The Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING
Carteret preceding the Regular Meeting February 22, 2024 was held
Thursday, February 8, 2024, at approximately 6:00 p.m. remotely, via
telephone call -in.
Upon individual roll call, the following were noted present: ROLL CALL

Also noted present were Municipal Clerk, Carmela Pogorzelski and
Robert J. Bergen, Esq., Law Director.
The meeting was opened with a moment of silent prayer and the PRAYER, PLEDGE
Pledge of Allegiance led by Councilmember Krum. OF ALLEGIANCE
Notice was entailed to The Home News Tribune and The Star Ledger STATEMENT OF
posted on the bulletin board and on the doors of the Memorial MEETING NOTICE
Municipal Building on January 24, 2024. Notice was published in The
Home News Tribune and The Star Ledger on January 30, 2024. All
items being voted on tonight were posted on the Borough's website,
www.carteret.net prior to tonight's meeting.
Upon MMS&C, by Councilmembers Krum and Naples and unanimous APPROVAL OF
affirmative vote of the full membership present, the minutes of MINUTES
January 18, 2024 were approved as transcribed and engrossed by the
Clerk.
ORDINANCE #24-1 was introduced and adopted on First Reading ORDINANCE #24-1
and the Clerk authorized and directed to advertise same for Public AMENDING
Hearing, upon MMS&C, by Councilmembers Krum and Bellino. CHAPTER 118
Upon individual roll call vote, Councilmembers Bellino, Diaz,
DiMascio, Johal, Krum and Naples voted in the affirmative.

ORDINANCE #24-1
"AMENDING & SUPPLEMENTING CHAPTER 118
ARTICLE II, CHAPTER §118-15"
Mayor Reiman said this Ordinance is from the Board of Health with
regard to holding both the landlord and the tenant accountable if the
tenant has an unlicensed dog or cat. He said the landlord may be
charging additional fees for having a pet but not making the tenant
register with the Board of Health. He said they are required to do so
by state law. He said we want to make sure we hold the property
owner and the person who owns the dog or cat responsible.
DRDINANCE #24-2 ORDINANCE #24-2 was introduced and adopted on First Reading
AMENDING and the Clerk authorized and directed to advertise same for Public
;HAPTER §254-62 Hearing, upon MMS&C, by Councilmembers Krum and DiMascio.
Upon individual roll call vote, Councilmembers Bellino, Diaz,
DiMascio, Johal, Krum and Naples voted in the affirmative.
ORDINANCE #24-2
"AMENDING & SUPPLEMENTING ARTICLE IX,
CHAPTER §254-62"
Mayor Reiman said this has to do with Title 39 which allows
agreements with the Borough so the Borough can enforce motor
vehicle violations on private property. He said the Borough has
agreements with the shopping center and other larger developments.
He said he believes this has to do with the Crow Project and would
allow police to inspect property as they are driving through the area.
?UBLIC PORTION A copy of each Resolution was posted on the Borough's website for
IESOLUTIONS/ public review prior to the meeting in accordance with the Rules of
AGENDA ITEMS Council. Upon MMS&C, by Councilmembers Bellino and DiMascio
k NEW BUSINESS and unanimous affirmative vote of the full membership present, the
meeting was opened for public input on all Resolutions/Agenda items
and new business.

David said he wants to update the cannabis Ordinance with regard to DAVID (RESIDENT)
the distance from residences and lowering the prohibited distance by
parks and schools to be more competitive with other towns. He said
he and his partners are longtime residents of Carteret and felt this
would be a positive change.
Mayor Reiman said the Borough encouraged and allowed up to four
(4) types of cannabis facilities but there is some disconnect between
the state and federal guidelines, he explained. He told David to come
in and meet with his Chief of Staff or Zoning Department to see what
would fit then explained some differences with Borough and federal
laws.
David asked who he should reach out to.
Mayor Reiman said his Chief of Staff, Frank.
There being no further comments or objections to the
Resolutions/Agenda items or new business, upon MMS&C, by
Councilmembers Bellino and Naples and unanimous affirmative vote
of the full membership present, the meeting was closed.

AUTHORIZING A PROFESSIONAL SERVICES CONTRACT WITH
THE LAW FIRM OF BATHGATE, WEGENER & WOLF
WHEREAS, the Borough of Carteret is in need of professional legal services in
connection with various projects within the Borough; and
WHEREAS, the law firm of Bathgate, Wegener & Wolf, possess the requisite skill and
expertise to provide said services; and
WHEREAS, Bathgate, Wegener & Wolf have submitted a proposal to provide said legal
services in accordance with the Borough's Fair and Open Process; and
WHEREAS, the Mayor and Council have reviewed said proposal which is on file in the
Borough Clerk's Office; and -
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the law firm of Bathgate, Wegener & Wolf is hereby retained
to provide professional legal services with regard to various
projects within the Borough at a total cost not to exceed
$25,000.00, billable, all in accordance with Bathgate, Wegener &
Wolf's proposal.
2. That this action is approved as an award of a professional services
contract pursuant to N.J.S.A. 40A:11-5(i)(a) in accordance with
the Borough's Fair and Open Process as authorized by law.
3. A copy of this Resolution be forwarded to the Borough's
Purchasing Department and Bathgate, Wegener & Wolf.

