The Regular Meeting of the Mayor and Council of the Borough of COUNCIL MEETING
Carteret was called to order by Mayor Daniel J. Reiman at
approximately 6:00 p.m. on Thursday, March 21, 2024 in the Council
Chambers of the Memorial Municipal Building, 61 Cooke Avenue,
Carteret, New Jersey.
Upon individual roll call, the following were noted present:
Councilmember Vincent Bellino
Jorge Diaz
Dennis DiMascio
Ajmar Johal
Randy Krum
Susan Naples
Also noted present were Carmela Pogorzelski, Municipal Clerk and
Robert J. Bergen, Law Director, via telephone conference.
The meeting was opened with a moment of silent prayer and the
Pledge of Allegiance led by Councihnember Krum.
The Annual Notice was emailed to The Home News Tribune and The
Star Ledger and posted on the bulletin board and on the doors of the
Memorial Municipal Building on January 2, 2024. Notice was
published in The Home News Tribune and The Star Ledger on January
9, 2024. All items being voted on tonight were posted on the
Borough's website, www.carteret.net prior to tonight's meeting.
Upon MMS&C, by Councilmembers Krum and Naples and unanimous
affirmative vote of the full membership present, the minutes of March
7, 2024 were approved as transcribed and engrossed by the Clerk.
At this time Mayor Reiman presented Sophie Wutkowski with a
Proclamation in honor of her 105 birthday which she celebrated on
February 28, 2024. He read the Proclamation and congratulated Mrs.
Wutkowski, wished her well and said she was the longest living
resident in the Borough.

Mayor Reiman presented Mara Salva with a Commendation for being
PRESENTATION the Artisonia Artist of the week contest winner. He congratulated her
KIARA SALVA on behalf of himself, the council and the residents and asked Mara's
high school art teacher Mrs. Catrone to join them as Mrs. Catrone
nominated Mara's artwork for the contest.
Mayor Reiman said he wanted to amend the Agenda to include
Ordinance #24-3, a Capital Ordinance Appropriating $1.75 million
from reserve funds, Resolution #24-86, Authorizing Execution of
NJDOT Modified Agreement and #24-87, Municipal Alliance Grant
Fund Resolution and asked for a Motion.
AGENDA AMENDED Upon MMS&C, by Councilmembers Diaz and Bellino and unanimous
affirmative vote of the full membership present, the Agenda was
amended to include Ordinance #24-3, $1.75 Capital Ordinance,
Resolution #24-86, Authorizing Execution of NJDOT Modified
Agreement and Resolution #24-87 Municipal Alliance Grant
Submission of Strategic Plan for FY25.
ORDINANCE #24-3 ORDINANCE #24-3 was introduced and adopted on First Reading
FULLY FUNDED - and the Clerk authorized and directed to advertise same for Public
VARIOUS CAPITAL Hearing, upon MMS&C, by Councilmembers Diaz and Krum. Upon
IMPROVEMENTS individual roll call vote, Councilmembers Bellino, Diaz, DiMascio,
Johal, Krum and Naples voted in the affirmative.

CALENDAR YEAR 2024
ORDINANCE TO EXCEED THE MUNICIPAL BUDGET
APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK
(N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that
in the preparation of its annual budget, a municipality shall limit any increase in said
budget up to 2.5% mnless authorized by ordinance to increase it to 3.5% over the previous
year's final appropriations, subject to certain exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized
by ordinance, appropriate the difference between the amount of its actual final
appropriation and the 3.5% percentage rate as an exception to its final appropriations in
either of the next two succeeding years; and,
WHEREAS, the Mayor and Borough Council of the Borough of Carteret, in the County
of Middlesex, finds it advisable and necessary to increase its CY 2024 budget by up to
3.5% over the previous year's final appropriations, in the interest of promoting the health,
safety and welfare of the citizens; and,
WHEREAS, the Mayor and Borough Council hereby determines that a 1.0% increase in
the budget for said year, amounting to $407,470.96 in excess of the increase in final
appropriations otherwise permitted by the Local Government Cap Law, is advisable and
necessary; and,
WHEREAS the Mayor and Borough Council hereby determines that any amount
authorized hereinabove that is not appropriated as part of the final budget shall be
retained as an exception to final appropriation in either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Mayor and Borough Council of the
Borough of Carteret, in the County of Middlesex, a majority of the full authorized
membership of this governing body affirmatively concurring, that, in the CY 2024 budget
year, the final appropriations of the Borough of Carteret shall, in accordance with this
ordinance and N.J.S.A, 40A: 4-45.14, be increased by 3.5%, amounting to $1,426,148.37
and that the CY 2024 municipal budget for the Borough of Carteret be approved and
adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that
is not appropriated as part of the final budget shall be retained as an exception to final
appropriation in either of the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be
filed with the Director of the Division of Local Government Services within 5 days of
introduction; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption,
with the recorded vote included thereon, be filed with said Director within 5 days after
such adoption.

COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING
$1,750,000 FORTHE ACQUISITON OF LAND AND VARIOUS
IMPROVEMENTS AS REQUIRED BY ADMINISTRATION IN

BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF
CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY AS FOLLOWS:
Section 1. The Borough of Carteret, in the County of Middlesex, New Jersey (the
"Borough") hereby appropriates the amount of $1,750,000, $478,422.06 of which is from the
Reserves for Property Acquisition and $1,271,577.94 of which is from the sale of 35 Louis Sheet
and 26 Noe Street, for the acquisition of land and various improvements as required by
Administration, including all related costs and expenditures incidental thereto, and further
including all work and materials necessary therefor and incidental thereto.
Section 2. The Borough hereby certifies that it has adopted a capital budget or a
temporary capital budget, as applicable. The capital or temporary capital budget of the Borough is
hereby amended to conform with the provisions of this ordinance to the extent of any
inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with
the adopted capital or temporary capital budget, a revised capital or temporary capital budget has
been filed with the Division of Local Government Services.
Section 3. This ordinance shall take effect as provided by applicable law.

ADOPTING THE CARTERET BUSINESS PARTNERSHIP, INC.
2024 ANNUAL SID I BUDGET
WHEREAS, the Carteret Business Partnership, Inc. (the "CBP"), the district
management corporation for the Borough of Carteret ("Borough") Special Improvement
District ("SID"), has submitted their proposed SID I Budget for the 2024 Calendar Year
("SID I Budget") to the Governing Body for its approval and ultimate adoption according
to law; and
WHEREAS, on March 7, 2024, the Governing Body adopted Resolution #24-63,
Introducing and Approving the submitted SID I Budget slid scheduling the same for a
Public Hearing on April 11, 2024, all in accordance with the applicable law; and
WHEREAS, as advertised, the Governing Body held a Public Hearing on the SID I
Budget on this date, with the majority of the full membership of the Governing Body
having determined that the said SID I Budget be read by title, hereby declaring that the
following required conditions therefore having been met as follows:
1, At least one week prior to the date of the Public Hearing, this April 11,
2024, a complete copy of the approved budget, as advertised, was
posted in a public place where public notices are customarily posted in
the principal municipal building of the Borough; and
2. A complete copy of the SID I Budget was made available to any
person who requested the same; and
WHEREAS, the Public Hearing on the SID I Budget was opened to the public, giving all
persons having an interest therein the opportunity to present any objections with regard to
the same, and no one presented any objections thereto, after which the (tearing was
closed; and
WHEREAS, the Governing Body wishes to hereby Adopt the said SID I Budget as
presented by the CBP, without any amendments.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough
of Carteret as follows:
1. That the above referenced 2024 SID I Budget is hereby Adopted as
presented by the CBP without any amendment thereto.
2. That a copy of this resolution be forwarded to the Director of the
Carteret- Business Partnership.

WHEREAS, the Carteret Business Partnership, Inc. (the "CBP"), the district

WHEREAS, the Public Hearing on the SID II Budget was opened to the public, giving
all persons having an interest therein the opportunity to present any objections with
regard to the same, and no one presented any objections thereto, after which the hearing
was closed; and
WHEREAS, the Governing Body wishes to hereby Adopt the said SID II Budget as
presented by the CBP, without any amendments.

