D. WAIVER OF STATUTORY NOTICE TO QUIT In the event Lessor exercises its option to cancel this Lease upon the happenings of any or all of the events set forth in Section C (Cancellation by Lessor), a notice of cancellation shall be sufficient to immediately cancel this Lease; and, upon such cancellation, Lessee hereby agrees that 9 it will forthwith surrender up possession of the demised premises to the Lessor as set forth in Article VIII. E. ASSIGNMENT AND SUBLETTING The Lessee shall not sublease, or assign this Lease without first obtaining the written approval of the Lessor; but in such event. These include their failure to make adjustments to fire hydrants there by rending many of them inoperable, their lack of timely repair of water leaks and inadequate repair of street pavement, and their indecisiveness and inactivity in system rehabilitation . These points are exemplified by Missouri American Water Company 's (MAWC) actions over the past year. In particular are the Missouri Boulevard and Ellis Boulevard Sidewalk projects , the curb and gutter and sidewalk work that was done on Moreland Avenue , and the repair or lack thereof of a number of water breaks and leaks throughout town . In the case of Missouri Boulevard MAWC was notified more than a year in advance that the construction of this sidewalk would require the vertical adjustment of two fire hydrants and the potential adjustment or relocation of a third . They were kept abreast of the development of the project and were informed when the project reached construction . During construction the City's project inspector and the contractor made numerous calls to MAWC requesting that the hydrants be adjusted . Apart from their personnel visiting the job site no action was taken . Because of the project design , the hydrants were not in direct conflict so work continued , but the hydrants are now unusable due to the fill and sidewalk that was constructed . The seriousness of this situation is compounded by the fact that these three hydrants are located in secession , which creates gap between fully accessible fire hydrants at nearly 2500 feet , when by code hydrants in a commercial area are to be located every 300 feet. There are two hydrants on Ellis Boulevard , one of which is rendered nearly unusable and another which the City agreed could be left in place if MAWC would rotate the hydrant so that the hose connection did not protrude into the sidewalk . In the latter case the City left out a section of sidewalk to facilitate this change . This sidewalk directly serves a newly installed bus shelter and though MAWC has known about this situation for si x months nothing has been done . The issue on Moreland Avenue differs from the first two projects in that the project itself did not require anything of MAWC, rather when the City informed them of the upcoming project they told us that they had a number of old service lines under the street whi ch connected to an old 2" water main . They U:\Publ ic Works\Eng ineerin g\dbange\PUBLI C W OR KS & PLANNI NG\2014 \Fire Hydren ts and ot her W ater Company lss ues.d ocx Memorandum 2 requested that we coordinate our project with them so that they could install new service lines to a new 611 main which would allow them to abandon the 2" main. As the project neared and then entered construction the City and our contractor contacted MAWC on a number of occasions and although their personnel came to the site, no work was initiated In the past nine months we have seen a breakdown in the manner in which the MAWC repairs the street following the repair of water main breaks. What had be a relatively smooth and timely process has now ground to a near standstill as the full damage to the streets is not being repaired and in some instances what were emergency measures and repairs have remained uncorrected for months. In conjunction with this is an issue with small leaks rather than full pipe breaks. MAWC is not addressing these leeks and there are a number of instances where water is weeping up though our street pavement. This is a serious issue as this constant saturation of the material under the pavement weakens it and in turn can no longer support the pavement and the road is destroyed. This issue is particularly problematic as this water reaches the surface and then causes the road to ice over creating a hazard for motorists and additional work for the City to try and keep these areas clean and free of ice. Fire Station #3 which is being constructed along Highway 179 is another example of the difficulty that the City is experiencing with the MAWC. As the project was being designed the City received information from the MAWC that the water main could be extended to serve the building. As a result the City officially requested the extension and agreed to fund its cost. Throughout the summer the City made inquiries as to the status of this extension and were lead to believe that the project was still working its way through the process. In early December a letter was sent specifically asking about the status of the project. As this memo was being written we at last received a letter from MAWC stating that they will not extend the water main. This has left the City in a position where we will need to negotiate an change order with our contractor to extend the line when this could have been done inside the original contract had we received the correct information from MAWC. Apart from the dangers posed by inadequate fire protection, poorly repaired streets, and the hazard caused by leaking pipes, these things cast the City in a poor light as it is hard for the citizenry to know who is responsible for these activities, and will often assume that it is the City itself who is at fault. An example of this is a call that we received today from a resident on Norris Drive who for two years has been expecting the City to fill a hole in her yard. In researching her complaint we were able to discover that it was MAWC who was responsible for this hole, yet for these past years this owner believed it was the City who had left her yard in disrepair. I have included a number of pictures depicting some of the items discussed above. If you need additional information please contact me. As you may recall , the Council recently authorized the surplus and auction of three para-transit