APPROVING CHANGE ORDER #2
TARHEEL ENTERPRISES, INC./MILIK STREET RESURFACING
PROJECT
WHEREAS, the Governing Body of the Borough of Carteret has previously
awarded a contract to Tarheel Enterprises, Inc. in the amount of S304,842.50
for improvements to Milik Street; and
WHEREAS, the Borough's Consulting Engineer for the project, T & M
Associates, has advised the Governing Body that a modification of the
contract is reasonable and necessary and has recommended that the aforesaid
contract be modified in accordance with Contract Change Order #2 (See
attached); and
WHEREAS, Change Order #2 includes a change in the description of work
to reduce and increase quantities to reflect as built conditions and to add
supplemental items required for additional work and to extend the completion
date for the contract from November 28, 2001 to May 15, 2002; and
WHEREAS, Changc Order # 2 provides for a net increase in the contract
price in the an~ount of $24,011.03 resulting in a revised contract price of
$328,505.13, including previously approved Change Order # 1; and
WHEREAS, thc Borough's Consulting Engineer, T & M Associates, has
advised that thc above described changes and/or modifications to the project
~vere unforeseen at the time of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough
Council of the Borough of Carteret as follows:
1. Contract Change Order #2, attached hereto and made a part
hereof, resulting in a net increase of $23,662.23 in the overall
contract price, including Change Order # 1, resulting in a
revised contract price of $328,505.13 is hereby approved.
2. The appropriate Borough Officials are hereby authorized to
execute Change Order #2.

3. A copy of this resolution and a fully executed copy of Change
Order #2 be forwarded to T&M Associates for distribution to
Tarheel Enterprises, Inc.
Adopted this 2nd day of May, 2002 and certified
as a true copy of the original on May 3, 2002.
