AWARDING CONTRACT FOR TEE MARINA STRUCTURES FOR
THE CARTERET FERRY TERMINAL
WHEREAS, the Borough of Carteret ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Marina
Structures for the Carteret Ferry Terminal Project ("Project");
WHEREAS, the Borough has previously received bids for said Project on January 10, 2024; and
WHEREAS, Grade Construction, I10 Pennsylvania Avenue, Paterson N.J. 07503, ("Grade"),
initially appeared to be the low bidder for the Project, however Grade requested to withdraw its
bid pursuant to N.J.S.A. 40A:11-23.3, and the Borough Law Director has recommended to the
Governing Body that Grade be allowed to so withdraw its bid pursuant to the statute and case
law; and
WHEREAS, the remaining low bidder is George Harms Construction Co., Inc., Yellowbrook
Road, Howell, N.J. 07731, ("Harms") in the amount of $7,945,299.00; and
WHEREAS, tire Borough's Consulting Engineer for the Project has reviewed the above
referenced bid proposal(s) and has recommended an award of a contract for the Project to Harms;
and
WHEREAS, the Borough's Chief Financial Officer has certified that. funds are or will be
available for the award of a contract for said Project.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the Marina Structures for the
Carteret Ferry Terminal to George Harms Construction Co, Inc., in the amount
of $7,945,299.00, subject to any required approval by any outside governmental
agencies.
2. That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract with George Harms Construction Co., Inc, for the aforesaid
amount, in a form acceptable to the Borough Law Director and in accordance in
all respects with the request for bids and bid on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Law Director,
Purchasing Department and Consulting Engineer for distribution at the direction
of the Law Director.
