AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey
to the 370/Missouri Bottom Road/Taussig Road Transportation Development
District, certain real property of the District located in St. Louis County, Missouri
and prescribing the terms of said transaction.
WHEREAS, the real property hereinafter described has been declared
as surplus pursuant to Resolution No. 2165, adopted January 12, 1995, and
WHEREAS, pursuant to Resolution No. 2016, adopted September 18,
1991, said real property was appraised and the sale price was negotiated with an
agency having the power of eminent domain.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District are hereby authorized to sell
and convey to 370/Missouri Bottom Road/Taussig Road Transportation
Development District, certain real property of the District located in St. Louis
County, Missouri for the total sale price of Three Million Eight Hundred Fifty
Thousand Dollars ($3,850,000.00), said real property being described as follows:
Beginning at the intersection of the Southeast line of Prouhet Farm Road (formerly
Taussig Road), 40 feet wide, with the East line of property conveyed to William
Prouhet by deed recorded in Book 5950, Page 179 of the St. Louis County
Records, said East line being also the centerline of Cow Mire Creek; thence North
51 degrees 56 minutes 17 seconds East 380.76 feet, along said Southeast line of
Prouhet Farm Road to the Southwest line of Missouri Bottom Road, 40 feet wide;
thence South 37 degrees 06 minutes 43 seconds East 1575.07 feet, along the said
Southwest line of Missouri Bottom Road to the North line of property conveyed to
the State of Missouri by deed recorded in Book 856, Page 628 of the St. Louis
County Records, being the West right-of-way line of Missouri State Route 115;
thence South 65 degrees 38 minutes 19 seconds West 8.26 feet along said right-
of-way line to a point; thence South 26 degrees 36 minutes 34 seconds East
147.26 feet and South 13 degrees 03 minutes 51 seconds East 2.48 feet along
said right-of-way line of Missouri State Route 115 to the Northwest line of property
conveyed to Samuel B. Murphy Irrevocable Living Trust UTA by deed recorded in
Book 9793, Page 1729 of the St. Louis County Records; thence South 51 degrees
58 minutes 58 seconds West 1203.23 feet along said Northwest line of Samuel B.
Murphy property to the Northeast line of "Bailey and Prouhet Subdivision", a
subdivision according to the plat thereof recorded in Plat Book 331, Page 63 of the
St. Louis County Records; thence North 36 degrees 50 minutes 20 seconds West
716.97 feet along said Northeast line of "Bailey and Prouhet Subdivision" to the
most Southern corner of the aforesaid Prouhet property, being also the centerline
of Cow Mire Creek; thence Northwardly along the East line of Prouhet property
and the centerline of Cow Mire Creek, the following courses and distances: North
18 degrees 22 minutes 59 seconds West 115.88 feet, North 03 degrees 48 minutes
45 seconds East 101.00 feet, North 02 degrees 28 minutes 45 seconds East 76.00
feet, North 07 degrees 36 minutes 53 seconds East 105.70 feet, North 06 degrees
01 minute 15 seconds West 34.00 feet, North 19 degrees 06 minutes 05 seconds
West 72.14 feet, North 08 degrees 55 minutes 37 seconds West 101.02 feet, North
02 degrees 21 minutes 15 seconds West 130.00 feet, North 08 degrees 38 minutes
45 seconds East 120.00 feet, North 14 degrees 12 minutes 07 seconds East
237.73 feet, North 09 degrees 28 minutes 48 seconds East 134.00 feet, North 13
degrees 19 minutes 57 seconds East 72.95 feet, North 19 degrees 28 minutes 45
seconds East 22.00 feet, North 11 degrees 28 minutes 45 seconds East 23.00 feet
and North 16 degrees 27 minutes 42 seconds East 7.75 feet to the point of
beginning and containing 40.475 acres according to a survey by Volz, Inc. during
January, 1995.
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to
execute and deliver a Special Warranty Deed and any and all other documents as
approved by the office of the General Counsel of the District as may be necessary
to effect the sale and conveyance as authorized in Section One above, and further
to deposit the proceeds from said sale and conveyance in the reserve for Real
Property Purchase, Improvement and Alterations Account.
The foregoing Ordinance was adopted February 8, 2001 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, P.P. Finn, and J.W. Siscel.
Nays – None.
