ORDINANCE NO. 67 -235
AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING SECTION 4265.3 OF ARTICLE IV OF
THE TEMPLE CITY MUNICIPAL CODE AND PROVID-
ING FOR IMMEDIATE ENACTMENT
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. Section 4265.3 of the Temple City Municipal
Code is hereby amended to read as follows
Section 4265.3. Same.
It shall be unlawful for any person to deal,
play, carry on, open or conduct any game of chance
played with cards, dice, or any other device, for
money, checks, credit or thing of value; and no
person shall bet at any of said prohibited games.
There shall be excepted from the effect of this
Section - but not from the effects of Penal Code
Section 330 or any other State proscription - oc-
casional private games played exclusively for social
purposes in a private home, provided such games are
not conducted with any aspect or manifestation of
commercialism, and with respect to which there is
no promoter, house charge, advertising, promotion
or participation by the public.
SECTION 2. The City Council declares that it is necessary
for this ordinance to become effective as an urgency ordinance
on June 2, 1967, for the reason that it has recently adopted
Ordinance 67 -231 providing for an essentially similar enactment
but without indicating that the exemptions provided therein are
not intended to conflict with applicable State regulations; and
for the further reason that without such clarification, there
may be misunderstanding as to the compatibility of such section
with Section 330 of the Penal Code; and for the further reason
that specific rules should be promulgated before implementing
any exemption for benevolent societies.
SECTION 3. SEVERABILITY. If any section, sentence, clause
or phrase of this Ordinance is for any reason held by a court
of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance.
The City Council of the City of Temple City hereby declares that
it would have passed and does hereby pass this Section and each
sentence, section, clause and phrase hereof, irrespective of
the fact that any one or more sections, sentences, clauses or
phrases be declared invalid or unconstitutional.
SECTION 4. PENALTY. Any person, firm or corporation
violating this Ordinance shall be guilty of a misdemeanor and
upon conviction thereof shall be punishable by a fine of not
more than $500, or by imprisonment in the City or County Jail
for a period of not to exceed six (6) months, or by both such
fine and imprisonment.

SECTION 5. The City Clerk of the City of Temple City shall
certify to the passage and adoption of this Ordinance and to its
approval by the Mayor and shall cause the same to be published
in the Temple City Times, a newspaper of general circulation,
printed, published and circulated in the City of Temple City.
