Present: Mayor, Gary Acromite; Councilmembers, Ann Thies, Robert Mitchell, Wilfred Scherer, Philip Zietlow; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman; Police Chief, Richard Rabenort; Zoning Administrator, Loren Kohnen; Engineer, Glenn Cook; Attorney, Ron Batty 1. ADDITIONAL AGENDA ITEMS Moved by Scherer, seconded by Acromite to discuss Tupco clean-up. Motion declared carried 2. MINUTES OF JANUARY 15, 1991 Philip Zietlow stated that date of February 5, rather than February 2, be inserted in Item 6 on Pages 11 and 12. Moved by Scherer, seconded by Zietlow to approve minutes of January 15, 1991 as corrected. Motion declared carried 3. MINUTES OF FEBRUARY 1, 1991 Moved by Zietlow, seconded by Acromite to approve minutes of February 1, 1991 as presented. Motion declared carried 4. MINUTES OF FEBRUARY 2, 1991 Moved by Zietlow, seconded by Acromite to approve minutes of February 2, 1991 as presented. Motion declared carried 5. SCOTT STILLMAN Scott Stillman, newly hired police officer, was sworn in by Clerk -Treasurer. 6. PLANNING COMMISSION APPLICANTS Council interviewed the following to fill a planning commission vacancy. Jim Johnson, 45 Hwy. 55; Leon Greenslit, 2022 Hickory Dr.; John Ferris, 1265 Oakview Rd. Council voted secret ballot and John Ferris was appointed to serve for an unexpired term ending March 1992. 7. POLICE DEPARTMENT Union Negotiations Ann Thies reported that union contract negotiations are continuing with a session scheduled for the week of February llth. Loretto Police Contract Rick Rabenort reported that Loretto had changed Item 12 of the contract regarding their notification to the city before September 1, 1991 if they intend to cancel their contract with the city at the end of 1991. Robert Mitchell stated that similar language should be included should the city wish to cancel the contract. Moved by Mitchell, seconded by Scherer to amend Item 12 of the Loretto police contract to allow either party to give written notice prior to September 1 of each year if they wish to cancel the contract at the end of that year. Council discussed what other options Loretto had for police service. Philip Zietlow stated that in the future the city needs to discuss an equitable means of contract dollars. Motion declared carried 8. GARBAGE HAULING Jim Dillman explained the procedure that the city has used to license garbage haulers in the city and he recommended negotiating a one year contract and then to begin the process to bring the cities procedures into compliance with state statutes that were adopted after the city first1 licensed haulers in 1986. Moved by Acromite, seconded by Thies to proceed to negotiate a one year garbage hauling license contract with the present haulers and to 'begin the licensing process according to state statutes. Motion declared carried 1.7 1 8 9. HIGHWAY 1.2 Gary aCromite reported that very good response had been received from the Hi: ^ ray 12 meeting any.: council should he deciding what course of action should to taken. Robert Mitchell stated that a resolution should he pr^_pared using citizen input and other information for discussion at the February 19th meeting. Moved by Acromite, seconded by Mitchell to summarize Hay. 12 meeting minutes and work on a draft resolution for council review on February. 19, 1991. Motion declared carried 1 10. SURVEYS Donna Roehl reported that 350 road and water surveys had been returned. Ann Thies, Gary Acrcmite and Philip Zietlow stated that they would tabulate the responses. 11. SIGNS Jim Dillman explained that several years ago the city had requested a parking lot to provided for users of Hennepin Parks near Co. Rd. 29 and Co. Rd. 19. This was not don so the city requested that "no parking" signs be placed in the area. The City cf Maple Plain have asked that the signs be removed because cars are now being parted in their residential areas. Hennepin Parks has. now decided that a parking lot will be constructed but if the signs are removed cars will again oark alons the county roads and a traffic hazard will still exist. Moved y Lietlow, seconded by Mitchell to request. that Jim Dillman write a letter to Hennepin Parks explaining aining that we want the signs to remain in place until such time that t o city can determine hat impact the parking lot has on the area. Motion. declared carried 12. COMPREHENS I G E PLAN Glenn Cook revs _ ed;. the seeder information that he bad prepared at the request of the Metropolitan Council staff for review with the cities comprehensive plan amendment. Gary Rylander, Engineer with Bonestroo, reviewed the transportation portion of to in- formation regarding Highway J5 traffic projections. Council discusses hoar and when the information should be submitted to Metre, Council. Moved by Acromite, seconded by Mitchell to submit the sewer and traffic reports to the Metropolitan Council along with a letter from the mayor emphasising specific areas of t:a report outlined ty Glenn Cook and Gary Rylander. Motion declared carried 13. PLANNING AND ZONING DEPARINENT George Gu'b'oins, Rezonins Loren Kohne.n reviewed ::is memo regarding George Gubbins application to rezone ages east of the Kellin/Awes '.horse facility, from residential tecommercial to allow 'aim to construct a law office building. He stated that the Planning Commission had recommended denial of Cie rezoning but had suggested