AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an
easement agreement with the Missouri Highways and Transportation Commission,
granting and conveying to the Commission the right to construct, reconstruct and
maintain a section of Route 364 in the vicinity of Bennington Place, in accordance
with certain road plans on file in the office of County Clerk of St. Louis County,
Missouri, over and across a portion of an easement owned and held by MSD and
situated in Township 46N, Range 5E, St. Louis County, Missouri, said easement
also being within the right-of-way of the proposed highway improvement.
WHEREAS, the District has an easement situated in Township 46N,
Range 5E, St. Louis County, Missouri, said easement also being within the right-
of-way of Route 364, and
WHEREAS, the Missouri Highways and Transportation Commission
proposes to construct and improve a section of Route 364 in the vicinity of
Bennington Place, in accordance with certain road plans on file in the office of
County Clerk, St. Louis County, Missouri, and
WHEREAS, the Missouri Highways and Transportation Commission
has requested that the District enter into an easement agreement, whereby the
District grants and conveys to the Commission the right to construct, reconstruct
and maintain said highway over and across a portion of said easement,
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into an easement agreement whereby the District will grant and convey to the
Missouri Highways and Transportation Commission the right to construct,
reconstruct and maintain a highway over and across that portion of an easement
owned and held by MSD, situated in Township 46N, Range 5E, St. Louis County,
Missouri and more particularly described as follows:
That portion of the District's easement located in Section
28, Township 46 North, Range 5 East in St. Louis
County, Missouri and described as beginning at a point
on the centerline of Route 364, being at Station 29+700
on the hereinafter described center of Route 364; thence
leaving said centerline and extending Southwesterly to a
point 45.759 meters (150.13 feet) radial distance
Southwest of said centerline Station 29+700; thence
Southeasterly to a point 50.737 meter (166.46 feet)
radial distance Southwest of center Station 29+729.044;
thence Southeasterly to a point 56.929 meters (186.77
feet) radial distance Southwest of centerline Station
29+756.264; thence Easterly to a point 52.679 meters
(172.83 feet) radial distance Southwest of centerline
Station 29+778.525; thence Easterly to a point 46.500
meters (152.56 feet) radial distance Southwest of
centerline Station 29+825.00; thence Southeasterly to a

THE POINT OF BEGINNING.
Said centerline of Route 364 being described as follows:
Commencing at an old stone marked with a cross cut on
top, approximately 4" x 6", Hulon D. McDaniel, R.L.S.
#276 found evidence of the corner described below
located and recorded in the Northeastern part of U.S.
Survey 1929, Township 46 North, Range 5 East recorded
as Seven Pines Plat II in St. Louis County Assessor's
Office in Book 163 Page 73, also referenced as Royal
Pines Plat I Book 231 Page 24 in St. Louis County,
Missouri; thence South 77 degrees 15 minutes 03
seconds West a distance of 256.205 meters to Station
28+355.591 on the centerline of Route 364, equals
Station 10+000 on the centerline of Seven Pines Drive,
being the point of beginning; (the angle of the tangent to
spiral curve bears 119 degrees 42 minutes 14 seconds);
thence to the right on said spiral curve for a distance of
57.395 meters to S.C. Station 28+412.986; (said spiral
curve having a X distance of 179.496 meters along the
main tangent of and Y distance of 10.029 meters offset
from the main tangent); thence to the right on a 46
degrees 48 minutes 23 second curve having an interior
angle of 65 degrees 59 minutes 57 seconds for a distance
of 438.974 meters to C.S. Station 28+851.961; thence to
the right on a spiral curve for a distance of 180.000
meters to S.T. Station 29+031.961 (said spiral curve also
having a X distance of 179.496 meters and a Y distance
of 10.029 meters); thence South 22 degrees 38 minutes
30 seconds East a distance of 314.751 meters to T.S.
Station 29+346.712; thence to the left on a spiral curve
for a distance of 180.000 meters to S.C. Station
29+526.712 (said spiral curve having a X distance of
179.496 meters along the main tangent and Y distance
of 10.029 meters offset from the main tangent); thence to
the left on a 62 degree 50 minutes 20 second curve
having an interior angle of 80 degrees 33 minutes 20
seconds for a distance of 638.437 meters to C.S. Station
30+165.149, thence to the left on a spiral curve for a
distance of 180.000 meters to S.T. Station 30+345.149
(said spiral curve also having a X distance of 179.496
and Y distance of 10.029 meters); thence North 76
degrees 48 minutes 10 seconds East a distance of
254.851 meters to centerline Station 30+600.00, BEING
THE POINT OF ENDING.
Section Two. The easement agreement as authorized in Section One
of this ordinance shall be comprised of such terms and conditions as are approved
by the office of the General Counsel of the District
The foregoing Ordinance was adopted March 8, 2001 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, P.P. Finn, J.W. Siscel, and C.D.
Seward.
