Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Anne Heideman, William Reiser , Robert Mitchell; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Public Works Director, James Dillman; Police Chief, Michael Sankey; Attorney, Richard Schieffer; Engineer, Glenn Cook 1. ADDITIONAL AGENDA ITEMS Moved by Heideman, seconded by Scherer to discuss the following additional items: Gambling license applications Weed Inspecting Hwy. 55/Co. Rd. 116 Signals Garbage hauling 2. RECOGNITION OF THOMAS CROSBY Thomas Anderson presented a certificate of appreciation to Thomas Crosby for his 8 years of service as a Councilmember for the City of Medina. Council and others in attendance also thanked Mr. Crosby for his time and efforts while on the Council. Moved by Scherer, seconded by Heideman to name the creek on Willow Dr., south of Co. Rd. 24, "Crosby Creek." Motion declared carried 3. MINUTES OF JANUARY 29, 1985 Anne Heideman requested the following corrections: Page 190, Item 3, line 8; change "could" to "would." Page 192, Item 6, line 3; add "previously" before "purchased." Page 193, Item 12; motion should designate purchase of a postage meter. Page 193, Item 17; motion should include all employees who had not had salaries set for 1985. Moved by Heideman, seconded by Scherer to accept minutes of January 29, 1985, as corrected. Motion declared carried 4. PUBLIC WORKS DEPARTMENT Weight Restrictions Robert Mitchell explained that Wayzata had some problems when they contracted with one garbage hauler through a bidding process. He stated that contracts are for 3 years and that service begins to deteriorate with some types of fees increased. He explained that the contract is for residential pick-up only, with commercial garbage picked up by private haulers. He asked if there would be an advantage to Medina requiring that all garbage haulers take out a license so that the city would know who was picking up garbage in town. Thomas Anderson suggested that haulers be required to use smaller trucks when the roads were broken up. Jim Dillman stated that garbage haulers should be allowed to use a road once each week; that they be required to supply a map of their routes and should stay on that schedule. He suggested that the price of the permit should be reasonable enough so that all haulers would take out permits. He also asked for the authority to close a road if it becomes necessary. Moved by Scherer, seconded by Heideman to charge a $5.00 permit fee, per overweight vehicle per road posting season, to garbage haulers, farmers, fuel delivery trucks, septic tank pumpers during the road posting season with the Public Works Director to schedule vehicles or close roads at his discretion, with no permits to be issued for vehicles transporting construction materials, gravel etc. with school buses to be prohibited if so determined by the Public Works Director. Motion declared carried Water Operators School Moved by Scherer, seconded by Heideman to authorize Francis Pumarlo and Jim Dillman to attend a Water Operators School on April 9-11 at a fee of $50.00 each. Motion declared carried Ron Peterson, Medina Morningside Thomas Anderson reviewed City Clerk's memo regarding Ron Peterson's request that the city repair his concrete driveway, as he believed that it cracked as a result of the sewer line construction. 198 Jim Dillman explained that the cement cracking may not have been caused by construction. Donna Roehl was asked to schedule Mr. Peterson before the City Council. Administration Car Jim Dillman stated that the frame of the City Car had recracked and would need to be repaired. Council advised that it be taken to a shop for a determination as to whether or not it could be repaired. 5. POLICE DEPARTMENT Seminars Moved by Heideman, seconded by Reiser to allow Jill Hodapp to attend a seminar on Crim- inal Interrogation for a fee of $355.00. Motion declared carried Moved by Heideman, seconded by Reiser to allow City Department Heads the descretion of spending previously approved seminar budgets without presenting to City Council for approval. Motion declared carried 6. PLANNING AND ZONING DEPARTMENT Dickey Natural Systems, Conditional Use Permit Amendment Discussion of application to amend Dickey Natural Systems Conditional Use Permit to allow use of an outside storage area by the Lumber Co. at 2705 Hwy-55 The company deals in wholesale to