wide easements recorded in Deed Book 4581, Page 348; all easements recorded in Deed
Book 5603, Page 38 all easements recorded in Deed Book 6286, Page 341; the easement
of varying width recorded in Deed Book 6291, Page 1218; and a ten foot (10') wide
easement recorded in Deed Book 6599, Page 2046; all of the St. Louis County Records,
said easements being in Executive Apartments, and Executive Apartments Phase Two,
subdivisions according to the plats thereof recorded in Plat Book 108, Page 32 and Plat
Book 114, Page 33, respectively, of the St. Louis County Records.
WHEREAS, the owner of the subject property has requested this District
to vacate the subject easements, and this District has no further use for said
easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT;
Section One. The two ten foot (10') wide easements recorded in Deed
Book 4581, Page 348; all easements recorded in Deed Book 5603, Page 38; all
easements recorded in Deed Book 6286, Page 341; the easement of varying width
recorded in Deed Book 6291, Page 1218; and a ten foot (10') wide easement recorded in
Deed Book 6599, Page 2046; all of the St. Louis County Records as shown hachured on
the attached "Easement Vacation Plat", and marked Exhibit "A" and made a part
hereof, are hereby vacated EXCEPTING THEREFROM the easements established by
"Easement Plat", as recorded in Plat Book 346, Page 561 of the St. Louis County
Records.
The foregoing Ordinance was adopted October 8, 1998 by the following vote –
Ayes – C. L. Barnhart, P.P. Finn, C.D. Seward, M.C. Williams, and G. J. Sheffield.
Nays – None.
