AN ORDINANCE, appropriating One Million Five Hundred Thousand
Dollars ($1,500,000.00) from the Improvement Fund to be used for project costs for the
construction of sanitary sewers in FF-09 Fee Fee Creek Sanitary Relief L-51 (P-718)
Phase III (89138C), in the City of Maryland Heights, Missouri; authorizing the
Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis
Sewer District to enter into a contract with Bates Utility Company, Inc. for the
construction of the aforesaid sanitary sewers, and to enter into Amendment No. 5 to
Contract E-836 with Horner & Shifrin, Inc. for additional engineering services for the
final design of said project.
WHEREAS, the bid for the construction of said sanitary sewers is One
Million Three Hundred Eighty-nine Thousand Eight Hundred Two Dollars
($1,389,802.00), and the cost of additional engineering services, easement acquisition,
and the allowance for construction change orders is One Hundred Ten Thousand One
Hundred Ninety-eight Dollars ($110,198.00), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of One Million Five Hundred Thousand
Dollars ($1,500,000.00) is hereby appropriated from the Improvement Fund for project
costs for the construction of sanitary sewers in FF-09 Fee Fee Creek Sanitary Relief L-
51 (P-718) Phase III (89138C), in the City of Maryland Heights, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a
contract with Bates Utility Company, Inc. as the lowest responsible bidder for the
construction of sanitary sewers in FF-09 Fee Fee Creek Sanitary Relief L-51 (P-718)
Phase III (89138C), in the City of Maryland Heights, Missouri, with The Metropolitan
St. Louis Sewer District, pursuant to bids received and opened on the 7th day of April,
1999.
Section Three. The Executive Director and Secretary-Treasurer are
hereby authorized to enter into Amendment No. 5 to Contract E-836 with Horner &
Shifrin, Inc. for additional engineering services for the final design of FF-09 Fee Fee
Creek Sanitary Relief L-51 (P-718) Phase III (89138C), in the City of Maryland
Heights, Missouri; said amendment to be comprised of such terms and conditions as
are approved by the office of the General Counsel of the District
Section Four. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted May 6, 1999 by the following vote –
Ayes – C. L. Barnhart, P.P. Finn, C.D. Seward, M.C. Williams, and J.W. Siscel.
