A RESOLUTION OF THE TOWN OF GULF STREAM SUPPORTING
THE PALM BEACH COUNTY ASSOCIATION OF CHIEFS OF
POLICE, INC., AND REQUESTING A REVIEW AND REVISION
OF THE FLORIDA JUSTICE SYSTEM.
WHEREAS, the Palm Beach County Association of Chiefs of Police,
Inc., as a result of their unique perspective as it relates to crime in Palm Beach
County, Florida, deemed it necessary to adopt a Resolution recommending changes
in our justice system in order to more effectively combat the increased crime
rate; and
WHEREAS, the Town Commission of the Town of Gulf Stream is in
complete support of the Palm Beach County Association of Chiefs of Police, Inc.,
in its goal to combat the increasing crime rate; and
WHEREAS, as set forth by the Palm Beach County Association of
Chiefs of Police, Inc., in their Resolution, the citizens of the State of Florida no
longer maintain the same respect for the Florida Justice System that they did in the
past and many of the citizens of the State live in fear of being the victims of
crimp and
WHEREAS, the Palm Beach County Association of Chiefs of Police, Inc.,
has determined that the criminal element no longer respects or fears the Florida
Justice System and the Florida Justice System has over a period of time been
subject to substantial reformation without due regard being given as to the effect
of those reforms on the increasing crime rate; and
WHEREAS, the law enforcement community has voiced its disagreement
with the philosophical direction the reforms in the Florida Justice System have
taken and by resolution has taken a strong stand on the matter of crime; and
WHEREAS, the Palm Beach County Association of Chiefs of Police, Inc.,
has determined that certain elements of the criminal justice system are characterized
by a laxity that encourages the criminal element of believe that crime pays.
WHEREAS, the Town Commission of Gulf Stream agree with Chief
Justice Warren Burger's comments concerning the present criminal justice system.
NOW, THEREFORE, BE IT RESOLVED that the Town Commission of the
Town of Gulf Stream ratifies and adopts the recommendations of the Palm Beach County
Association of Chiefs of Police, Inc., which are as follows:
1. That higher bond schedules be developed and uniformly adopted by
all judicial circuits.
2. That more stringent sentences be swiftly meted out, especially
those individuals who have a history of criminal involvement.
3. That sentencing equity be restored to the criminal system
and that most plea bargaining be eliminated.
4. That the responsibility for criminal activity be squarely placed
on the convicted individuals and that they be held responsible for all costs as-
sociated with the crime, including compensation to victims.
5. That funds be provided to build more prisons thereby eliminating
the revolving door policy which presently exists.
6. That the following measures be taken regarding the increasing
involvement of juvenile offenders in serious crimes:
a. The first offender be considered a higher priority
for rehabilatative counseling.
b. The repeat offenders be held more accountable for
their criminal acts.
c. That Health and Rehabilitated Services be held
accountable for the ever increasing recidivism
rate of juvenile criminals.
