HomeMy Public PortalAboutr 02:212 No 02-212 Dale tit' Adoplion [~l, ay 2, 2002 FINDING THAT THERE EXISTS CERTAIN BUILDINGS WHICH ARE UNFIT FOR HUMAN HABITATION OR OCCUPANCY WHEREAS, pursuant to the provisions of N.J.S.A. 40:48-2.3, et seq., whenever any municipality finds that there exists in such municipality any building or buildings which are unfit for human habitation or occupancy, or use, due to dilapidation, defects increasing the hazards of fire, accidents or other calamities, lack of ventilation, light or sanitation facilities, or due to other conditions rendering such building or buildings or part thereof, unsafe or insanitary or dangerous or detrimental to the health or safety or otherwise inimical to the welfare of the residents of said municipality, po;ver is conferred upon such municipality to exercise its police poxvers to repair, close or demolish, or cause or require the repairing, closing or demolition of such building or bnildings, or part thereof, in the manner therein provided; and WHEREAS, the Borough's Construction Code OFficial, Anthony Niebert, by memorandum dated March 20, 2002; has advised the Mayor and Council that the Borough of Carteret does have ;vithin its boundaries structures that are dilapidated, dangerous, unsafe, unsanitary, or otherwise unfit for human habitation or use. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret hereby declare and find, based upon the memorandum of the Construction Code Official, a copy of which is attached hereto and made a part hereof, that certain building conditions of the character described in N.J.S.A. 40:48- 2.3 exist within the Borough. BE IT FURTHER RESOLVED that the Borough Attorney is hereby authorized to prepare for adoption an ordinance relating to buildings within the Borough which are unfit for human habitation or occupancy or use, and providing for the Borough to exercise its police powers to repair, close or demolish, or cause or require the repairing, closing or demolition of such building or buildings or part thereof, as authorized by law Adopted this 2nd day of May, 2002 and certified as a true copy of the original on May 3, 2002. Neibert Construction Official/Zoning Officer DATE: March 20, 2002 S13~JECT: Unfit Buildings It is my understanding that m order that the Borough may proceed to adopt an ordinance that complies with the state statute a finding of fact letter is required. As the chief administrator of the Construction Department and m conjunction with all pertinent Building Officials of this office I have determined that as per 40:48-2.3 that the Borough of Cartemt does have within it's boundaries structures that axe dilapidated, dangerous, unsafe, unsamtary, or otherwise unfit for human habitation, occupancy, or use are inimical to the welfare and dangerous and injurious to the health and safety of the people of the State and that a public necessity exists for the repair, closing or demolition of such strum or buildings. Based on this intbrmaUon and under 40:48-2.5 I am requesting that an ordimmcc be drafted authorizing the repair, closing or demolition of these structures If you should have any questions please feel flee to contact me.
