HomeMy Public PortalAbout10642 O R D I N A N C E NO. 10642 AN ORDINANCE, to extend the boundaries of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the District; and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District, and that the interest of sanitation and public health of the District will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer or drainage facilities of the District can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of The Metropolitan St. Louis Sewer District are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deed of the City of St. Louis and the Secretary of State. The foregoing Ordinance was adopted October 14, 1999 by the following vote – Ayes – C.L. Barnhart, P.P. Finn, C.D. Seward, J.W. Siscel, and M.C. Williams. Nays – None. Secretary-Treasurer Exhibit A Commencing at a point being the intersection of the South line of State Highway 100 of varying width and the west line of Section 1, Township 44 North, Range 3 East, said point being the northeast corner of a tract of land conveyed to AMOCO Oil Company by deed recorded in Book 7970, Page 0858 of the St. Louis County, Missouri Recorder=s Office; thence southerly along said west line of Section 1, also being the east line of said AMOCO Oil Company tract a distance of 244.34 feet to the southeast corner, thereof, said point also being The Point of Beginning; thence westerly along the south line of said AMOCO Oil Company tract, and the north line of a tract of land conveyed to Alice G. Schneider, Etal by deed recorded in Book 6362, Page 500 of said Recorder=s Office a distance of 322.50 feet, to the east right of way line of State Highway 109 of varying width; thence southerly along said east right of way line of State Highway 109, to its intersection with the eastern prolongation of the south line of a tract of land conveyed to St. Onge Properties L.L.C. by deed recorded in Book 11268, Page 635 of said Recorder=s Office, and the north line of a tract of land conveyed to Slavik Associates Trustee by deed recorded in Book 9567, Page 2121 of said Recorder=s Office; thence westerly along said prolongation to the west right of way line of said State Highway 109, also being the southeast corner of said St. Onge tract; thence northwesterly along said south line of said St. Onge tract a distance of 808.11 feet, to the southwest corner thereof; thence northerly along the west line of said St. Onge tract a distance of 83.00 feet, to the northwest corner thereof, said corner being on the south line of a tract of land conveyed to Alice Schneider by deed recorded in Book 4795, Page 432 of said Recorder=s Office; thence easterly along the north line of said St. Onge tract, and the south line of said Schneider tract a distance of 603.06 feet, to the east corner of said Schneider tract, said corner being on the south right of way line of the aforementioned State Highway 100; thence northwestwardly along said south right of way line of State Highway 100, and the north line of said Schneider tract a distance of 270.05 feet to an angle point on said south right of way line of State Highway 100; thence continuing northwestwardly along south right of way line of State Highway 100 to its intersection with the southern prolongation of the west line of a tract of land conveyed to Bowers Property, LTD. By deed recorded in Book 7937, Page 926 of said Recorder=s Office; thence northerly along said southern prolongation and west line of said Bowers tract, to the northwest corner, thereof, said point being the southwest corner of ALafayette Trails@, a subdivision as recorded by plat in Book 324, Page 75 of said Recorder=s Office; thence easterly along the north line of said Bowers tract, and the south line of said ALafayette Trails@ subdivision and the eastwardly prolongation of said south line to the centerline of State Highway 109 of varying width; thence northerly along said centerline to the centerline of Old Eatherton (40 foot wide) Road; thence southeasterly along said centerline of Old Eatherton Road to the south right of way line of the aforementioned State Highway 100; thence westerly along said south right of way line to the east line of the aforementioned AMOCO Oil Company tract and the west line of the aforementioned Section 1; thence southerly along said west line of Section 1, and the east line of said AMOCO Oil Company tract distance of 244.34 feet to the True Point of Beginning.
