AWARDING CONTRACT FOR THE SITE IMPROVEMENTS UPLAND WORK FOR
TIM CARTERET FERRY TERMINAL AT ARTHUR KILL
WHEREAS, the Borough of Carteret, ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Site
Improvements Upland Work for tine Carteret Ferry Terminal at Arthur Kill Project ("Project");
WHEREAS, the Borough has previously received bids for said Project on February 1, 2024; and
WHEREAS, Grade Construction, 110 Pennsylvania Avenue, Paterson N.J. 07503, ("Grade"),
initially appeared to be the low bidder for the Project, however Grade requested to withdraw its
bid pursuant to N.J.S.A. 40A:11-23.3, and the Borough Law Director has recommended to the
Governing Body that Grade be allowed to so withdraw its bid pursuant to the statute and case
law; and
WHEREAS, the remaining low bidder is Tomco Construction, Inc., 22 Howard Blvd, Ste. 204
Mount Arlington, N.J. 07856, (" Tomco") in the amount of $5,638,646,00; and
WHEREAS, the Borough's Consulting Engineer for the Project has reviewed the above
referenced bid proposal(s) and has recommended an award of a contract for the Project to Tomco;
and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
available for the award of a contract for said Project.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the site Improvements Upland Work
for tine Carteret Ferry Terminal at Arthur Kill to Tomco Construction, Inc., in the
amountof $5,638,646.00, subject to any required approval by any outside
governmental agencies.
2. That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract with Toulon Construction, Inc., for the aforesaid amount, in
a form acceptable to the Borough Law Director and in accordance in all respects
with the request for bids and bid on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Law Director,
Purchasing Department and Consulting Engineer for distribution at the direction
of the Law Director.

Dear Mayor and Borough Council:
Enclosed herewith please find a summary of bids received on February 1, 2024, for the above
referenced project. A total of eight (8) bids were submitted, ranging from an apparent low bid of
$4,582,041.45 by Grade Construction to a high base bid of $8,858,294.00 by George Harms
Construction Company, Inc, The Engineer's Estimate for the project was $7,809,739.25. Please find
enclosed a complete Summary of Bids for the Council's review.

We understand that the apparent low bidder, Grade Construction, has submitted a request to
withdraw their bid pursuant to N.J.S.A § 40A:11-23.3 due to a clerical error in their submission.
Provided this bid is withdrawn, Tomco Construction, Inc. is next the lowest responsible bidder. There
were no mathematical irregularities in their bid.
As a matter of procedure, our office has contacted Tomco Construction, Inc. to discuss their bid. The
representatives we spoke to indicated they are comfortable with the bid as submitted and there is no
objection to completing the project based on the bid prices submitted and the contract time.
Based on this information, we recommend the following actions:

Award of the contract to the low bidder, Tomco Construction, Inc. within 60 calendar days, on a
unit price basis in the total amount of $5,638,646.00 for Bid Items 1 through 82, as available
funding permits. The award should be subject to review and approval by the Borough Attorney,
including concurrence to waive any minor irregularities, the review of the bid bond and surety
from the low bidder, and submission of the required bonds and insurance certificates for the
project.
2. Review and approval of the bid package submitted by Tomco Construction, Inc. by NJDOT to
verify compliance with all applicable SBE/DBE and other conditions of funding.
3. Bid and bid security of the second and third low bidder be retained and held open, pending
execution of the contract agreement by Tomco Construction, Inc.
4. Return bid securities to remaining bidders
By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of
Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded
to my office for further execution.