contractors. Discussion of the cyclone on top of the building. Cole Graham of Dickey Natural Systems stated that the cyclone is approximately 18-25 ft. higher than the roof. Anne Heideman stated that some type of screening, comparable to the Anderson Co. building, should be required. Wilfred Schere asked who would be responsible for maintenance of the proposed fence for the Lumber Co. Mr. Graham stated that the tenant would be responsible. Thomas Anderson stated that the responsibility would be the responsibility of the owner. Council discussed the outside storage area which is being requested, which is much larger than presently allowed in the ordinance. JoEllen Hurr stated that the Planning Commission had not reached a conclusion on that issue.Mr. Graham explained that they were requesting a 50,000 sq. ft. outside storage area for the Lumber Co. plus a 5000 sq. ft. area adjacent to the existing building, which will be used by another tenant. Patricia Headley, Planning Commission representative, stated that the Planning Commission had agreed that 40,000 sq. ft. should be approve, plus the 5000 sq. ft. adjacent to the building. Robert Mitchell stated that the city should have the opportunity to require that the entire fence be opaque. Moved by Mitchell, seconded by Heideman to authorize preparation of a resolution to amend the Dickey Natural Systems Conditional Use Permit to allow 40,000 sq. ft. of out- side storage for the Lumber Co. to operate a wholesale lumber business at 2705 Hwy. 55; entire area to be screened with a 7 ft. high privacy fences, except the southerly 100 ft. which shall be allowed to be cyclone, unless the city determines, at a future date, that the entire fence should be opaque; also that storage inside the fenced area will not exceed 7 ft. in height. Motion declared carried Moved by Mitchell, seconded by Heideman to authorize preparation of a resolution amend- ing the Dickey Natural Systems Conditional Use Permit to allow a 50 ft. by 100 ft. storage area behind the existing loading dock to remain unfenced, due to the fact that the area is located behind the building but to reserve the right to require the entire area to be fenced if- a problem. Motion declared carried Moved by Heideman, seconded by Mitchell to direct staff to research requirements for 1.99 screening of the Anderson Co. building cyclone at 4535 Willow Dr. and to require similar screening for the Dickey Natural Systems building. Motion declared carried Walter G. Anderson Co., Water System Richard Schieffer advised that Council not enter into the prepared agreement with the Anderson Co. as it would probably be unenforceable and the Council would be contracting away a government function. He suggested that itmes contained in the agreement be in- cluded in a resolution with the deletion of Item 4 regarding reimbursement of fire insurance premiums if water tower is not built by November 15, 1987. Robert Mitchell asked if their assessment would be lost if they installed their own system. Glenn Cook stated that the property could still be assessed. Moved by Mitchell, seconded by Heideman to authorize the Attorney to prepare a resolution setting forth the facts and agreements contained in the prepared resolution and agreement, except Item 4 of the Agreement, regarding supplying water to the Walter G. Anderson Co. at 4535 Willow Dr. Motion declared carried 7. ECONOMIC DEVELOPMENT AND TAX INCREMENT PROGRAM Steve Apfelbacher of Ehlers and associates presented alternate plans for bonding and construction of a water line and water tower along Hwy. 55, west of the Hamel area. Council also discussed where the water line would be located, north or south of Hwy. 55; taking bids for construction of either a 16" or 12" water line and the need to hold a Public Hearing to consider amending the Tax Increment Plan. Moved by Heideman, seconded by Mitchell to hold a Special Meeting on Wednesday, March 13, 1985 and to adopt Resolution 85-7, Calling for a Public Hearing at 7:30 P.M. to consider amending the Tax Increment Plan. Motion declared carried Moved by Reiser, seconded by Mitchell to adopt Resolution 85-8, Ordering Plans and Speci- fications for construction of a water line along Hwy. 55, west to Willow Dr. Motion declared carried Donna Roehl stated that Item 10, page 192 of minutes of January 29th state that plans and specifications had been ordered and should be corrected if that was not the intent- ion of the City Council. Moved by Mitchell, seconded by Reiser to amend Item 10, Page 192 to delete reference to ordering plans and specifications for the water line construction. Motion declared carried 8. CABLE TELEVISION COMMISSION Patricia Headley stated that she would try to find someone from the Medina Morningside area who might be interested in serving on the Cable Television Commission. 