AN ORDINANCE OF THE CITY OF JEFFERSON , MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF HOLIDAY HOUSE ACRES SUBDIVISION , A SUBDIVISION
OF THE CITY OF JEFFERSON , MISSOURI.
WHEREAS, River City Habitat for Humanity, owner of the real estate hereinafter described ,
having submitted to the City Council a plat of said real estate, being located in
Jefferson City, Cole County, Missouri , and described as : Part of the Northeast
Quarter of the Southeast Quarter of Section 22 , Township 44 North , Range 11
West, City of Jefferson, Cole County, Missouri , more particularly described as
follows : From the northeast corner of the Northeast Quarter of the Southeast
Quarter of said Section 22 ; thence S05 °15'53"E, a long the Section Line , 349 .94 feet
to the POINT OF BEGINNING for this description ; thence cont inuing along the
Section Line, S05 °15'53"E , 245 .64 feet to a point on the northerly right of way line
of Moreau View Drive; thence Northwesterly, along the northerly right of way line of
Moreau View Drive the following courses: Northwesterly on a curve to the left
having a radius of 844.04 feet , an arc distance of 83.49 feet, (the chord of said
curve being , N39°51 '21 "W , 83.45 feet); thence N42°41 '22"W, 22 .23 feet ; thence
northwesterly on curve to the left , having a radius of 7 41 .77 feet , an arc distance of
202 .83 feet , (the chord of said curve being, N50 °31 '22"W, 202 .19 feet); thence
N58°21 '22"W , 61 .41 feet ; thence leaving said northerly right of way line of Moreau
View Drive , N30°53'40"E, 133.49 feet ; thence S59 °07'17"E , 216 .51 feet to the
POINT OF BEGINNING for this description . Containing 0.94 acres; and
WHEREAS, it appearing that sa id plat has been fully and properly signed and accepted by the
owner of said subdivision , known and referred to as the Final Subdivision Plat of
Holiday House Acres Subdivision , that all taxes have been paid , that in all respects
the requirements of Chapter 445, RSMo , entitled "Plats" have been fully complied
with by the owner of said subdivision , and that in all respects the requirements of
the Planning and Zoning Commission of the City of Jefferson, Missouri , relating to
plats and subdivisions have been complied with .
NOW, THEREFORE , BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON ,
MISSOURI , AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Holiday House Acres Subdivision , lying ,
being and situated within the corporate limits of the City of Jefferson , Missouri , as shown by the
said plat attached hereto and made a part of this ordinance , is he reby approved and accepted by
the City Council of the City of Jefferson , Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P13016-Final Subdivision Plat of Holiday House Acres Subdivision. Application
filed by River City Habitat for Human ity , property owner, Marlene Medin , authorized
representative , for a Final Subdivision Plat of 0.94 acres cons isting of three lots. The property is
zoned RS-2 Low Densi ty Residential and is located on the north s ide of Moreau V iew Drive 400
feet east of Robinson Road a nd is described as Part of the Northwest Quarter of the Southeast
Q uarter of Section 22, Town s hip 44 North , Range 11 West, Jefferson City, Missouri (Centra l
Missouri Professional Services , Consultant).
Mr. Barron described the proposal and explained that th is property was originally owned by
Scholastic, and t he existin g house on the property was used as an office . He stated that the
property was rezoned from C-1 to RS-2 and separated from the adjacent Scholastic parking lot by
an administrative parcel division. Mr. Barro n explained that the property was then transferre d to
River C ity Habitat for Humanity. He stated th at Habitat wishes to divide the property into three lots ,
with the existing house o n th e propert y remaining on a s ing le lot and two new building lots being
c reated .
Mr. Kyle Kittrell , Construction Manager, River City Habitat for Humanity, 1420 Creek Trail Drive,
spoke rega rding this request. He explained that Scholastic, In c . approached them about a year ago
about some property that they would like to donate. Mr. Kittrell stated that once the property was
rezoned residential Scholastic In c. deeded it to t hem. He explained that the ir intent is to rehab the
existing house a nd bu il d two new houses on the remaining lots .
Mr. Mike Bates, Central Mi ssouri Professional Services , 2500 E. McCarty Stre et , spoke regarding
this request. Mr. Bates distributed two visua ls depicting the layout fo r the proposed subdivision . He
explained that the commercial zone d property would not have been compatible with the residential
neighborhood . Mr. Bates explai ned that they met with the neighborhood and addressed their
concerns.
No one spoke in opposition to this reque st and no correspond ence was received.
Mr. Wade gave the Engineering Division staff report.

Chairman Robinett announced that Mr. Jordan will abstain on Case No . P13016 and Ms . Cotten
will vote.
Mr. Nunn moved and Mr. Yarnell seconded to recommend approval of the Final Subdivision Plat
to the City Council subject to the following conditions :
1. Compliance with the comments and technical corrections of the Engineering Division .
2. Finalization of plat prior to introduction to City Council.
The motion passed 8-0 with the follow ing votes:

Background
This property was originally owned by Scholastic, and the existing hou se on the property was used as
an office. The property was rezoned from C-1 to RS-2 and separated from the adjacent Scholastic
parking l ot by an administrative parcel divis ion. The prop erty was then transferred to the River City
Habitat for Humanity. Habitat wishes to divide the property into three lots, with the existing house on
the property remaining on a single lot and two new building lots being created .

is a corner lot and meets the appl icable minimum lot area of 12 ,000 square feet.
Setbacks: The existing ho use located on propo se d Lot 1 wo uld meet the required setbacks of 10 feet
on the si des, 25 feet on the front, and 30 feet in the rear.
Streets: A 10 feet wide strip of property on the eastern side of the subdivis ion (adjacent to Lake Road,
a private unimproved roadway) is being dedicated as right-of-way in order to accommodate any future
w idening of Lake Road.
Staff Recommendation
Pending correction of minor technical item s remaining on the plat, staff recommends approval of the
fina l subdivision plat.
