AN ORDINANCE, appropriating Two Hundred Fifteen Thousand Dollars
($215,000.00) from the Sanitary Replacement Fund to reimburse Triple Crown
Properties II, L.L.C. and Taylor Morley, Inc. for a portion of the cost to construct
approximately 1,680 feet of 18-inch diameter sanitary relief sewer located south of
Olive Boulevard between Woods Mill Road and Fernview Drive, in the City of Creve
Coeur, Missouri, as a replacement for the existing inadequate 8-inch diameter sanitary
sewer; and authorizing the Executive Director and Secretary-Treasurer on behalf of
The Metropolitan St. Louis Sewer District to enter into a contract with Triple Crown
Properties II, L.L.C. and Taylor Morley, Inc. for the aforesaid construction.
WHEREAS, the District=s Engineering Department has identified a
sanitary relief project to upgrade an existing inadequate sanitary sewer (CC-02,
Fernview and Olive Sanitary Relief, MSD Project Number 90009), and
WHEREAS, the District=s Engineering Department has determined that
the existing 8-inch diameter sanitary sewer does not have sufficient capacity to accept
the additional flow from the proposed developments of Mill Crossing (P-21955), owned
by Triple Crown Properties II, L.L.C. and Bellerive Farm Estates (P-22564), owned by
Taylor Morley, Inc., and
WHEREAS, Triple Crown Properties II, L.L.C. and Taylor Morley, Inc.
are desirous of completing the construction of approximately 1,680 feet of the
downstream replacement sewer (Mill Crossing Offsite Sewer, P-23044) in a time more
immediate than the MSD construction schedule, and
WHEREAS, Triple Crown Properties II, L.L.C. and Taylor Morley, Inc.
have agreed to undertake the construction of the aforesaid 1,680 feet of sewer and
share in the cost of the design and construction of said relief sewer, and
WHEREAS, the funds for the upgrade of the sanitary sewer was included
in the 1999-2000 Capital Improvement and Replacement Program, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Fifteen Thousand Dollars
($215,000.00) is hereby appropriated from the Sanitary Replacement Fund to
reimburse Triple Crown Properties II, L.L.C. and Taylor Morley, Inc. for a portion of
the cost to construct approximately 1,680 feet of 18-inch diameter sanitary relief sewer
located south of Olive Boulevard between Woods Mill Road and Fernview Drive, in the
City of Creve Coeur, Missouri, as a replacement for the existing inadequate 8-inch
diameter sanitary sewer.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a
contract with Triple Crown Properties II, L.L.C. and Taylor Morley, Inc. whereby
Triple Crown Properties II, L.L.C. and Taylor Morley, Inc. will construct approximately
1,680 feet of 18-inch diameter sanitary relief sewer located south of Olive Boulevard

between Woods Mill Road and Fernview Drive, in the City of Creve Coeur, Missouri, as
a replacement for the existing inadequate 8-inch diameter sanitary sewer; said contact
to be comprised of such terms and conditions as are approved by the office of the
General Counsel of the District.
Section Three. This ordinance, being an appropriate ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted August 5, 1999 by the following vote –
Ayes – G.J. Sheffield, C.D. Seward, J.W. Siscel, and M.C. Williams.
Nays – None.