9. ELM CREEK WATERSHED JOINT POWERS AGREEMENT Moved by Heideman, seconded by Scherer to adopt Resolution 85-9, entering into a Joint Powers Agreement for the Elm Creek Watershed Commission. Motion declared carried 10. WOODLAKE LANDFILL JoEllen Hurr presented report from Bruce Liesch and Associates regarding the Woodlake landfill. She stated that she had not had the time to review it, also Woodlake does not yet have a plan for leachate removal. 11. PLANNING COMMISSION APPOINTMENTS Thomas Anderson reported that Bonnie Etzel was no longer interested in being appointed to the Planning Commission and that he was trying to find someone from the Independence Beach area who might be willing to serve on the Commission. He asked that the Clerk write a letter of appreciation to the resident who did not qualify for appointment because of the residency requirement and to invite other applicants to an interview session on February 19th. 200 12. REED BALES SAWMILL Richard Schaeffer reported that Mr. Bales Attorney had told him that they did not wish to enter into an agreement to keep the wood storage area at 2 acres, perhaps 5 or 6 acres would be needed if the Hennepin County chipping station were to close. He reported that City Ordinance does not allow Elms to be stored unless debarked after April 1st of each year. Robert Mitchell stated that the city should abide by the ordinances and that he should be told what needs to be done according to the Conditional Use Permit. Richard Schaeffer stated that Mr. Bales is aware of the conditions. Wilfred Scherer stated that he had visited the site and they were making a great deal of progress with the wood chipper. 13. BOARD OF REVIEW MEETING Moved by Heideman, seconded by Scherer to hold the Board of Review meeting on Tuesday, April 2, 1985 at 6:30 P.M. Motion declared carried 14. CORCORAN/MEDINA FIRE EQUIPMENT CONTRACT Moved by Heideman, seconded by Scherer to table the Corcoran/Medina contract and ask that the Mayor, Richard schieffer, Julius Dorweiler from the Hamel Fire Department and someone from Corcoran to work out details of the contract. Motion declared carried 15. SENATOR TAD JUDE State Senator Jude congratulated Thomas Crosby for his years of service to Medina as a Councilmember. He reported that the State Legislature was not to busy, but Committees were meeting. 16. HWY. 55/C0. RD. 116 SIGNALS Council discussed letter from MnDOT regarding the fact that the staff of Hennepin County has recommended that the county not pay for any of the cost of the temporary signals. Also discussed was the letter from Glenn Cook which explained that the cities portion of the cost for the signal would be $88,515. Council discussed various methods for assessing the signal and storm sewer project and Glenn Cook was asked to prepare several alternative methods for consideration at the February 19th meeting. Tad Jude stated that he would do some checking into participation by the State. 17. WEED INSPECTOR Thomas Anderson stated that he had spoken to Howard schleif of Corcoran who was interested in becoming the cities Weed Inspector. Donna Roehl was asked to invite him to the February 19th meeting. 18. GAMBLING LICENSE APPLICATIONS Donna Roehl stated that she had received intentions of application for Gambling Licenses from St. Anne's Church, Holy Name Church and the Multiple Sclerosis Society who would be selling Pull -tabs at Medina Recreations. She stated that the Council had 30 days in which to respond to the State, either positively or negatively regarding any of the applications. Moved by Heideman, seconded by Scherer to offer no objection to the issuance of Gambling Licenses to Holy Name Church, St. Anne's Church and the Multiple Sclerosis Society. Motion declared carried 19. BILLS Moved by Heideman, seconded by Scherer to pay the bills; Order Checks # 3535-3619 in the amount of $178,490.54 and Payroll Checks # 8116-8152 in the amount of $15,372.15.
