HomeMy Public PortalAboutOrdinance 67-232ORDINANCE NO. 67 -232 AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE, PUR- SUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE, RELATING TO SUBSECTION (1)(c) OF SECTION 409 OF THE TEMPLE CITY ZONING CODE. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and determine that the Planning Department of this City has heretofore undertaken studies to determine the appropriate wording of Section 409 to safe- guard against devaluation of neighboring residential properties; - that said Planning Department has heretofore made certain recommen- dations in connection therewith. SECTION 2. The City Council further finds that the processing of such recommendation is contemplated by the Planning Commission - and City Council within the next few months, and that to permit fur- ther violative construction prior to the consummation of the appro- priate hearings thereon would in large measure emasculate the benefits to be derived therefrom and would be contrary to the best interests and general welfare of the residents of this City. SECTION 3. Pending completion of such studies, and pursuant to the provisions of Section 65858 of the Government Code, Subsec- tion (1)(c) of Section 409 of the Temple City Zoning Code is hereby amended to read as follows: "(c) on the rear third of an interior lot, except on the front lot or lots of lot splits developed as flag or tiered lots, accessory buildings and structures not containing accessory living quarters may be built to the lot side lines and the lot rear line, provided if the rear of the lot abuts upon an alley a garage with a vehicu- lar entrance from the alley shall maintain a distance of not less than fifteen (15) feet from the center line of the alley; if either an alley or a utility easement exists along the rear of the lot, not less than ten (10) feet of the lot rear line shall be maintained free and clear of buildings or structures, except for a fence with a gate to provide access to the alley or utility easement as the case may be. If a utility pole is located on the easement, then the required opening in the fence or wall shall be so located as to provide immediate access to the pole." SECTION 4. This Ordinance shall remain in effect until August 1, 1967, and the Building Inspector of this City is directed not to issue any building permit for construction or substantial recon- struction during the term of this Ordinance, except in compliance with Section 3 hereof. SECTION 5. This Ordinance shall become immediately effective as an emergency Ordinance pursuant to the provisions of Section 65858 of the Government Code and for the reasons above stated, and is adopted pursuant to the authority of Anderson v. Pleasant Hills, 229 A.C.A. 81; Metro Realty v. County of El Dorado, 222 A.C.A. 560; Hunter v. Adams, 180 C.A.2d 511; Los Angeles v. Superior Court 221 A.C.A. 151; 44 A.G. Ops. 14; and Slater v. Los Angeles, 238 A.C.A. 937. SECTION 6. It shall be unlawful for any person to violate the provisions of Section 3 hereof. 634 1 Ordinance No. 67 -232 SECTION 7. The City Clerk shall certify and attest to the adoption of this Ordinance and shall cause the same to be published once in the Temple City Times, a semi- weekly newspaper, published and circulated in the City of Temple City.
