AN ORDINANCE, vacating a portion of a five foot (5') wide and seven
and one-half foot (7.5') wide easement as established on Lot 1, and a portion of a
five foot (5') wide and seven and one-half foot (7.5') wide easement as established
on Lot 2, and a portion of a seven and one-half foot (7.5') wide easement as
established on Lot 11, all of AHighland on Conway Plat No. 1", a subdivision
according to the plat thereof recorded in Plat Book 83, Page 23 of the St. Louis
County Records and shown on Adjusted Lot A and Adjusted Lot B of ABoundary
Adjustment Plat of part of Original Lot 2 and all of Lot 1 of Highland on Conway
Plat No. 1, Plat Book 83, Page 23, and part of Adjusted Lot 2 of a Boundary
Adjustment Plat of Lots 2 and 11 of Highland on Conway Plat No. 1, Plat Book
301, Page 53 in U.S. Survey 366, Township 45 North, Range 4 East, City of
Chesterfield, St. Louis County, Missouri@, a boundary adjustment according to the
plat thereof recorded in Plat Book 348, Pages 638 and 639 of the St. Louis County
Records in the City of Chesterfield, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this
District to vacate the portions of the subject easements, and this District has no
further use for said portions,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the five foot (5') wide and seven and one-
half foot (7.5') wide easement as established on Lot 1, and the portion of the five
foot (5') wide and seven and one-half foot (7.5') wide easement as established on
Lot 2, and the portion of the seven and one-half foot (7.5') wide easement as
established on Lot 11, all of AHighland on Conway Plat No. 1", a subdivision
according to the plat thereof recorded in Plat Book 83, Page 23 of the St. Louis
County Records and shown on Adjusted Lot A and Adjusted Lot B of ABoundary
Adjustment Plat of part of Original Lot 2 and all of Lot 1 of Highland on Conway
Plat No. 1, Plat Book 83, Page 23, and part of Adjusted Lot 2 of a Boundary
Adjustment Plat of Lots 2 and 11 of Highland on Conway Plat No.1, Plat Book
301, Page 53 in U.S. Survey 366, Township 45 North, Range 4 East, City of
Chesterfield, St. Louis County, Missouri, a boundary adjustment according to the
plat thereof recorded in Plat Book 348, Pages 638 and 639 of the St. Louis County
Records, in the City of Chesterfield, St. Louis County, Missouri as shown
hachured on the attached AEasement Vacation Plat@, and marked Exhibit AA@ (1
of 3)(2 of 3) (3 of 3), respectively, and made a part hereof, is hereby vacated.
The foregoing Ordinance was adopted January 11, 2001by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, C.D. Seward, P.P. Finn, and
J.W. Siscel.
