O R D I N A N C E NO. 10931
AN ORDINANCE, appropriating Three Hundred Thousand Dollars
($300,000.00) from the Sanitary Replacement Fund to reimburse the Missouri
Highways and Transportation Commission for a portion of the cost to construct
approximately 1,620 feet of 12-inch to 18-inch diameter sanitary relief sewer
located in the vicinity of Bennington Place and Route 364, in the City of Maryland
Heights, Missouri and in the Unincorporated Area of St. Louis County, Missouri,
for the replacement of the existing inadequate 8-inch diameter sanitary sewer; and
authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into an agreement with the Missouri
Highways and Transportation Commission for the aforesaid construction.
WHEREAS, the Missouri Highways and Transportation Commission
proposes to construct and improve a section of Route 364 in the vicinity of
Bennington Place, in accordance with certain road plans on file in the office of
County Clerk of St. Louis County, Missouri, and
WHEREAS, in order to improve said highway in accordance with said
plans, it will be necessary to relocate an existing 8-inch diameter sanitary sewer,
and
WHEREAS, the District's Engineering Department has determined
that said sewer does not have adequate capacity to serve existing customers, and
has identified a sanitary relief project to upgrade said sewer (CC-15 Seven Pines to
Bennington Place Sanitary Relief) (2001130), and
WHEREAS, the District is desirous that said sewer be upgraded at the
time of the relocation, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Thousand Dollars
($300,000.00) is hereby appropriated from the Sanitary Replacement Fund to
reimburse the Missouri Highways and Transportation Commission for a portion of
the cost to construct approximately 1,620 feet of 12-inch diameter to 18-inch
diameter sanitary relief sewer located in the vicinity of Bennington Place and
Route 364, in the City of Maryland Heights, Missouri and in the Unincorporated
Area of St. Louis County, Missouri, for the replacement of the existing inadequate
8-inch diameter sanitary sewer.
Section Two: The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into an agreement whereby the Missouri Highways and Transportation
Commission will construct approximately 1,620 feet of 12-inch diameter to 18-
inch diameter sanitary relief sewer located in the area of Bennington Place and
Route 364, in the City of Maryland Heights, Missouri and in the Unincorporated
Area of St. Louis County, Missouri, for the replacement of the existing inadequate
8-inch diameter sanitary sewer; said agreement to be comprised of such terms
and conditions as are approved by the office of General Counsel of the District.
Section Three. This ordinance, being an appropriate ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 12, 2001 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, A.J. Soukenik, J.W. Siscel, and
C.D. Seward.
