December 19, 1950 The regular meeting of Town Council was held today at 4 P. M. in the Council Room and was attended by Mayor Dutton, who presided, Councilmen Peters, Smith, Meddin, Hosti, Lovell, Town Attorney Solms, Fire Chief E. J. Solomon, Supt. Reed, Chief McCutchen. Chief Solomon called attention to the lack of heating facilities by those users of propane gas due to a shortage, and suggested that for the time being Council pass up the present ordinances covering the erection of chimneys and etc., his idea was that if necessary precautions were taken that other arrange- ments could be made until the present emergency is passed. The Mayor appointed a committee of Mr. Solomon and Mr. Reed to handle the matter. The minutes of the meetings held on October 19th, Octo- ber 26th, October 31st and November 9th were read and adopted. Councilman Meddin moved that bills for the month of November amounting to $694.90 be paid, Councilman Peters second- ed and the motion passed. Councilman Meddin stated that the Seaview Developement Company, the owners of Hotel Tybee, had requested that the north- ern portion of the north parking area be swapped with them for an equal amount of property on 15th Street near the Strand, owned by them. The Mayor stated that it would be necessary to hold an elec- tion to convey any part of the Strand, it was decided to refer the matter to the Finance Committee and Town Attorney Solms and they to contact the Hotel Tybee owners for a conference. Councilman Meddin discussed the finances of the Town and stated that there is a balance of approximately $28,000.00 in the bank. 1 1 63 The Mayor instructed Chief McCutchen to contact Mr. J. J. Hoovler, Commander of American Legion post f 151-, in connection with the purchase of oxygen for use in emergency work, the Legion would pay for the oxygen until a balance in a fund of the Legion was used up, then the Town would pay for it. Chief McCutchen also reported that the heads of the Dual - Parking Meters were being packed to be shipped back to the Dual Company as they were to replace the heads without cost to the Town. Mr. Reed stated that there were 20 prisoners on hand, that the Water Works Department was functioning alright, that the water meters .were read on December 1, 1950 but that no bills es yet had,,beer,sent, Mr. Lang was still in the Hospital. The Mayor informed Council that the Finance & Water Works Committed had agreed to salary changes and adjustments in connection with the Water Works System as follows: J. W. Lang, $220.00 per month, to be paid from the Water Works Ac- count, December 1, 1950. Thomas M. Reed, $280.00 per month, to be paid from General Account, December 1, 1950. Oris S. Blair, 4192.00 per month „ to be paid from General Account, December 1 1950. Councilman Smith moved that the action of the committee be adopted, Councilman Hosti seconded and the motion passed. Town Clerk Buckley requested that in connection with the additional work and added responsibilities in his office that his assistant and himself be given additional compensa- tion. The matter was referred to the Finance Committee. The wayor stated that he had been in conference with Mr. Hubbard of the Southern Bell Tel. & Tel. Company relative to the ringing of the fire siren by an operator at the Tele- phone Exchange when a fire call comes in. The Mayor informed Council that the Town should take action to put Lot 13, Ward 1, formerly owned by the Tybee Water Works, on the market and dispose of it, the property is now occupied by A. p. Solomon, Jr., Councilman Meddin moved that he be permitted to occupy the property until March 1, 1951, rent free, provided all taxes due the Town are paid with no refunds or prorations. Councilman Smith moved that the Finance Committee and the Mayor be authorized to sell the real estate known as Lot 13, Ward 1, formerly owned by the Tybee Water Works and that - the following Resolution be adopted, Councilman peters second- ed and the motion passed. 64 A RESOLUTION WHEREAS, Savannah Beach, Tybee Island, is the sole stockholder of record of the Tybee water Works; and, WHEREAS, a Resolution was passed by the Board of Directors and a Resolution was passed at the Stockholderts meet- ing, both of which meetings were held on December 1st, 1950, as follows, to -wit: RESOLVED, that the Officers of the Corpora- tion be and they are hereby authorized, empowered and directed to proceed with the payment, or the provision for payment, of all of the liabilities of this Corporation and that they transfer and convey to the sole Stockholder all assets of the Corporation consisting of both real and-personal property that may be remaining after the payment of liabilities, and that they take all appropriate steps .necessary to effect the dissolution of this Corporation and to surrender the Charter of this Corporation; and WHEREAS, Thomas & Hutton, Engineers, have advised the mayor and Councilmen of the Municipality that Lot Number 13, Thirteen, Ward One (1), is not necessary for the use and opera- tion of the said Water Works System; NOW THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach in Council assembled that the Non. Edward A. Dutton, Mayor to the Mayor and Council men of the Town of Savannah Beach, Tybee bland, or the then acting Mayor, be and he is hereby authorized and directed to make and execute leases, rental agreement, sales contract, option or any other agreement in the name of the municipality, Savannah Beach, Tybee Island, for the disposition by way of rental or sale or otherwise of the said Lot Number Thirteen (13), Ward One, (1), Savannah Beach, Tybee Island, Chatham County, Georgia, and the Clerk of Council is hereby authorized and directed to attest the signature