PIER EXTENSION AND DOCK REPAIRS
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a contract.
to Agate Construction Co, Inc. in the adjusted contract amount of $1,467,519.74 for the Pier
Extension and Dock Repairs; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advised
the Governing Body that a modification of the contract is reasonable and necessary and has
recommended that the aforesaid contract be modified in accordance with Final Payment &
Closeout Change Order (see attached); and
WHEREAS, Final Payment & the Closeout Change Order include a change in the description of
work and/or to decrease quantities to reflect as -built conditions, and to provide for certain
supplementary items; and
WHEREAS, the Closeout Change Order provides for an increase in the contract price in the
amount of $6,633.75, resulting in a revised contract price of $1,474,153,49 including all
previously approved change orders; and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the above
described changes and/or modifications to the project were unforeseen at the time of the award of
the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret as follows:
-1. That Final Payment the Closeout Change Order attached hereto and
made a part hereof, resulting in an increase of $6,633.75 and resulting in
a revised contract price of $1,474,153.49 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute
Final Payment and Closeout Change Order, and issue payment thereon,
based upon the recommendation of the Borough Engineer and subject to
attorneys review of the maintenance bond:

WHEREAS, the Borough of Carteret ("Borough") is in need of specialized municipal
grant research, writing and consulting services; and
WHEREAS, the Millennium Strategies, LLC, 60 Columbia Road, Morristown, New
Jersey 07960 ("Millennium") has submitted a proposal to provide said services; and
WHEREAS, the Borough has determined that the proposal from Millennium is
advantageous to the Borough, considering all relevant factors including price; and
WHEREAS, Millennium has extensive expertise, knowledge and a proven reputation
and record in is this field; and
WHEREAS, the Local Public Contracts Law,.N.J.S.A. 40A:11-5 (1)(a) (ii), authorizes
the awarding of a contract for such extraordinary, unspecifiable services while providing
the contract's availability for public inspection; and
WHEREAS, the governing body has deemed it advisable to enter into a contract with
Millennium to provide specialized municipal grant research, writingand consulting
services for the Borough for the determined contract term of one year in accordance with
the terms of its proposal. .
NOW THE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, and State of New Jersey as follows;
1. That the Mayor and appropriate Borough officials are hereby authorized to
execute and enter into a formal agreement with Millennium to provide the
specialized municipal grant research, writing and consulting services
provider for in a form' acceptable to the Borough's Law Director and
substantially in the form attached hereto, for a sum not to exceed $54,000.
2. That this dual contract is awarded as air extraordinary, mnspeeifiable
services in accordance with N.J.S.A. 40A:11-5 (1)(a)(ii) of the Local
Public Contracts Law as the provision of said services require special
expertise and extensive training in the area -of said services and a proven
reputation in said field, which is critical and essential to this grant
consulting proposal.

section, certified by the officer or director in charge of the department wherein the
emergency occurred, or such other officer or employee as may be authorized to act in the
place of said officer or director, and the contracting agent or his deputy in charge, being
satisfied that the emergency exists, is hereby authorized to award a contract for said work
or labor, materials, supplies or services; and
WHEREAS, an emergency situation meeting the criteria set forth above resulting from
an EMERGENCY SEWAGE FAILURE REPAIR; and
WHEREAS, an emergency purchase/repair was made by PSI Process & Equipment
Group, 201 Lincoln Blvd., Middlesex, NJ 08846 ill the amount not to exceed of
$10,000.00 for said Sewage Failure Repair with regard to the Roosevelt Avenue sanitary
sewer pump station. -
NOW THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough
of Carteret, does hereby authorize the payment of $10,000.00 to PSI Process &
Equipment Group, 201 Lincoln Blvd,, Middlesex, NJ 08846 for the emergency purchase
described herein in accordance with N.J.S.A. 40A:11-6.

