HomeMy Public PortalAbout10562 O R D I N A N C E NO. 10562 AN ORDINANCE, declaring the necessity for the acquisition of certain real property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of a pump station, force main and sanitary sewers in the project known as Windsor Springs Sanitary Interceptor (90127) to serve the needs of residents of the area, and authorizing the acquisition of such real property by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Meramec River Basin Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing the pump station, force main and sanitary sewer lines on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise the real property for the construction, reconstruction, 2 maintenance or repair of a pump station, force main and sanitary sewer lines as hereinafter set forth, said real property being more particularly described as follows: 3 WINDSOR SPRINGS SANITARY INTERCEPTOR (90127) Daniel E. Permanent easement across Lot B of CAVANAUGH ACRES, a subdivision according to the plat thereof recorded in Plat Book 308, Page 26 of the St. Louis County, Missouri Recorder=s Office, being more particularly described as follows: PERMANENT INGRESS - EGRESS/UTILITY/SEWER EASEMENT NO. 4 6 COMMENCING at the southwest corner of said Lot B; thence along the western line of said Lot B, North 00 degrees 54 minutes 00 seconds East a distance of 30.78 feet to the POINT OF BEGINNING of the hereon described said Permanent Ingress/Egress Easement No. 4; thence continuing along said western line North 00 degrees 54 minutes 00 seconds East a distance of 32.10 feet to a point; thence leaving said western line, North 63 degrees 29 minutes 48 seconds East a distance of 217.96 feet to a point on the eastern line of said Lot B; thence along said eastern line South 00 degrees 54 minutes 00 seconds West a distance of 51.41 feet to a point; thence leaving said eastern line South 71 degrees 45 minutes 29 seconds West a distance of 119.32 feet to a point; thence South 63 degrees 29 minutes 48 seconds West a distance of 90.99 feet to the POINT OF BEGINNING. 7 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted June 10, 1999 by the following vote – Ayes – C.L. Barnhart, G.J. Sheffield, C.D. Seward, P.P. Finn, J.W. Siscel, and M.C. Williams. Nays – None. Secretary-Treasurer
