AN ORDINANCE, vacating a portion of a twelve foot (12') wide
easement originally granted to the City of Ellisville, Missouri, as recorded in Deed
Book 6454, Page 1023 of the St. Louis County Records; a portion of a twelve foot
(12') wide easement originally granted to the City of Ellisville, Missouri, as
recorded in Deed Book 6454, Page 1021 and Deed Book 6473, Page 1509 of the
St. Louis County Records; and a ten foot (10') wide easement as recorded in Deed
Book 10013, Page 511 of the St. Louis County Records, said easements being in A
Tract of Land in the Northeast 1/4 and the Southeast 1/4 of Section 5, Township
44 North, Range 4 East, now known as Polo Lake, a subdivision recorded in Plat
Book 346, Pages 465 and 466 of the St. Louis County Records, in the City of
Ellisville, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this
District to vacate the portions of subject easement, and this District has no
further use for said portions,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the twelve foot (12') wide easement as
recorded in Deed Book 6454, Page 1023; the portion of the twelve foot (12') wide
easement as recorded in Deed Book 6454, Page 1021 and Deed Book 6473, Page
1509; and the ten foot (10') wide easement as recorded in Deed Book 10013, Page
511, all as shown hachured on the attached AEasement Vacation Plat@, and
marked Exhibit AA@ and made a part hereof, are hereby vacated, EXCEPTING
THEREFROM, the easements established by the plat of Polo Lake, a subdivision
recorded in Plat Book 346, Pages 465 and 466 of the St. Louis County Records, in
the City of Ellisville, St. Louis County, Missouri.
The foregoing Ordinance was adopted May 11, 2000 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, C.D. Seward, P.P. Finn, J.W. Siscel, M.C.
Williams.
Nays – None.