2024 TEMPORARY BUDGET
WHEREAS, The Revised Statutes of New Jersey 40A:4-20 provides for the
adoption of emergency temporary appropriations in addition to temporary
appropriations necessary for the period between the beginning of the current fiscal
year and the date of the adoption of the Local Budget for the Year 2024;

PROCLAMATION
SEXUAL ASSAULT AWARENESS MONTH
WHEREAS, Sexual Assault Awareness Month and the observance of
"Denim Day" draw attention to the fact that sexual violence — including
sexual assault, sexual harassment, and sexual abuse — is widespread; and
WHEREAS, sexual violence has mental and physical health implications for
survivors, as well as public health consequence for the Borough of Carteret
community; and
WHEREAS, statistics indicate that every 68 seconds someone is sexually
assaulted in the U.S.A. and every 9 minutes the victim is a child; and
WHEREAS, violence and abuse decrease in supportive and connected
communities that promote respect, health, safety, and well-being for everyone;
and
WHEREAS, by building connected communities we ensure the spaces in
which we live, learn, work, and play are inclusive and equitable so that sexual
violence can be stopped; and
WHEREAS, anti -violence and prevention programs of Middlesex County,
including the Center for Empowerment and Sexual Violence Prevention
Coalition, promote challenging norms and practices linked to a culture of
violence, increasing all forms of equity, and prioritizing the health and well-
being of survivors and the rest of the community; and
WHEREAS, the New Jersey Sex Crimes Officers Association and the
Middlesex County Sex Crimes Liaison Officers in connection with the
Middlesex County Prosecutor's Office are dedicated to ensuring the effective
investigation and prosecution of sex crimes through interagency collaboration
and training; and
WHEREAS, with commitment, we can reduce sexual violence in the
Borough of Carteret by: raising awareness; cultivating healthy individuals,
relationships, spaces, and communities; challenging all forms of oppression;
increasing all forms of equity; supporting survivors; and holding perpetrators
of violence accountable; and
WHEREAS, throughout the month of April, the Borough of Carteret supports
the efforts of national, state, and local partners, as well a encourages every
citizen to understand the realities and root causes of sexual violence; support
survivors in culturally specific ways, and join prevention efforts.
NOW, THE,REI+ORE,1, DANIEL J. REIMAN, MAYOR of the Borough
of Carteret, Middlesex County, State of New Jersey, do hereby proclaim April
2024 as:
SEXUAL ASSAULT AWARENESS MONTH
and promote the observance of Denim Day on Wednesday, April 24, 2024,
joining advocates and support service programs in urging all community
members to help end sexual violence.

WHEREAS, developmental and intellectual disabilities manifest during the
formative years of life, before the age of 22, and are lifelong in duration,
resulting in the continuing need for a variety of services designed to support
full inclusion in community life.
WHEREAS, it is estimated that approximately two percent of the United
States population has an intellectual or developmental disability, which
translates to approximately 178,000 children and adults in New Jersey, and
The Are Middlesex County alone serves 333 individuals, and their families;
and
WHEREAS, The Arc Middlesex County has worked collaboratively with
individuals, with developmental and/or intellectual disabilities, their families,
organizations, coalitions, state and local agencies; and
WHEREAS, The Arc Middlesex County has valued and promoted effective
partnerships between community partners volunteers, staff and leadership at
all levels; and
WHEREAS, The Arc Middlesex County is guided in the belief that all people
with intellectual and/or developmental disabilities are defined by their own
strengths, abilities and inherent value, not by their disability and are entitled. to
the respect, dignity, safety, and security accorded to other members of
society, and are equal before the law.
WHEREAS, The Arc Middlesex County has articulated a positive vision for
the future of people with developmental and/or intellectual disabilities and has
catalyzed public and private support in the realization of that vision by its
unwavering commitment to its individuals, families, community, leadership,
staff and volunteers; and
WHEREAS, in 75 years The Arc Middlesex County has lead in the area of
providing support, care and opportunity with integrity and accountability that
reflects quality and excellence in all its work.
NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of
the Borough of Carteret do hereby recognize The Are Middlesex County in
celebrating 75 years of outstanding and dedicated contributions in caregiving
and support to empower individuals with developmental and/or intellectual
disabilities and their families to live their lives to the fullest.
