Improvement Fund, is hereby
appropriated from the Operation, Maintenance and Construction Improvement Fund of Deer
Creek to be used for project costs for the construction of sanitary and storm sewers in
Harrison-Brentwood Relief Sewers Phase I & Phase II (94052), in the City of Brentwood,
Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with
Bates Utility Company as the lowest responsible bidder for the construction of sanitary and
storm sewers in Harrison-Brentwood Relief Sewers Phase I & Phase II (94052), in the City
of Brentwood, Missouri, with The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 7th day of November, 1997.
Section Three. The Executive Director and Secretary-Treasurer are hereby
authorized to enter into Amendment No. 6 to Contract E-821 with Engineering Design &
Management, Inc. for additional engineering services for the final design of Harrison and
Brentwood Relief Sewers Phase I & Phase II (94052); said amendment to be comprised of
such terms and conditions as are approved by the office of the General Counsel of the District
Section Four. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted January 8, 1998.
