AUTHORIZING A PROFESSIONAL SERVICES CONTRACT WITH
EXCEL ENVIRONMENTAL RESOURCES, INC.
WHEREAS, the Borough of Carteret is in need of professional environmental services
related to a Preliminary Assessment regarding 100 Minue Street; Block 2702, Lot 25; and
WHEREAS, Excel Enviromnental Resources, Inc. possesses the requisite knowledge,
training, experience and professional license to provide said services; and has submitted a
proposal to provide said services at a cost not to exceed a total amount of $5,685.00; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose. Account #:
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
I. The proposal from Excel Enviromnental Resources, Inc. for
professional environmental services related to a Preliminary
Assessment regarding Block 2702, Lot 25, 100 Minue Street at a cost
not to exceed $5,685.00 at the rate set forth in Excel Environmental
Resources, Inc.'s existing contract with the Borough is hereby
approved.
2. Annexed hereto is a copy of said proposal.
3. This action is approved as an award of a professional services contract
pursuant to N.LS.A. 40A:11-5(1)(a) in accordance with the Borough's
Fair and Open Process as authorized by law.
4. A copy of this Resolution to be forwarded to the Borough's
Purchasing Department, the Borough's Director of Engineering and
Excel Environmental Resources, Inc.

Excel Environmental Resources, Inc. (Excel) is pleased to provide this Proposal to conduct a Preliminary Assessment (PA)
for the above referenced property as detailed in the attached Cost Estimate for your consideration. The PA will be conducted
to meet or exceed the minimum requirements for a PA as specified in N.LA.C. 7:26E, the Technical Requirements for Site
Remediation (hereafter referred to as the Technical Rules), in order to satisfy the minimum due diligence requirements of the
innocent purchaser defense as defined by N.J.S.A. 58:10.23.1 lg.
The objective of the PA is to identify areas of potential environmental concern (ADCs) associated with the current and/or
past uses at the subject property. Note that the potential for an environmental concern associated with asbestos, lead -based
paint, and radon will also be evaluated as part of the PA.
Work will be conducted on a time and materials basis and Excel will not exceed the cost estimate detailed herein without
receipt of prior authorization. The detailed Cost Estimate is provided in Attachment A. The work outlined in this proposal
will be conducted in accordance with Excel's Standard Terms and Conditions and labor rates provided in Attachment B. A
copy of Excel's General Comprehensive, Professional, and Pollution Liability insurance certificate can be provided upon
