AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of constructing the Rehabilitation of Pump Station (P-781) and appurtenances in
the project known as Riverport 6 Pump Station (P-781) Rehabilitation (12188) in the City of
Maryland Heights, Missouri to serve the needs of residents of the area, and authorizing staff to
proceed with further condemnation efforts related to the project, including but not limited to the
purchase and/or the filing of all necessary court pleadings or documents to commence and
prosecute formal legal proceedings for the acquisition of said easements and temporary
construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an
area of the County of St. Louis within the Missouri River Tributary Areas Watershed wherein
numerous people live and work;
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over, and across said area in order to relieve and
alleviate these conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the purpose of
constructing the Rehabilitation of Pump Station (P-781) and appurtenances in the project known
as Riverport 6 Pump Station (P-781) Rehabilitation (12188) hereinafter set forth, said easements
and temporary easements being more particularly described below:
Parcel #2
A 50 FOOT WIDE EASEMENT in the Northwestern corner of a tract of land being part of Lot 1
of Riverport Commons as recorded in Plat Book 350 Page 97 of the St. Louis County, Missouri
Recorder’s Office, being more particularly described as follows:
COMMENCING at the northeast corner of Lot 1 of Riverport Commons as recorded in Plat
Book 350 Page 97 of the St. Louis County, Missouri Recorder’s Office said point also being on
the Southern Right-Of-Way line of Riverport Lane 50 feet wide; THENCE South 66 degrees 40
minutes 26 seconds East 457.95 feet to the POINT OF BEGINNING of the herein described 50
FOOT WIDE EASEMENT; THENCE South 66 degrees 40 minutes 26 seconds East 18.01 feet
along the Southern Right-Of Way of Riverport Lane 50 feet wide to a point of curvature to the
left, having a chord bearing of South 21 degrees 40 minutes 34 seconds West, a chord length of
45.23 feet, an arc length of 50.25 feet and a radius of 31.98 feet to a point on the Eastern Right -
Of-Way line of Riverport Drive of variable width; THENCE continuing on said Eastern Right-
Of-Way line South 23 degrees 19 minutes 34 seconds East 32.02 feet to a point; THENCE
leaving the Eastern Right-Of-Way line of Riverport Drive of variable width, North 66 degrees 40
minutes 26 seconds East 50.00 feet to a point; THENCE North 23 degrees 19 minutes 34
seconds West 64.00 feet to the Southern Right-Of-Way of Riverport Lane 50 feet wide and the
POINT OF BEGINNING, excepting therefrom that portion covered by the existing easements
recorded in Plat Book 271 Page 45, Plat Book 287 Page 80, Deed Book 12970 Page 2455 and
Plat Book 350 Page 97 with said St. Louis County Missouri Record’s Office.
Also, a VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT for use during
the construction of any sewer in the above described 50 FOOT WIDE SEWER EASEMENT,
said VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being more
particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT, COMMENCING at
the northeast corner of Lot 1 of Riverport Commons as recorded in Plat Book 350 Page 97 of the
St. Louis County, Missouri Recorder’s Office said point also being on the Southern Right -Of-
Way line of Riverport Lane 50 feet wide; THENCE South 66 degrees 40 minutes 26 seconds
East 427.95 feet to the POINT OF BEGINNING of the herein described VARIABLE WIDTH
TEMPORARY CONSTRUCTION EASEMENT; THENCE continuing along the Southern
Right-Of-Way of Riverport Lane 50 feet wide, South 66 degrees 40 minutes 26 seconds East
30.00 feet; THENCE leaving said Right-Of-Way South 23 degrees 19 minutes 34 seconds East
64.00 feet to a point; THENCE South 66 degrees 40 minutes 26 seconds West 50.00 feet to a
point on the Eastern Right-Of-Way line of Riverport Drive of variable width; THENCE South 23
degrees 19 minutes 34 seconds East 42.70 feet to a point of curvature to the right, having a chord
bearing of South 20 degrees 47 minutes 59 seconds East, a chord length of 47.34 feet; an arc
length of 47.36 feet, and a radius of 537.00 feet to a point; THENCE leavin g said Right-Of-Way,
North 66 degrees 40 minutes 26 seconds East 52.09 feet to a point; THENCE North 23 degrees
19 minutes 34 seconds West 65.00 feet to a point; THENCE North 21 degrees 40 minutes 26
seconds East 35.36 feet to a point; THENCE North 23 degr ees 19 minutes 34 seconds West
64.00 feet to the POINT OF BEGINNING, excepting therefrom that portion covered by the
existing easements recorded in Plat Book 271 Page 45, Plat Book 287 Page 80, Deed Book
12970 Page 2455 and Plat Book 350 Page 97 with said St. Louis County Missouri Record’s
Office.
TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of
the above described sewer construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all easements
for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri f or the appropriation of private
property rights as hereinabove set out.
The foregoing Ordinance was adopted on April 9, 2020.
