Carteret preceding the Regular Meeting April 25, 2024 was held
Thursday, April 11, 2024, at approximately 6:00 p.m. remotely, via
telephone call -in.
Upon individual roll call, the following were noted present: ROLL CALL

The meeting was opened with a moment of silent prayer and the OF ALLEGIANCE

Public Hearing on the 2024 Annual SID I & II Budgets to be closed,
upon MMS&C, by Councilmembers Diaz and Krum and unanimous
affirmative vote of the four (4) Councihnembers present.
Councilmember DiMascio abstained.
APPROVAL OF Upon MMS&C, by Councilmembers Diaz and Bellino and unanimous
MINUTES affirmative vote of the five (5) Councilmembers present, the minutes
of March 21, 2024 were approved as transcribed and engrossed by the

ORDINANCE #24-3 The Municipal Clerk stated that Ordinance #24-3 was introduced and
FULLY FUNDED adopted on First Reading on March 21, 2024. It was duly published in
ACQUISITION the Home News Tribune on April 2, 2024 with notice that it will be
ORDINANCE considered for final passage after Public Hearing to be held on April
11, 2024, at approximately 6:00 p.m. The Ordinance was posted on

ORDINANCE OF THE BOROUGH OF CARTERET,
IN THE COUNTY OF MIDDLESEX, ADOPTING
REDEVELOPMENT PLAN FOR THE 21— 25 COOKE
AVENUE REDEVELOPMENT AREA
WHEREAS, on August 11, 2022, the Borough Council (the `Borough Council") of the
Borough of Carteret (the `Borough"), following the recommendation of the Borough
Planning Board (the "Planning Board"), adopted a resolution designating the property
identified as Block 6504, Lot 11 on the tax map of the Borough (the "21 — 25 Cooke
Avenue Redevelopment Area") as an "area in need of redevelopment" under the Local
Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the "Redevelopment
Law"); and
WHEREAS, on December 13, 2023, the Planning Board reviewed a proposed
redevelopment plan for the 21 — 25 Cooke Avenue Redevelopment Area, prepared by
Beacon Planning and Consulting Services, LLC and dated December 2023 (die "21 — 25
Cooke Avenue Redevelopment Plan"); and
WHEREAS, on December 13, 2023, the Planning Board found and concluded that the
21 — 25 Cooke Avenue Redevelopment Plan is not inconsistent with the Borough's
Master Plan or the Master Plans of Woodbridge, Rahway or Linden, the Middlesex
Comity Master Plan or the State Development and Redevelopment Plan, and, on
December 13, 2023, it adopted a resolution memorializing such findings and
recommending adoption of the 21 — 25 Cooke Avenue Redevelopment Plan; and
WHEREAS, the Borough Council agrees with the findings of the Planning Board and
finds that the 21 — 25 Cooke Avenue Redevelopment Plan will serve the best interests of
the Borough and now desires to adopt same.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough
of Carteret as follows:
1. The aforementioned recitals are incorporated herein as though fully set fon1li at
length.
2. The 21 — 25 Cooke Avenue Redevelopment Plan, a copy of which is on file
with the Borough Clerk and which is incorporated herein by reference, is
hereby approved and adopted.
3. The sections of the Zoning Map of the Borough that relate to the 21-25
Cooke Avenue Redevelopment Area are hereby amended to incorporate the
provisions of the 21 — 25 Cooke Avenue Redevelopment Plan.
4. This Ordinance shall take effect in accordance with applicable law.

FOR EMERGENCY SEWAGE FAILURE REPAIR
WHEREAS, N.J.S.A. 40A:11-6 provides that a purchase, contract or agreement may be
made, negotiated or awarded without public advertising for bids and bidding therefore,
notwithstanding that the cost of contract price will exceed the amount set in the
prevailing bidding threshold, when an emergency affecting the public health, safety or
welfare requires the inumdiate delivery of performance of services, provided: A written
requisition for the performance of such work or labor, or the furnishing of materials,
supplies or services is filed with the contracting agent or his deputy in charge describing

or labor, materials, supplies or services; and
WHEREAS, an emergency situation meeting the criteria set forth above resulting from
an EMERGENCY SEWAGE PAILURE REPAIR; and
WHEREAS, an emergency purchase/repair was made by PSI Process & Equipment
Group, 201 Lincoln Blvd., Middlesex, NJ 08846 in the amount not to exceed $10,000.00
for said Sewage Failure Repair with regard to the Hayward Avenue & Beverly Street
Sanitary Sewer Pump Stations.
NOW THE REFORE BE IT RESOLVED that the Mayor and Council of the Borough
of Carteret, does hereby authorize the payment of $10,000.00 to PSI Process &
Equipment Group, 201 Lincoln Blvd., Middlesex, NJ 08846 for the emergency purchase