buses. Those buses have been auctioned and the City received $17,620 for them . MoDOT indicated they will allow the City to keep the funds if they are utilized to purchase a new bus . The cost for a new para- transit bus is approximately $60 ,000. Therefore it will require the City to fund approximately $43 ,000 for the purchase from sales tax funds designated for Transit. Transit has approx imately $329,000 available in its sales tax fund. The City maintains a fleet of 10 para -transit buses , so that 8 buses will be available for routes at all times . The two "spares" allow for the maintenance, breakdowns , etc. The buses take approximately one year from the time they are ordered to be received . Once the ordered bus is near receipt, staff will surplus another para-transit bus from the fleet and request that MoDOT allow its receipts to be utilized towards the new purchase as well. That will potentially lower the City's funding input by another $5000-$6000. This issue will be discussed at the January Public Works Committee meeting . In accordance with that resolution , $100,000 was transferred from the street materials budget (used by the street division to make roadway repairs and improvements) to the chemical budget. At this time , staff is requesting a supplement appropriate in the amount of $100 ,000 to restore the street material budget. The $100,000 transferred provided enough funds to fill our stock pile to capacity. Barring any major storm event well beyond the norm, staff believes this stock pile will be sufficient to meet the needs of the community thru the end of the winter. In previous years it has been our practice to fill our stock pile to ca pacity at the end of each season (last year was the notable exception). Given the fact that all funds have been expended at this time, any salt used in the remaining portions of the winter could not be replaced without additional funding bein g granted. This year's bid price for salt is a 5 year low. Given this f act staff would request future consideration of an additional supplemental appropriate at the conclusion of the winter season. The amount requested would be equal to the valu e of th e salt used in the remaining portion of this year. cc : Matt Morasch , P.E. This will allow City staff to place orders for the chemicals while a supplemental appropriation is being prepared for the Council's approval at a future meeting. We believe the future supplemental request will be in the range of $150- $175,000. As you may recall, the City budgeted $200,000 for chemical purchases this last budget cycle. However the salt storage bins were only about half full at the beginning of the winter. Those funds have been expended. As of this date the City has approximatefy 75o/o of its salt storage capacity on hand. The community has considerable potential for additional storms in January, February and March that will require the roadway to be chemically treated to ensure that they are passable and safe. On average we typically experience about 10 storm events per year. So far this year the City has experienced six winter storm events with three additional events forecasted later this week. It is important to receive the Council's approval soon, so that additional salt can be ordered and received in a timely manner. Salt can be difficult to obtain in a harsh winters as other communities are competing for the supply. It is also important to note the City supplies both Lincoln and Jefferson City Public Schools with salt. Each entity pays for the salt they receive but they do depend on the City to have it on hand. Smith, P.E.~ Subject: Airport Runway Project and Ground Lease Update As the committee may remember, we are in the planning stages of a major runway repair/replacement project at the airport. This project will include the complete replacement of each end of the main runway and the concrete overlay of the remaining portions. Also included in the project is the addition of a taxiway as well as the replacement of most of the field lighting. Construction is anticipated to begin this summer. This project will provide a great improvement to the airport with the elimination of pavement and lighting that is well past its useful life. However, with a project of this magnitude, disruption of the airport and the inconvenience of our various tenants is inevitable. With the closure of the main runway, currently estimated to last four months , all tenants will be inconvenienced and those with aircraft requiring a longer runway many have to relocate their aircraft during the construction. As a result, staff proposes a 50% reduction in ground lease fees charged to all our airport hangar tenants during the closure of the main runway . Assuming a four month closure, this reduction would result in a loss of revenue estimated to be $12 ,000. This possibility, as well as an anticipated reduction of "fuel flowage fees " due to reduced fuel sales at the airport, was anticipated during the budget process . Therefore the reduction can be made without adversely affecting the current budget. RESOLUTION SUMMARY RESOLUTION NO: .::.D-=-=RA=-==--FT~----- SPONSOR: Councilman Scrivner SUBJECT: Cooperative bidding of City of Jefferson Sanitary Sewer Main Replacement with Cole County Stormwater and Road Improvements DATE INTRODUCED: February 3. 2014 Summary: The Cole County Public Works Department is bidding two projects where there are inadequate sanitary sewers or the potential to serve unsewered areas. These projects are located on Frog Hollow Road, and Business 50 West in unincorporated Cole County. Background Information: There are undersized sanitary sewer mains located on Frog Hollow Road that are recommended in the Sewerage Master Plan for upgrade. There are unsewered properties in the 4900 block of Business 50 West that could be served in the future if a sanitary sewer is installed during the Business 50 West rebuild. Fiscal Information: Upon opening of bids, the City of Jefferson agrees to pay the County of Cole up to $280,000 for construction but will reflect actual bid prices to replace sanitary sewers on Frog Hollow Road and Business 50 West. Cole County is replacing the streets and stormwater in this location, so there will be significant restoration cost savings for the City. The funds would come from the Wastewater Capital Fund.
