AN ORDINANCE AMENDING CHAPTER 3 (ADVERTISING AND SIGNS) OF THE CODE OF
THE CITY OF JEFFERSON , MISSOURI, PERTAINING TO ELECTRONIC MESSAGE
CENTERS .
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS
FOLLOWS:
Section 1 . Chapter 3 (Advertising and Signs), Sect ion 2 (Definitions), is amended as
follows :

Section 2. Chapter 3 (Advertising and Signs), Section 4 (On-Premise Signs), Subsection
H, is amended as follows :

and shall be building mounted or part of a d et a ched ground s ign.
2 . A premi ses may have no more than one electroni c message cent er s ign unl ess the prem ises abut s
more th an o ne street fro nt , in whi ch case it may have two e lectro ni c message ce nters, with a
maxi mum of o ne e lectron ic message center per stree t fro ntage. A second e lectroni c message
ce nter s ha ll no t increase th e total all owed s ig nage as permi tte d und er sec ti o n J-4-JJ 3-4.H.3 of the
C ity Co de.
3. Electro nic message centers may co mprise no more than 50% of a pre mi ses total a ll owed signage.
4 . Th e message di spl ayed sha ll be used onl y for on -pre mise ad vertis in g o r AMBER alerts.
5. Elec troni c message center s igns shall be eq ui pp ed wi th automat ic dimmin g tec hno logy wh ich
auto mat icall y adju sts the s ign 's br ightn ess based on natura l ambient li g ht co nd it io ns. No
e lec troni c mess age ce nte r sign may excee d a br ightness leve l of 0.3 foot candl es above ambie nt
li ght as meas ured us in g a foot cand le meter at a preset dis tance depend ing on s ign area, measured
as fo ll ows:

6. Any di splay on the e lectronic message center shall remai n illuminated and visibl e for at lea st fo ur
seconds.
7. Messages may be replaced at intervals prescribed in paragraph 6 above, but s hall not fla sh or
scroll.
8 . Protected areas:
a. "Protected area" is defined as a residential zo ne, a city park, a property identified on the
National Register of Historic Pl aces, a property located within a N atio na l Register of
Histor ic Places District, a property located within a C ity of Jefferson Historic Di s trict.
b. An e lectronic me ssage center located w ith in 25 0 feet of a protected area may Aat SJ3erate
shall be turned off or set to a static display between the hours of I 0 :00 p.m. and 6:00
a.m. of the following day.
9. Except as provided in Section 4.H.l.(c), e lectronic message cente r s igns are prohibited wi thin
I 00 feet of a protected area if any part of the s ig n face wo uld be v is ibl e fro m the protected area. A
conservation di strict or other overl ay district may exclud e Electroni c Message Centers from being
erected within the di strict, after creation of the di strict.
10 . All electronic s igns shall be underwrite r laboratory li sted.
II . No e lectron ic message center shall be d is playe d in a fas hi o n so as to be confused with emergency
light s, traffic li ghts, or other official signage.
12. A party aggrieved by a regul ation of this section may appeal the regulation to the Board of
Adjustment. The Board may g rant a va riance to the regulation if, among a ll other required findings
of the Board, it find s that beca use of topography or other unique c ircumstance, th e property wou ld
suffer a hardship b y e nforcem ent of th e regulation as drafted, and that by waiving the specific
provision of this secti o n, the economi c development base of the comm un ity wi ll be increased, and
th at the variance granted by the Board is the most re stri ctive the regulation can be and s till
accommodate the hards hip.

Helias Catholic H i gh School respectfully requests the C ity of Jefferson review the cmTent
code for Advertising and Signs, Chapter 3, for the potential of allowing an Electronic Message
Center for their facility located on Swifts Highway. It is our understanding the current code
prohibits pennitting of E l ectronic Message Centers for their zoning classification. The proposed
signage would be monument type and would be located west of the west entrance to the High
School.