AWARDING CONTRACT FOR THE MARINA STRUCTURES FOR
THE CARTERET FERRY TERMINAL
WHEREAS, the Borough of Carteret ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Marina
Structures for the Carteret Ferry Terminal Project ("Project");
WHEREAS, the Borough has previously received bids for said Project on January 10, 2024; and
WHEREAS, Grade Construction, 110 Pennsylvania Avenue, Paterson N.J. 07503, ("Grade"),
initially appeared to be the low bidder for the Project, however Grade requested to withdraw its
bid pursuant to N.J.S.A. 40A:11-23.3, and the Borough Law Director has recommended to the
Governing Body that Grade be allowed to so withdraw its bid pursuant to the statute and case
law; and
WHEREAS, the remaining low bidder is George Harms Construction Co, Inc., Yellowbrook
Road, Howell, N.J. 07731, ("Harms") in the amount of $7,945,299.00; and
WHEREAS, the Borough's Consulting Engineer for the Project has reviewed the above
referenced bid proposal(s) and has recommended an award of a contract for the Project to Harms;
and
WHEREAS, the Borough's Chief Financial Officer has certified that, funds are or will be
available for the award of a contract for said Project.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of die Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the Marina Structures for the
Carteret Ferry Terminal to George Harms Construction Co., Inc., in the amount
of $7,945,299.00, subject to any required approval by any outside governmental
agencies.
2. That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract with George Harms Construction Co., Inc., for the aforesaid
amount, in a form acceptable to the Borough Law Director and in accordance in
all respects with the request for bids and bid on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Law Director,
Purchasing Department and Consulting Engineer for distribution at the direction
of the Law Director.

AWARDING CONTRACT FOR THIN SITE IMPROVEMENTS UPLAND WORK FOR
THE CARTERET FERRY TERMINAL AT ARTHIUR KILL
WHEREAS, the Borough of Carteret, (`Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Site
Improvements Upland Work for the Carteret Ferry Terminal at Arthur Kill Project ("Project");
WHEREAS, the Borough has previously received bids for said Project on February I, 2024; and
WHEREAS, Grade Construction, 110 Pennsylvania Avenue, Paterson N.J. 07503, ("Grade"),
initially appeared to be the low bidder for the Project, however Grade requested to withdraw its
bid pursuant to N.J.S.A. 40A:11-23.3, and the Borough Law Director has recommended to the
Governing Body that Grade be allowed to so withdraw its bid pursuant to the statute and case
law; and
WHEREAS, the remaining low bidder is Tomco Construction, Inc., 22 Howard Blvd, Ste. 204,
Mount Arlington, N.J. 07856, ("Tomco") in the amount of $5,638,646.00; and
WHEREAS, the Borough's Consulting Engineer for the Project has reviewed the above
referenced bid proposal(s) and has recommended an award of a contract for the Project to Torino;
and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
available for the award of a contract for said Project.
NOW THEREFORE BE IT RESOLVED by die Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the site Improvements Upland Work
for the Carteret Ferry Terminal at Arthur Kill to Tunica Construction, Inc., in the
amountof $5,638,646.00, subject to any required approval by any outside
governmental agencies.
2. That the appropriate Borough Officials Inc hereby authorized and directed to
enter into a contract with Trumann Construction, Inc., for the aforesaid amount, in
a form acceptable to the Borough Law Director and in accordance in all respects
with the request for bids and bid on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Law Director,
Purchasing Department, and Consulting Engineer for distribution at the direction

A RESOLUTION TO ADOPT PROCEURES FOR ADMINISTRATION AND
INSPECTION OF FEDERAL AID HIGHWAY PROJECTS
WHEREAS, the Federal Highway Administration (FHWA) provides opportunities for
Local Public Agencies (LPA), such as the Borough of Carteret, to receive Federal Aid
Highway Program (FAHP or federal -aid) funds through New Jersey Department of
Transportation (NJDOT); and
WHEREAS, the Borough of Carteret is presently the recipient of federal -aid funds
awarded through a project under the 2023 TA Set Aside Program for the Carteret
Waterfront Multi -Use Pathway Project; and
WHEREAS, the Borough of Carteret as an LPA, is responsible for administering
federal -aid funded projects in compliance with all federal -aid requirements established by
the FHWA; and
WHEREAS, the NJDOT, through its Stewardship Agreement with FHWA, is
responsible for ensuring that the Borough of Carteret is adequately staffed and suitably
equipped to undertake federal -aid projects, and ensure that federal requirements are met;
and
WHEREAS, the Borough of Carteret, as required by the NJDOT, has developed a Policy
outlining the required procedures for the Administration of Federally Funded
Transportation Projects administered through the NJDOT;
NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Carteret,
County of Middlesex, State of New Jersey, that the Borough of Carteret adopts the policy
entitled, "Borough of Carteret Procedure for Administration and Inspection of federal Aid
Highway Projects" dated July 2023.