that a PUD app lication he made ty Gu> tins. George Gu bins explained that several commercial operations are carries' on north of Hwy. 53 in Corcoran, the Jog kennel is located to the east and the horse facility is to the west. He stated that the request will not affect the homes on the lake. Gary acromit` asked if he '.has: considered applying for a PUD. Geerc:e Gubtins stated that there was no assurance that a PUD would be approved and he did not want to spend additional money as it had already cost $4500 for the survey to city '.:Zad required for the rezoning ap olication. Phi1i_n Zietlau stated that the Planning Commission had no pro'nl. m with a law office tut were concerned about other businesses that might be '.built if the property was rezones to commercial. Ron Batty :stated that a PUD must he attached to an underlying zone, in this situation a commercial zone. Moved by Zi etlow, seconded .by Thies to authorize preoaration of a resolution denying the rezoning of the George Gub'bins _ roperty to commercial. Motion carried Abstaining -Scherer 14. RR-2 REZONING Loren Kohnen reviewed his memo regarding rezoning of property east of the A es/Kellin property to Peter Lake, to an R R-2 zone. Ron rt Mitchell stated that ha was not in agreement with some of the text of the RR-2 text that had been adopted in December the actual rezoning of the property. Moved by Mitchell, seconded by Scherer to the text of the ordinance have been and the city council. Motion declared carried and believed that it should be changed prior to to table rezoning of the property until revisions reviewed and approved by the planning commission Moved by Mitchell, seconded by Zietlow to ask the Planning Commission to consider amend- ments to the RR-2 zoning ordinance and that a schedule a public hearing for the changes. Motion declared carried Tuckborough Farm, 3rd Addition Loren Kohnen reviewed his memo regarding subdivision of Tuckborough Farm 3rd Addition of approximately 80 acres, west of Tuckborough Farm. He stated that two proposals have been submitted:, one with the Co. Rd. 116 easement and one without the easement. He stated that the Planning Commission had recommended approval of either plan with the only difference being lot configuration of the lots in the southerly 40 acres. Robert Mitchell stated that some time was needed to consider whether or not the city should retain the Co. Rd. 1.16 easement. Moved by Mitchell, seconded by Thies to table the matter until April 2, 1991. Motion declared carried John Day Loren Kohnen explained that John Day had received a bill for $565.55 from the city in conn- ection with a Conditional Use Permit application. He stated that the city had asked for written approval from the Soo Line railroad for a drainage easement and later found out that the railroad does not give any written approvals. Because of the delay the tenant was no longer intersted in the building so John Day wanted the city to forgive the charges. Moved by Zietlow, seconded by Acromite to notify John Day that payment is due, this is part of doing business and the citizens of Medina will be paying the bill if he fails to pay. Motion declared carried Hans Hagen, Cherry Hill Farm Moved by Scherer, seconded by Mitchell toretain $69,1.58.83 for Cherry Hills Farm, sewer, water and street improvements, upon the recommendation of the city engineer. Motion declared carried 15. PARK TRAILS Moved by Scherer, seconded by Zietlow to approve the park commission working with all adjacent communities regarding a trail system. Motion declared carried 16. COMMUNITY AND UPTOWNAAMEL BUSINESS SIGNS Council discussed a community events sign and a sign for the uptown Hamel businesses. Wilfred Scherer stated that he and Loren Kohnen would do some research and report later. 17. LAND TRANSACTIONS Ron Batty explained that the city has the ability to control filing of land transactions by adopting.a resolution directing Hennepin County to only accept subdivisions if they have been approved by the city. Moved by Thies, seconded by Scherer to adopt Resolution 91-7, pertaining to land trans- action filing restrictions. Motion declared carried 18. FIRE MARSHAL REPORT Loren Kohnen explained that all of the commercial/industrial buildings have been inspected, they will be doing follow-up inspections -and -updating the record, books for the city and the fire departments. He stated that they had also inspected septic systems and reviewed conditions of Conditional Use Permits while on the premises. He explained that these inspections are done once a year and that in some cities buildings only get inspected every two to three years. :_0. 2 U 19. 'rUPC0 Loren Kobnen stated that he had met in his office with the wrchasers of the Takeo property and they had discussed clean up of the wood. chips, etc. He had r-een told that they intended to sell firewood, try to market some of the chips and that they believed that the piles were one half dirt. He had told, teem to open the piles and he would meet them to determine the contents. He stated that they had begun to spread out the Niles so a meeting had been scheduled for Thursday, February 7th to inspect the premises. 20. RILLS Moved by Scherer, seconded by Mitchell to pay the bills; Order Checks # 9349-9428 in the amount of $289,813.79; Payroll Checks # 11981-12017 and 8919 in the amount of $24466.24.
