AN ORDINANCE, vacating a stormwater easement of irregular width as
recorded in Deed Book 11653, Pages 2444 and 2445 of the St. Louis County Records
and located in a tract of land being part of Lots 3 & 4 of the Subdivision of the West
One-half of U.S. Survey 415 and part of Lot 7 of Thomas K. Humphrey's Estate and Lot
4 of Baxter Crossing and part of Section 9, Township 45 North, Range 4 East, in the
City of Chesterfield, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this District
to vacate the subject stormwater easement, and this District has no further use for said
stormwater easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The stormwater easement of irregular width, as recorded in
Deed Book 11653, Pages 2444 and 2445 of the St. Louis County Records and shown
hachured on the attached "Stormwater Easement Vacation Plat," and marked Exhibit
"A" and made a part hereof, is hereby vacated, EXCEPTING THEREFROM the ten
foot (10') wide easement as recorded in Plat Book 345, Pages 365 and 366 of the St.
Louis County Records.
The foregoing Ordinance was adopted December 10, 1998 by the following vote –
Ayes – C.L. Barnhart, J.W. Siscel, C.D. Seward, P.P. Finn, G.J. Sheffield, and M.C.
Willaims.
Nays – None.