for the Mayor or acting Mayor of Savannah Beach, Tybee Island, and affix to said instrument, or instruments, the official seal of the Town of Savannah Beach, Tybee Island, Georgia. The Mayor asked what has been done relative to re- pairs at the Fire Station. Councilman Smith stated that the work had been held up due to high costs and etc.. The Mayor informed Council that in connection with the purchasing of materials for the Water Works System that Coun- cilman Meddin had been very helpful. Councilman Smith stated that Thomas & Hutton had informed him that the Town should get reason- able deliveries on materials for the Water System as scheduled. Councilman Lovell stated that he understood Thomas & Hutton would dispose of the large water tank at Ft. Screven. The Mayor informed Council that Garden City had recently acquired a Water 65 System and that Thomas & Hutton were the Engineers for them, we might negotiate and cooperate with Garden City. Councilman Smith discussed setting up a new rate scale for water takers and suggested that on any new applications rate for water service to be prorated to May 1, 1951 on residen- tial or small commercial users, he stated that the commercial rate must be increased and that commercial users be metered, they to furnish meter and pay for cost of installation. • The application of Lonnie V. Davis to erect a drive -in Restaurant on Lots 23 & 24, Ward 4, on property owned by him was referred to the Assessment Committee and the Mayor. The matter of the claim of Herman Diamond for sand he contends that the Town moved from his property was discussed. No action was taken on the matter. Town Attorney Solms stated that in negotiations covering the purchase of the water Works System Lot 29 -A, Ward 1, was included, the Town was offered $600.00 for this lot. Council- man peters moved that the offer of $600.00 be accepted, and the money deposited in the construction fund, Councilman Smith sec- onded and the motion passed. Councilman peters moved that the 1950 whiskey license of the Brass Rail by Mitchell R. Young be transferred to Fred Haar and likewise the 1950 whiskey license of C. J. Hosti be transferred to Chester L. LaCour, provided that the transfer fee of $25.00 each is paid, Councilman Hosti seconded and the motion passed. Councilman Smith stated that G. Fred Garis had filed for a refund of the cost of running a service line to Camp Sabeca some years ago, the matter was referred to Mr. C. F. powers. A request was madeby a group of young people for per- mission to use the auditorium every Friday night for a dance. The matter was referred to the school Committee. Councilman Smith moved that as has been the custom in past years that the Town furnish cigarettes and ect., to the guards and prisoners for Christmas, Councilman peters Second- ed and the motion passed. Councilman Smith moved that the following Resolution be adopted, Councilman Lovell seconded and the motion passed. A RESOLUTION WHEREAS, prior to the purchase by Savannah Beach, Tybee Island, of the Water System locatbd within the Muni- cipality, it was necessary to determine the value, condition and state of repair of all pumps, wells, supply pipes, tanks 66 and other parts of said water System; and, WHEREAS, the Honorable OLIN F. FULLER, Mayor of the City of Savannah and the Honorable LOUIS A. EAST, Superintend- ent of the Water Department of the City of Savannah, gave val- uable assistance to the mayor and Councilmen of Savannah Beach, Tybee Island, in every way possible, as well as materially assisted the Water Committee of Savannah Beach, Tybee Island, and Messrs. Thomas & Hutton, Engineers for said Town by per- mitting the Honorable Bruce Sams, Engineer df the Industrial and Domestic Water Supply, to inspect said system and give his professional opinion and suggestions in consultation with the Engineers of said Town, together with his other vital assis- tance by reason of his vast experience and knowledge of water systems. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled and it is hereby resolved by authority of the same that the thanks, appreciation and gratitude of the Mayor and Councilmen of Savannah Beach, Tybee Island, as well as those of the citizens of Savannah Beach, Tybee Island, be and they are hereby extended to the Honorable Olin F. Fulmer, Mayor of the City of Savannah, the Alderman of the City of Savannah, and the Honorable Louis A. East, Superintendent of the Water Department of the City of Savannah for their cooperation and assistance rendered to Savannah Beach, Tybee Island, in this new endeavor entered into by said Municipality. BE IT FURTHER RESOLVED by the Mayor and. Councilmen of Savannah Beach, Tybee Island, and it is hereby resolved by authority of the same that the Honorable Bruce Sams, be extend- ed the thanks, appreciation and gratitude of the Mayor and the Councilmen of Savannah Beach, Tybee Island, and those of the citizens of Savannah Beach for rendering his professional engineering services in consultations with the officials of said Municipality and its Engineers, Messrs. Thomas & Hutton, as well as for his timely advice and recommen- dations of the Water system located within the corporate limits. of Savannah Beach, Tybee Island. BE IT FURTHER RESOLVED by authority of the same that a copy of this Resolution be spread upon the minutes of Council of Savannah Beach, Tybee Island, and that copies be sent to the Honorable Olin F. Fulmer, Mayor of the City of Savannah, to "fihe Mayor and Aldermen of the City of Savannah, to the Honorable Louis A. East, Superintendent of the Water Department of the City of Savannah, and to the Honorable Bruce Sams, Engineer of the Industrial and Domestic Water Supply of the City of Savannah.
