RESOLUTION OF THE BOROUGH OP CARTE, RET, IN THE
COUNTY OF MIDDLESEX, NEW JERSEY DESIGNATING
CERTAIN PROPERTY IDENTIFIED AS BLOCK 3601,
LOTS 1 & 2 ON THE BOROUGH'S TAX MAP AS
AN AREA IN NEED OF REDEVELOPMENT
WHEREAS, by Resolution No. 22-74, adopted on March 24, 2022, the Borough Council
authorized and directed the Borough's Planning Board (the "Planning Board") to
undertake an investigation to determine whether the area consisting of Block 3601, Lots I
& 2 on the Borough's Tax Maps and commonly known as 391 Carteret Avenue and 100
Jackson Avenue (collectively, the "Study Area") constitutes an area in need of
redevelopment under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1
et seq. (the "Redevelopment Law"); and
WHEREAS, the Planning Board caused Beacon Planning and Consulting Services, LLC
(the "Planning Consultant") to conduct a preluninary investigation to determine whether
the Study Area should be designated as an area in need of redevelopment; and
WHEREAS, the Planning Board received a report and map depicting the Study Area
prepared by the Planning Consultant, entitled "391 Carteret Avenue & 100 Jackson
Avenue Redevelopment Area Assessment", dated February 2024 (the "Report"),
concerning the determination of the Study Area as an area in need of redevelopment; and
WHEREAS, on March 27, 2024, the Planning Board reviewed the Report, heard
testimony from a representative of the Planning Consultant, and conducted a public
hearing during which the owners of. the property in the Study Area and members of the
public were given an opportunity to present their own evidence and/or to cross-examine
the Planning Consultant coneeming the potential designation of the Study Area as an area
in need of redevelopment; and
WHEREAS, the Planning Consultant concluded in the Report and testified to the
Planning Board on March 27, 2024, that the properties in the Study Area satisfy the
criteria for redevelopment area designation set forth in N.J.S.A. 40A:12A-Se and 5h; and
WHEREAS, after the conclusion of the public hearing described above, the Planning
Board determined that the Study Area meets criteria set forth in N.J.S.A. 40A:12A-5e
and 5h for designation as an area in need of redevelopment and determined that it would
recommend that the Borough Council so designate the Study Area; and
WHEREAS, on March 27, 2024, the Planning Board adopted a Resolution of Findings
and Conclusions setting forth such findings and recommendations; and
WHEREAS, the Borough Council agrees with the conclusions of the Planning Board
that the Study Area satisfies the criteria for redevelopment area designation set forth in
N.J.S.A. 40A:12A-Se and 511; and the Borough Council finds that such conclusion is
supported by substantial evidence; and
WHEREAS, the Borough Council now desires to designate the Study Area as an area in
need of redevelopment, pursuant to N.J.S.A. 40A:12A-6.
NOW, THEREFORE, BE IT RESOLVED by Jhe Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:

I, The aforementioned recitals hereof are incorporated herein as though set
forth at length herein.
2. The properties designated as Block 3601, Lots I & 2 on the Official Tax
Map of the Borough and commonly known as 391 Carteret Avenue and
100 Jackson Avenue satisfy the criteria for redevelopment area
designation set forth in N.J.S.A. 40A:12A-5e and 5h as set forth in the
Report, and such area is hereby designated as an area in need of
redevelopment (the "Redevelopment Area").
3. In connection with the redevelopment of the Redevelopment Area, the
Borough shall be authorized to use all the powers provided under the
Redevelopment Law for use in a redevelopment area other than the use of
eminent domain.
4. This resolution shall take effect immediately.

Designation of the Properties Identified on the tax map of the Borough of Carteret
Block 3601, Lots 1 and 2 as a Non -Condemnation Area in Need of Redevelopment
Dear Acting Commissioner Suarez:
This firm serves as redevelopment counsel to the Borough of Carteret, County of
Middlesex, State of New Jersey (the "Borough"). The Municipal Council of the Borough (the
"Borough Council") has determined, based upon the recommendation of the Borough's Planning
Board, that the area identified as Block 3601, Lots 1 and 2 on the tax map of the Borough be
designated as a non -condemnation area in need of redevelopment (the "Redevelopment Area")
under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq.. On behalf of the
Borough, enclosed herewith, attached as Exhibit A hereto, please find a certified copy of
Resolution No. 24-110, adopted on April 25, 2024, so designating the Redevelopment Area.
The Redevelopment Area is located in, Metropolitan Planning Area, an area where
development or redevelopment is encouraged pursuant to State law or regulation promulgated
thereto. Accordingly, the designation takes effect immediately upon transmittal of this letter,
pursuant to N.J.S.A. 40A:12A-6(b)(5)(c).

prepared by the Planing Consultant, entitled '1391 Carteret Avenue & 100 Jackson
Avenue Redevelopment Area Assessment", dated February 2024 (the "Report'),
concerning the determination of the Study Area as an area fn need of redevelopment; and
WHEREAS, on Math 27, 2024, the Planning Board roviowed the Report, heard
testimony ffom a representative of (lie Planning Consultant, and conducted a public
hearing during which the owners of the property in the Study Area and members of the
public were given an oppoituun(ty to present their own evidence and/or to cross-examine
the Pluming Consultant concerning the potential designation of the Study Area as an area
In need of redevelopment; and
WHEREAS, the Planning Consultant concluded bi the Report and testified to the
Planning Board on March 27, 2024, that the properties in the Study Area satisfy the
criteria for redevelopment area designation set forth hn N.J,S,A, 40A:12A-5e and 511; and
WHEREAS, after the eoncluslon of [lie public hearing described above, the Planning
Bond determined that the Study Area meets criteria sot forth in N,J.S.A. 40A:12A-Se
and 511 for designation as an area in steed of redevelopment and determined that it would
recommend that the Borough Council so designate the Study Area; and
WHEREAS, on March 27, 2024, the Planning Board adopted a Resolution of Findings
and Conclusions setting forth such findings and recommendations; and
WHEREAS, the Borough Council agrees with the conclusions of the Planning Board
that the Study Area satisfies the criteria for redevelopment area designation set forth in
N,J.S,A, 40A:12A-5o and 5h; and the Borough Council finds that such conclusion is
supported by substantial evidence; and
WHERE, AS, the Borough Council now desires to designate the Study Area as an area in
need of redevelopment, pursuant to N.J.S.A. 40A:12A-6.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
