AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as West
Lockwood Sanitary Relief (11679) in the City of Webster Groves, Missouri to serve the needs of
residents of the area, and authorizing staff to proceed with further condemnation efforts related
to the project, including but not limited to the purchase and/or the filing of all necessary court
pleadings or documents to commence and prosecute formal legal proceedings for the acquisition
of said easements and temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an
area of the County of St. Louis within the Deer Creek Watershed wherein numerous people live
and work;
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance, or
repair of sewers and related appurtenances on, over, and across said area in order to relieve and
alleviate these conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements
and temporary construction easements in real property for the construction of sewers and related
appurtenances in the project known as West Lockwood Sanitary Relief (11679) hereinafter set
forth, said easements and temporary easements being more particularly described below:
Parcel #10
A VARIABLE WIDTH SEWER EASEMENT across a tract of land being part of LOT 1 IN
BLOCK D OF SHERWOOD FOREST 2ND ADDITION as recorded in Plat Book 14 on Page 92
as recorded with the St. Louis County, Missouri Recorder’s Office and being more particularly
described as follows:
COMMENCING at the Northeast corner of said Lot 1 of said subdivision, also being the
common corner to land described in Deed Book 20509 on Page 1155 as recorded with the St.
Louis County, Missouri Recorder’s Office and Deed Book 09739 on Page 1345 also as recorded
with the St. Louis County, Missouri Recorder’s Office; THENCE around a 3060.19 foot radius
curve to the left 11.24 feet terminating at the end of a 11.23 foot long chord bearing North 63
degrees 14 minutes 58 seconds West along the south Right-Of-Way line of Baker Avenue to the
POINT OF BEGINNING; THENCE North 70 degrees 12 minutes 25 seconds West a distance of
75.71 feet to the Southerly Right-Of-Way line of Baker Avenue; THENCE along said Southerly
Right-Of-Way line for the next two courses; around a 50.00 foot radius curve to the right 27.99
feet terminating at the end of a 27.62 foot long chord bearing South 81 degrees 35 minutes 12
seconds East and; around a 3060.19 foot radius curve to the right 48.94 feet terminating at the
end of a 48.94 foot long chord bearing South 63 degrees 48 minutes 46 seconds East to the
POINT OF BEGINNING and containing 0.006 acres or 245.0 square feet more or less. Subject
to all legal highways, easements and restrictions of record.
Also, a TEMPORARY CONSTRUCTION EASEMENT for the use during the construction of
any sewer in the above described SEWER EASEMENT, said TEMPORARY CONSTRUCTION
EASEMENT being more particularly describe as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT, BEGINNING at the
Northeast corner of said Lot 1 of said subdivision, also being the common corner to land
described in Deed Book 20509 on Page 1155 and Deed Book 09739 on Page 1345 as recorded
with said Recorder’s Office; THENCE South 08 degrees 59 minutes 10 seconds West a distance
of 8.79 feet along the East line of said Lot 2; THENCE North 70 degrees 12 minutes 25 seconds
West a distance of 101.79 feet to the Southerly Right-Of-Way line of Baker Avenue; THENCE
along said Right-Of-Way line around a 50.00 foot radius curve to the right 16.70 feet terminating
at the end of a 16.62 foot long chord bearing North 72 degrees 48 minutes 37 seconds East ;
THENCE along the above described VARIABLE WIDTH SEWER EASEMENTS South line
South 70 degrees 12 minutes 25 seconds East a distance of 75.71 feet to the Southerly Right -Of-
Way line of Baker Avenue; THENCE around a 3060.19 foot radius curve to the right 11.24 feet
terminating at the end of a 11.23 foot long chord bearing South 63 degrees 14 minutes 58
seconds East to the POINT OF BEGINNING and containing 0.022 acres or 942.0 square feet
more or less. Subject to all legal highways, easements and restrictions of record.

A 5 FOOT WIDE SEWER EASEMENT across a tract of land being PART OF LOTS 10 & 11
OF CHOTEAU’S SUBD. in the SARPY TRACT as recorded in Deed Book 18580 on Page 2453
as recorded with the St. Louis County, Missouri Recorder’s Office and being more particularly
described as follows:
BEGINNING at the POINT OF INTERSECTION of the South line of said property and West
line of West Lockwood’s West Right-Of-way line; THENCE North 77 degrees 53 minutes 13
seconds West a distance of 5.00 feet; THENCE North 12 degrees 08 minutes 52 seconds East a
distance of 90.00 feet; THENCE South 77 degrees 52 minutes 13 seconds East a distance of 5.00
feet; THENCE South 12 degrees 08 minutes 52 seconds West a distance of 90.00 feet to the
POINT OF BEGINNING, said described 5 FOOT WIDE SEWER EASEMENT being bounded
on the East by the West Right-Of-Way line of West Lockwood Avenue, on the West parallel and
5 feet West of said West Right-Of-Way line, on the North by property described in Deed Book
22238 on Page 5056 as recorded in said Recorder’s Office and on the South by property
described in Deed Book 07449 on Page 1996 as recorded in said Recorder’s Office and
containing 0.010 acres or 450.0 square feet more or less. Subject to all legal highways,
easements and restrictions of record.
Also, a 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for the use during the
construction of any sewer in the above described SEWER EASEME NT, said TEMPORARY
CONSTRUCTION EASEMENT being more particularly describe as follows:
A 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT
A 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT, being adjacent to and
along the West side of the above describe 5 FOOT WIDE SEWER EASEMENT and containing
0.021 acres or 900.0 square feet more or less. Subject to all legal highways, easements and
restrictions of record.
Parcel #15
A 5 FOOT WIDE SEWER EASEMENT across a tract of land being PART OF LOTS 10, 11, 26
& 27 OF CHOTEAU’S SUBD. in the SARPY TRACT as recorded in Deed Book 18071 on Page
1513 as recorded with the St. Louis County, Missouri Recorder’s Office and being more
particularly described as follows:
BEGINNING at the POINT OF INTERSECTION of the South line of sai d property and West
line of West Lockwood’s West Right -Of-way line; THENCE North 69 degrees 12 minutes 18
seconds West a distance of 5.00 feet; THENCE North 19 degrees 10 minutes 52 seconds East a
distance of 137.80 feet; THENCE South 82 degrees 47 minutes 22 seconds East a distance of
5.11 feet; THENCE South 19 degrees 10 minutes 52 seconds West a distance 139.00 feet to the
POINT OF BEGINNING said described 5 FOOT WIDE SEWER EASEMENT being bounded
on the East by the West Right-Of-Way line of West Lockwood Avenue, on the West parallel and
5 feet West of said West Right-Of-Way line, on the North by property described in deed Book
21201 on Page 1096 as recorded in said Recorder’s Office and on the South by property
described in Deed Book 19024 on Page 2108 as recorded in said Recorder’s Office and
containing 0.016 acres or 692.0 square feet more or less. Subject to all legal highways,
easements and restrictions of record.
Also, a 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for the use during the
construction of any sewer in the above described SEWER EASEMENT, said TEMPORARY
CONSTRUCTION EASEMENT being more particularly describe as follows:
A 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT
A 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT, being adjacent to and
along the West side of the above describe 5 FOOT WIDE SEWER EASEMENT and containing
0.031 acres or 1,366.0 square feet more or less. Subject to all legal highways, easements and
restrictions of record.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all easements
for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri f or the appropriation of private
property rights as hereinabove set out.
The foregoing Ordinance was adopted on April 9, 2020.