RESOLUTION OF THE BOROUGH OF CARTERET, IN THE
COUNTY OF MIDDLESEX, NEW JERSEY DESIGNATING
CERTAIN PROPERTY IDENTIFIED AS BLOCK 3601,
LOTS 1 & 2 ON THE BOROUGH'S TAX MAP AS
AN AREA IN NEED OF REDEVELOPMENT
WHEREAS, by Resolution No. 22-74, adopted on March 24, 2022, the Borough Council
authorized and directed the Borough's Planning Board (the "Planning Board") to
undertake an investigation to determine whether the area consisting of Block 3601, Lots 1
& 2 on the Borough's Tax Maps and commonly known as 391 Carteret Avenue and 100
Jackson Avenue (collectively, the "Study Area") constitutes an area in need of
redevelopment under the Local Redevelopment and Housing Law, M.I.S.A. 40A:12A-1
of seq. (the "Redevelopment Law"); and
WHEREAS, the Planning Board caused Beacon Planning and Consulting Services, LLC
(the "Planning Consultant") to conduct a preliminary investigation to determine whether
the Study Area should be designated as an area in need of redevelopment; and
WHEREAS, the Planning Board received a report and map depicting the Study Area
prepared by the Planning Consultant, entitled "391 Carteret Avenue & 100 Jackson
Avenue Redevelopment Area Assessment", dated February 2024 (the "Report'),
concerning the determination of the Study Area as an area in need of redevelopment; and
WHEREAS, on March 27, 2024, the Planning Board reviewed the Report, heard
testimony from a representative of the Planning Consultant, and conducted a public
hearing during which the owners of the property in the Study Area and members of the
public were given an opportunity to present their own evidence and/or to cross-examine
the Planning Consultant concerning the potential designation of the Study Area as an area
in need of redevelopment; and
WHEREAS, the Planning Consultant concluded in the Report and testified to the
Planning Board on March 27, 2024, that the properties in the Study Area satisfy the
criteria for redevelopment area designation set forth in N.J.S.A. 40A:12A-Se and 5h; and
WHEREAS, after the conclusion of the public hearing described above, the Plamiing
Board determined that the Study Area meets criteria set forth in N.J.S.A. 40A:12A-5e
and 5h for designation as an area in deed of redevelopment and determined that it would
recommend that the Borough Council so designate the Study Area; and
WHEREAS, on March 27, 2024, the Planning Board adopted a Resolution of Findings
and Conclusions setting forth such findings and recommendations; and
WHEREAS, the Borough Council agrees with the conclusions of the Planning Board
that the Study Area satisfies the criteria for redevelopment area designation set forth in
N.J.S.A. 40A:12A-5e and 5h, and the Borough Council fords that such conclusion is
supported by substantial evidence; and
WHEREAS, the Borough Council now desires to designate the Study Area as an area in
need of redevelopment, pursuant to N.J.S.A. 40A:12A-6.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:

1. The aforementioned recitals hereof are incorporated herein as though set
forth at length herein.
2. The properties designated as Block 3601, Lots 1 & 2 on the Official Tax
Map of the Borough and commonly known as 391 Carteret Avenue and
100 Jackson Avenue satisfy the criteria for redevelopment area
designation set forth in N.J.S.A. 40A:12A-5e and 5h as set forth in the
Report, and such area is hereby designated as an area in need of
redevelopment (the "Redevelopment Area").
3. In connection with the redevelopment of the Redevelopment Area, the
Borough shall be authorized to use all the powers provided under the
Redevelopment Law for use in a redevelopment area other than the use of
eminent domain.

WHEREAS, the Federal Highway Administration (FHWA) provides opportunities for
Local Public Agencies (LPA), such as the BOROUGH OF CARTERET, to receive
Federal Aid Highway Program (FAHP or federal -aid) funds through New Jersey
Department of Transportation (NJDOT); and '
WHEREAS, the BOROUGIF OF CARTERET is presently the recipient of federal -aid
funds awarded through a project under the 2023 CONGRESSIONAL
DISCRETIONARY PROGRAM for the Carteret Ferry Terminal Building
(Congressional Fed Discretionary FY 2023); and
WHEREAS, the BOROUGH OF CARTERET as an LPA, is responsible for
administering federal -aid funded projects in compliance with all federal -aid requirements
established by the FHWA; and
WHEREAS, the NJDOT, through its Stewardship Agreement with FHWA, is
responsible for ensuring that the BOROUGH OF CARTERET is adequately staffed and
suitably equipped to undertake federal -aid projects, and ensure that federal requirements
are met; and
WHEREAS, the BOROUGH OF CARTERET, as required by the NJDOT, has
developed a Policy outlining the required procedures for the Administration of Federally
Funded Transportation Projects administered through the NJDOT; and
NOW, THEREFORE, BE IT RESOLVED, by the Council of the BOROUGFI OF
CARTERET, County of Middlesex, State of New Jersey, that the BOROUGH OF
CARTERET adopts the policy entitled, "Procedures for the Administration and
Inspection of Federal Aid Highway Projects Dated April 2024; and
