HomeMy Public PortalAbout10557 O R D I N A N C E NO. 10557 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to The City of Black Jack, Missouri, for use as a public park, and to execute and deliver a Lease Agreement upon the conditions hereinafter set out. WHEREAS, the District owns certain unimproved real property in north St. Louis County, adjacent to and across Coldwater Creek from the Coldwater Creek Treatment Plant, and WHEREAS, St. Louis County, Missouri is desirous of leasing said real property for use as a public park, upon the terms and conditions as hereafter generally set forth, and WHEREAS, the District is willing to enter into such a lease, and believes it to be advantageous and in the public interest to do so, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District is hereby authorized to lease to the City of Blackjack, Missouri, upon the general terms and conditions hereinafter set forth, the following described real property: A tract of land situated partly in the SE-1/4 of Fractional Section 18, and partly in U.S. Survey 210, both in T. 47N., R.7E., St. Louis County, Missouri, and together described as: Beginning at the southwest corner of the 40.10 acre tract of land conveyed to John 2 F. Hoene and wife by deed recorded in Book 2080, Page 51, St. Louis County Recorder's office, being at the southwest corner of the S.E. Fractional 1/4 of said Section 18; thence along the south line of said Hoene tract, being along the south line of said Section 18, S. 89Ε, 17'E., 928.80'; thence N. 27Ε, 39' E., 226.25'; thence No. 06Ε, 13-1/2'W., 332.22'; thence N. 75Ε, 44-1/2' E., 274.99'; thence N.81Ε, 44-3/4'E. 560.03'; thence N. 76Ε, 45'E., 314.98'; thence N. 67Ε, 22' E., 610.47' to an intersection with the east line of said Fractional Section 18, thence along said east line of Fractional Section 18, N. 00Ε, 43' E., 220', more or less, to its intersection with the (centerline of the Coldwater Creek (formerly Drainage District No. 2A) right-of-way), 100' wide; thence southwestwardly and westwardly along said right-of-way centerline, being on a curve with a radius of 1,909.86' to the right, 1,355'; more or less, to the southeast corner of a tract of land, conveyed to The Metropolitan St. Louis Sewer District by deed recorded in Book 5184, Page 607, said Recorder's office; thence westwardly along the southern line of said Sewer District property the following courses and distances (which are unrelated to the foregoing courses shown herein): N. 89Ε, 27' W., 86.86'; N. 35Ε, 35'W., 43.34'; N. 35Ε, 45' W., 97.68'; N. 73Ε, 12' W., 108.82'; S.73Ε, 03' W., 68.90'; S.17Ε, 26' W., 89.04'; S. 15Ε, 31' W., 36.08'; and N. 88Ε, 31' W., 823.36' to the southwest corner of said Sewer District property; thence continuing westwardly along the centerline of said Coldwater Creek right-of-way, 234', more or less, to its intersection with the west line of the S.E. 1/4 of said Fractional Section 18; thence southwardly along said west line of the S.E. 1/4 of Fractional Section 18, 817', more or less, to the beginning. EXCEPTING that portion of the above-described property which lies on the north side of Coldwater Creek. Section Two. The lease shall be for an original term of one (1) year, and shall be automatically renewed from year to year, not to exceed twenty-four (24) renewable annual terms, at the rental of One Dollar ($1.00) per year. After five (5) years, either party may terminate the lease upon giving one hundred twenty (120) days notice. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized and directed to execute and deliver on behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other terms and conditions as approved by the Assistant General Counsel. 3 The foregoing Ordinance was adopted May 6, 1999 by the following vote – Ayes – C. L. Barnhart, P.P. Finn, C.D. Seward, M.C. Williams, and J.W. Siscel. Nays- None. Secretary-Treasurer
