HomeMy Public PortalAbout10278 O R D I N A N C E NO. 10278 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to Harold F. Helmkampf and Thomas F. Helmkampf, certain real property of the District located in the City of Olivette, Missouri (District Site No. 31), and prescribing the terms of said transaction. WHEREAS, said real property is located at 1233 Price Road, in the City of Olivette, Missouri and consist of 1.674 acres, and WHEREAS, pursuant to Resolution No. 2016, adopted September 18, 1991 said real property was appraised and publicly advertised for sale, and WHEREAS, said real property is of no use to the District, and has been declared as surplus pursuant to Resolution No. 2253, adopted May 8, 1997, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to sell and convey to Harold F. Helmkampf and Thomas F. Helmkampf certain real property of the District located in the City of Olivette, Missouri for the total sale price of Two Hundred Seventy-seven Thousand Seven Hundred Seventy-two Dollars ($277,772.00), said real property being described as follows: A tract of land being the north part of Lot 3 of "Olivette Industrial Acres", as recorded in Plat Book 79, Page 4 of the St. Louis County, Missouri Recorder's Office. Located in Section 32, Township 46 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point in the West line of a private road 40 foot wide, known as North Price Road, being the Northeast corner of said Lot 3; thence along the West line of said private road, South 00 degrees 32 minutes 00 seconds West, a distance of 155.00 feet to a point, being the Northeast corner of property conveyed to Engineered Air Systems, Inc., as recorded in Deed Book 7697, Page 1620 of the St. Louis County, Missouri Records; thence along the North line of said Engineered Air Systems, Inc. property, North 89 degrees 07 minutes 00 seconds West a distance of 391.13 feet to a point, on the Northeast line of the right-of-way of the Chicago, Rock Island & Pacific Railroad, 100 feet wide; thence along said right-of-way line, North 44 degrees 58 minutes 30 seconds West, a distance of 222.55 feet to a point being the Northwest corner of said Lot 3; thence along the North line of said Lot 3, South 89 degrees 07 minutes 00 seconds East, a distance of 549.89 feet to the "Point of Beginning", said tract containing 72.928 square feet or 1.674 acres, more or less, according to a survey by Kenneth Balk & Associates, Inc. during the month of May, 1997. -3- Section Two. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance of the real property as authorized in Section One above, and further to deposit the proceeds from said sale and conveyance in the Reserve for Real Property Purchase Improvement and Alterations Account. The foregoing Ordinance was adopted January 8, 1998.
