ORDINANCE NO. 67 -233
AN ORDINANCE OF THE CITY OF TEMPLE CITY
ENACTING AN INTERIM ZONING ORDINANCE, PUR-
SUANT TO THE PROVISIONS OF SECTION 65858
OF THE CALIFORNIA GOVERNMENT CODE, RELATING
TO THE TEMPORARY RECLASSIFICATION OF CER-
TAIN PROPERTY FROM C -M TO C -2.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council does hereby find and deter-
mine that the Planning Department of this City has heretofore
undertaken studies to determine the appropriate zone classifi-
cation for Lots 1 through 21, inclusive, of Tract 8526; that -
said Planning Department has heretofore made certain recommenda-
tions in connection therewith.
SECTION 2. The City Council further finds that the pro-
cessing of such recommendation is contemplated by the Planning
Commission and City Council within the next few months, and that
to permit further C -M construction prior to the consummation of
the appropriate hearings thereon would in large measure emascu-
late the benefits to be derived therefrom and would be contrary
to the best interests and general welfare of the residents of
this City.
SECTION 3. Pending completion of such studies, and pur-
suant to the provisions of Section 65858 of the Government Code,
Lots 1 through 21, inclusive, of Tract 8526 as per map recorded
in Book 97, pages 19, 20 of Maps are hereby reclassified from
zone C -M to zone C -2.
SECTION 4. The provisions of the Municipal Code indicating
zone C -M on such property are hereby suspended.
SECTION 5. This Ordinance shall remain in effect until
August 1, 1967, and the Building Inspector of this City is direc-
ted not to issue any building permit for construction or sub-
stantial reconstruct=ion during the term of this Ordinance, except
in compliance with C -2 zoning.
SECTION 6. This Ordinance shall become immediately effec-
tive as an emergency Ordinance pursuant to the provisions of
Section 65858 of the Government Code and for'the reasons above
stated, and is adopted pursuant to the authority of Anderson v.
Pleasant Hills, 229 A.C.A. 81; Metro Realty v. County of El®
Dorado, 222 A.C.A. 560; Hunter v. Adams, 180 C.A.2d 511; Los
Angeles v. Superior Court, 221 A.C.A. 151; 44 A.G. Ops. '1 T and
Slater v. Los Angeles, 238 A.C.A. 937.
SECTION 7. It shall be unlawful for any person to violate
the provisions of Section 3 hereof.
SECTION 8. The City Clerk shall certify and attest to the
adoption of this Ordinance and shall cause the same to be pub-
lished once in /the Temple City Times, a semi - weekly newspaper,
published and circulated in the City of Temple City.
