HomeMy Public PortalAbout10941O R D I N A N C E NO. 10941 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a Utility Facility Relocation Agreement with the City of St. Louis, Missouri whereby the District and the City of St. Louis agree to mutually cooperate to facilitate the reconstruction, relocation, removal or abandonment, by the City, of certain sanitary and storm sewers and drainage facilities (“MSD facilities”) as part of the construction of the W1- W Expansion of the Lambert-St. Louis International Airport. WHEREAS, the City of St. Louis is the owner and operator of Lambert-St. Louis International Airport, located in the County of St. Louis, Missouri (“Airport”), and WHEREAS, the City of St. Louis, under authority of City Ordinance 64279 approved March 9, 1998, as amended, has established a multi-year public works and improvement program at the Airport providing for the development, improvement, construction, rehabilitation, reconfiguration and expansion of the Airport (W1-W Expansion Program), and WHEREAS, the City of St. Louis has purchased or intends to purchase under its W1-W Expansion Program additional properties adjacent to the Airport (“Expansion Area”), and WHEREAS, the District has existing sanitary, storm and drainage facilities (“MSD Facilities”) within said Expansion Area, and WHEREAS, it will be necessary for the City of St. Louis to reconstruct, relocate, remove or abandon said MSD Facilities (“Sewer Modifications”) as part of the said W1-W Expansion, and WHEREAS, both the District and the City are desirous of entering into an agreement outlining the working relationship and defining the responsibilities of each party to facilitate the construction of said Sewer Modifications in a timely manner so as to not impact the progress of the City’s W1-W Expansion Program. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a Utility Facility Relocation Agreement with the City of St. Louis, Missouri outlining the working relationship and defining the responsibilities of each party with regard to the construction, reconstruction, relocation or abandonment of MSD facilities with the Lambert-St. Louis International Airport Expansion Area required as part of the City’s W1-W Expansion Program. Section Two. The Utility Facility Relocation Agreement authorized in Section One of this ordinance shall be comprised of such terms and conditions as approved by the office of General Counsel of the District. The foregoing Ordinance was adopted April 12, 2001 2001 by the following vote – Ayes – T.W. Purcell, M.G. Reichert, J.W. Siscel, C.D. Seward, and A.J. Soukenik. Nays – None. Secretary-Treasurer
