AN ORDINANCE, vacating a portion of a ten foot (10') wide easement
originally granted to the City of Kirkwood, Missouri, as recorded in Deed Book 3172,
Page 199 of the St. Louis County Records, said portion of easement being in Lots 1, 2,
3, 6 and 7 of The Oaks at Station Bend, a subdivision according to the plat thereof as
recorded in Plat Book 347, Page 91 of the St. Louis County Records, in the City of
Kirkwood, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this District
to vacate the portion of subject easement, and this District has no further use for said
portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the ten foot (10') wide easement originally
granted to the City of Kirkwood, Missouri, as recorded in Deed Book 3172, Page 199 of
the St. Louis County Records, as shown hachured on the attached AEasement Vacation
Plat@, and marked Exhibit AA@ and made a part hereof, is hereby vacated
EXCEPTING THEREFROM the easements established by the Plat of The Oaks at
Station Bend, a subdivision according to the plat thereof as recorded in Plat Book 347,
Page 91 of the St. Louis County Records, in the City of Kirkwood, St. Louis County,
Missouri.
The foregoing Ordinance was adopted December 9, 1999 by the following vote –
Ayes – C.L. Barnhart, G. J. Sheffield, C.D. Seward, J.W. Siscel, and P.P. Finn.
Nays – None
