AN ORDINANCE, vacating a portion of a ten foot (10') wide easement
originally granted to the City of Kirkwood, as recorded in Deed Book 2939, Page 68 of
the St. Louis County Records, a portion of a ten foot (10') wide easement originally
granted to the City of Kirkwood, as recorded in Deed Book 2929, Page 360 of the St.
Louis County Records, and a portion of a five foot (5') wide easement originally granted
to the City of Kirkwood, as recorded in Deed Book 3725, Page 332 of the St. Louis
County Records, being in part of the East half of the Northwest Quarter of Section 35,
Township 45 North, Range 5 East, in the City of Des Peres, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this District
to vacate the portions of the subject easements, and this District has no further use for
said portions,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the ten foot (10') wide easement originally
granted to the City of Kirkwood, as recorded in Deed Book 2939, Page 68 of the St.
Louis County Records, the portion of the ten foot (10') wide easement originally granted
to the City of Kirkwood, as recorded in Deed Book 2929, Page 360 of the St. Louis
County Records, and the portion of the five foot (5') wide easement originally granted to
the City of Kirkwood, as recorded in Deed Book 3725, Page 332 of the St. Louis County
Records, as shown hachured on the attached "Easement Vacation Plat", and marked
Exhibit "A" and made a part hereof, are hereby vacated.
The foregoing Ordinance was adopted August 13, 1998.
