AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING SUBSECTION (3) OF SECTION 2005
OF ARTICLE IX (ORDINANCE 63 -112) OF THE
TEMPLE CITY MUNICIPAL CODE, AND PROVIDING
FOR THE IMMEDIATE ENACTMENT HEREOF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council finds and determines that
Subsection (3) of Section 2005 of Article IX (Ordinance 63 -112)
of the Temple City Municipal Code is ambiguous with respect to
the proper interpretation thereof; and that, moreover, the
provisions of the State Planning and Zoning Law relevant to
such subsection were amended in 1965 to indicate the lack of
necessity for such subparagraph.
SECTION 2. Subsection (3) of Section 2005 of Article IX
(Ordinance 63 -112) is hereby amended to read as follows:
(3) A written notice shall be sent to the
owner or owners of subject property and to
the applicant if he be a person other than
the owner of the property, not less than
ten (10) days prior to the date of the
hearing on any type of application set forth
in subparagraph (2) above.
SECTION 3. The City Council finds and determines that it
is necessary for this Ordinance to become immediately effective
as an urgency Ordinance for the reasons set forth in Section 1
above and for the further reasons that such ambiguities have
led and will continue to lead to situations confusing to the
administrators of and those affected by the zoning ordinances
of the City.
SECTION 4. The City Clerk shall certify the adoption of
this Ordinance and cause the same to be published in the manner
prescribed by law.
