WHEREAS, Colliers Engineering & Design, 101 Crawfords Corner Road, Suite 3400, Holmdel, New Jersey 07733, possesses the requisite experience and expertise to provide said services; and WHEREAS, Colliers Engineering & Design has submitted a proposal to provide said services at a total cost not to exceed $100,000.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Acet. # NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from Colliers Engineering & Design for engineering services with regard to Ferry Ten ninat in Water Work Pre -Construction and Construction Administration Services at a cost not to exceed $100,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11-5(l)(a) in accordance with the Borough's Fair and Open Process as authorized by lacy. 3. A copy of this Resolution be forwarded to the Borough's Finance Department, the Borough Director of Engineering and, Colliers Engineering & Design. Engineering & Design Colliers Engineering & Design, Inc. (DBA Maser Consulting) is pleased to submit this proposal to provide Construction Administration Services and Construction Support Services for the Marina Structure for Carteret Ferry Terminal at Arthur Kill located in the Borough of Carteret, Middlesex County, New Jersey, The project scope is for the installation of a marina structure inclusive of timber piles, drilled shafts, floating dock, timber structure, aluminum gangway, and floating wave attenuator. The project duration is 365 days to achieve completion, This proposal is divided into four sections as follows: Section I - Scope of Services Section II - Business Terms and Conditions Section III -Technical Staff Hourly Rate Schedule and Reimbursable Expenses Section IV - Client Contract Authorization The order in which the following scope of services are presented generally follows the sequence In which the project will be accomplished; however, depending on the project, the various authorized services contained in this proposal may be performed in a sequence as deemed appropriate by Colliers Engineering & Design (CED) to meet project schedules. Section I - Scope of Services Based on our conversations and information noted above, we propose to complete the following: Accelerating success. Engineering & Design PHASE 1.0 CONSTRUCTION ADMINISTRATION & OBSERVATION SERVICES Our office will perform Construction Administration and Construction Observation services that will include the following tasks: • Provide general communication with the Borough and contractor throughout the duration of construction regarding such Issues as progress, submittal status, construction Issues and their resolution; • Provide communication and correspondence with the Borough; • Maintain project files, If required, for periodic inspection by the funding agencies; • Conduct pre -construction meeting, establish agenda, issue notice to proceed; • Review and approve Progress Schedule and Schedule of Values required to be submitted by the contractor; • Review and process Federal Compliance Documentation required to be submitted by the contractor; • Provide construction observation at a frequency necessary to ensure Contractor's compliance with the Contract Documents; full-time inspection/observation is needed during periods when the contractor Is on site to monitor their progress and compliance with the contract drawings and specifications, Including the contractor's environmental protection and restoration measures; • Provide photographs of work in progress; • Prepare daily Inspection reports and monthly progress reports; • Hold scheduled progress meetings with the Contractor and Borough to discuss scheduled activities; • Review monthly payment requests Including the final payment requests; • Participate in the review and evaluation of potential change orders, including detailed review of cost proposals; • Participate in the resolution of Issues involving unforeseen field conditions; • Prepare punchiist of remaining work Items; and, • Evaluate substantial and final completion and Issue certificates of substantial or final completion as appropriate. Proposal No. 24001788P February 28, 2024 Page 2 15 Engineering & Design Coordination with the contractor's schedule will ensure that construction Is receiving the necessary attention during all phases of construction. In addition, we will review and approve all payment vouchers submitted by the Contractor before they are presented to the municipality for payment. As the project approaches completion, the Contractor will also be presented with a detailed punch -list of the Items requiring repair and/or correction. Phase 1.0 Lump Sum Fee PHASE 2.0 CONSTRUCTION SUPPORT SERVICES $622,335.00 our office will perform Construction Support Services that will include the following tasks: • Respond to contractor RFI's; • Review shop drawings; • Respond to construction related issue with the owner as required; • Participate in progress meetings via teleconference; and, • Perform site Inspections (and attend on -site meetings) as requested. The project includes several items that the design is to be provided by the contractor and will require extensive review time to verify the design and supporting computations are acceptable. The estimation of the amount of time to review shop drawings can vary substantially which is why this task will be billed hourly with an estimated budget. Phase 2.0 Hourly/Estimated Fee $172,160.00 The fee for Phases 1.0 & 2.0 are based on a twelve (12) month contract period with an estimated twelve (12) months of full-time Inspection. The estimated budget provided below is based on 2,915 hours of field inspection, 510 hours of project management, 680 hours of office time to review shop drawings, technical Issues, and required documentation, and 264 hours of administrative assistant time. Additional meetings or more frequent field visits can be performed at the client's request, Please note, CED accepts no responsibility for construction methodology utilized by the contractors and sub -contractors, including worker health and safety Issues. REIMBURSABLE EXPENSES Delivery, mileage, printing and reproduction, overnight mail service and postage costs are not included In the fees for Phases 1,0 and 2.0 and will be added to each monthly invoice in accordance with the Schedule of Fees on file with the Borough. Reimbursable Expenses Budget $5,000.00 Proposal No. 24001788P February 28, 2024 Page 3 15 Schedule of Fees For your convenience, we have broken down the total estimated cost of the project Into the categories Identified within the scope of services. PHASE 1.0 CONSTRUCTION ADMINISTRATION & OBSERVATION SERVICES $622,335,00 PHASE 2.0 CONSTRUCTION SUPPORT SERVICES $172,160.00 REIMBURSABLES $ 5,000.00 TOTAL LUMP SUM FEE $799,495.00 This Contract and Fee Schedule are based upon the acceptance of CED's Business Terms and Conditions in accordance with our yearly Contract. Exclusions and Understandings Services relating to the following items are not anticipated for the project or cannot be quantified at this time. Therefore, any service associated with the following Items is specifically excluded from the scope of professional services within this agreement. Services not specifically outlined in Section I; • Design review, constructablliry review and redesign services as the project has been designed by others; • Any redesign required due to original design error, oversight, or unforeseen conditions; • Materials Testing; • Off -Site Inspection; • Environmental Remedlation Services; • As -built survey; and, • Exploratory or testing work, interpretations or conclusions related to determination of potential chemical, toxic, radioactive or other type of contaminants on the site. If an item not listed herein, or otherwise not specifically mentioned within this agreement, is deemed necessary, CED may prepare an addendum to this agreement for your review outlining the scope of additional services and associated professional fees regarding the extra services. Section II — Business Terms and Conditions The Business Terms and Conditions are in accordance with our yearly contract. Section III — Rate Schedule The 2024 Rate Schedule is on file with the Borough.
