AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer to grant to Union Electric Company, d/b/a AmerenUE, easements for
the construction, reconstruction, use, operation and maintenance of electric lines
and appurtenances thereto upon, over and across certain property of the District
known as the Coldwater Creek Treatment Plant property, in the City of Florissant,
Missouri, and to execute an instrument giving effect thereto upon the conditions
hereinafter set out.
WHEREAS, the Union Electric Company has asked the District for the
right to construct, operate and maintain said electric lines, over and across
certain hereinafter described real property of the District known as the Coldwater
Creek Treatment Plant property, and the District is desirous of granting such right
for the good of the general public.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District does hereby
grant to the Union Electric Company, d/b/a AmerenUE easements for the
construction, reconstruction, use, operation and maintenance of electric lines and
appurtenances thereto upon, over and across certain real property of the District
known as the Coldwater Creek Treatment Plant property, in the City of Florissant,
Missouri, in order to provide electric power to said real property and the adjoining
real property, such easements being described as follows:
A permanent easement one hundred feet (100') wide in a tract of land
situated partly in the southeast 1/4 of fractional Section 18, and
partly in U.S. Survey 210, both in Township 47 North, Range 7 East,
St. Louis County, Missouri, said one hundred (100) foot wide
easement running a distance of 2,713'∀ between the East property
line and the West property line, with the north side of the 100' wide
easement being the same line as the Northern property line of tract
described by deed recorded in Deed Book 6375, Page 1136 of the St.
Louis County, Missouri records. Said one hundred (100) foot wide
strip of land being indicated hachured on the drawing attached
hereto marked Exhibit "A" and made a part hereof.
A permanent easement fifty (50) feet wide in a tract of land situated in
U. S. Survey 104, Township 47 North, Range 7 East, St. Louis
County, Missouri, said fifty (50) foot easement running a distance of
825'∀ between the South property line and the North property line
with the East side of the 50' wide easement being the same line as the
Eastern property line of tract described in Deed Book 6625, Page 865
of the St. Louis County, Missouri records. Said fifty (50) foot wide
strip of land being indicated hachured on the drawing attached
hereto marked Exhibit "A" and made a part hereof.
Section Two. The Executive Director and Secretary-Treasurer
are hereby authorized to execute in behalf of the District an instrument giving
effect to Section One.
The foregoing Ordinance was adopted January 11, 2001 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, C.D. Seward, P.P. Finn, and
J.W. Siscel.
