HomeMy Public PortalAbout201401211 REGULAR COUNCIL MEETING, JANUARY 21, 2014 CALL TO ORDER The Regular Council Meeting of January 21, 2014, was convened at 6:00 P.M. by Mayor Eric Struemph. Mayor Struemph requested a moment of silence in honor of former Mayor Louise Gardner who passed away during the past week. ROLL CALL The following Council Members were present for the roll call: Present: Branch, Bray, Graham, Henry, Hussey, Mihalevich, Prather, and Scrivner, and Tergin Absent: Schulte A quorum was declared present. MISCELLANEOUS AGENDA ITEMS There were no miscellaneous agenda items presented. PUBLIC HEARINGS a. Amending Zoning Code Pertaining to Authorized Land Uses, Standards, Parking, and Definitions A staff presentation was made by Senior Planner Eric Barron providing the background of the proposed amendments. Following his presentation, he answered questions asked by Council Members. No one came forward to speak in favor of, or opposition to, the proposed rezoning. Mayor Struemph declared the evidentiary portion of the public hearing concluded and announced that the Council would consider the associated pending bill at this time. 2013-123, sponsored by Councilman Mihalevich, entitled: 2 REGULAR COUNCIL MEETING, JANUARY 21, 2014 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTIONS PERTAINING TO AUTHORIZED LAND USES, STANDARDS, PARKING, AND DEFINITIONS IN CHAPTER 35, THE ZONING CODE. Bill 2013-123 was read third time by title, placed on final passage and passed by the following roll-call vote as Ordinance 15221: Aye: Branch, Bray, Graham, Henry, Hussey, Mihalevich, Prather, Scrivner, and Tergin Nay: None b. Amending Zoning Code Pertaining to Telecommunication Facilities A staff presentation was made by Senior Planner Eric Barron. Following his presentation, he answered questions asked by the Council regarding the proposed amendments. The following persons came forward to speak on the issue. In Opposition: Mr. Michael Chambers on behalf of AT&T stated he believed there are conflicts within the proposed amendments with state and federal laws, and requested the Co uncil continue the issue until he can meet with staff and discuss those conflicts. No one else came forward to speak on the issue. Mayor Struemph declared the evidentiary portion of the public hearing concluded and announced that the Council would consider the associated pending bill at this time. 2013-124, sponsored by Councilman Mihalevich, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING CODE OF THE CITY OF JEFFERSON, BY MODIFYING SPECIFIC USE STANDARDS FOR TELECOMMUNICATION FACILITIES. Councilman Mihalevich requested that Bill 2013-124 be placed on the Informal Calendar at this time to allow staff to research the issues brought forward by Mr. Chambers in his testimony. 3 REGULAR COUNCIL MEETING, JANUARY 21, 2014 MINUTES AND REPORTS RECEIVED AND FILED Mayor Struemph announced that the following minutes and reports have been received and are on file for review in the City Clerk’s office: a. Planning & Zoning Commission, December 12, 2013 b. CAMPO Technical Committee, December 5, 2013 c. Animal Control Section Monthly Report for December, 2013 d. Board of Adjustment, June 11, 2013 e. Parks & Recreation Commission, December 17, 2013 and January 6, 2014 f. Historic Preservation Commission, November 12, 2013 g. Code Contact Issue Report for December, 2013 Mayor Struemph encouraged citizens who wish to participate in any of these boards and commissions to contact Human Resources Director Gail Strope or submit an application through the City’s website. COUNCIL COMMITTEE REPORTS Administration Committee –Councilwoman Carrie Tergin announced that the next meeting would be held Wednesday, February 5, at 8:00 A.M. Finance Committee – Interim Finance Director Bill Betts announced in Councilman Shawn Schulte’s absence that the next meeting will be held on Tuesday, January 28, at 7:30 A.M. Public Safety Committee – Councilman Rick Prather reported that the date for the next meeting will be held immediately following the Brown Bagel Wor k Session on Thursday, January 30. Public Works & Planning Committee – Councilman Bob Scrivner announced that the next meeting will be held on Thursday, January 23, at 7:30 A.M. Other Committee / Liaison Reports – Councilman Larry Henry reported on the January 14 meeting of the Historic Preservation Commission, and announ ced their next meeting will be held on Tuesday, February 11 at 6:30 P.M. Tina Werner, Parks and Recreation Department, made a report in Director Bill Lockwood’s absence regarding issues being considered by the Parks and Recreation Commission. 4 REGULAR COUNCIL MEETING, JANUARY 21, 2014 APPOINTMENTS BY THE MAYOR No appointments were brought forward at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Ms. Carol Davit Chairwoman of the Environmental Quality Commission, made a presentation regarding the Commission’s functions as well as issues currently being discussed and considered by that entity. She introduced two other members who were at the meeting. Following her presentation, she answered questions asked by the Council. Mayor Struemph thanked Ms. Davit and the Commission Members for their contribution to the City by serving on this Commission, and Councilman Henry, liaison to the Commission, also thanked them for the work they do to improve the community. Judge Cotton Walker made a presentation regarding the Municipal Court Community Service Award, and explained the community service program. He stated he wished to publicly recognize Mr. Tim Duncan for his invaluable help in this program, and presented Mr. Duncan with a City Coin and thanked him for his contribution to the program. The Mayor and Council thanked and congratulated Mr. Duncan. Rev. W. T. Edmondson, President of the Faith Voices of Jefferson City, announced the Founding Convention for that organization to be held on Thursday, January 23, at 7:00 P.M. at Quinn Chapel, and invited the Mayor and City Council to attend. Mayor Struemph thanked Rev. Edmondson for this important contribution to the community. ANNOUNCEMENTS BY THE MAYOR, COUNCIL, AND STAFF No announcements were made at this time. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Mr. Ed Williams made a presentation stating his opposition to Bill 2013 -125 (Capital Mall TIF). 5 REGULAR COUNCIL MEETING, JANUARY 21, 2014 CONSENT AGENDA The following items were presented to the Council for their approval by consent: a. Minutes of City Council Meetings: January 6, 2014 A motion was made by Councilman Rick Prather for approval of the Consent Agenda as presented, seconded by Councilman Larry Henry, and approved unanimously by voice vote. BIDS OVER $50,000 Bid 2014 – Patrol Vehicles: A motion was made by Councilman Rick Prather for approval of the bid as presented, seconded by Councilwoman Carrie Tergin, and approved unanimously by the following roll -call vote: Aye: Branch, Bray, Graham, Henry, Hussey, Mihalevich, Prather, Scrivner, and Tergin Nay: None BILLS INTRODUCED 2013-129, sponsored by Councilman Prather, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH OUTDOOR WARNING CONSULTING, LLC. Councilman Prather requested that the rules be suspended so this bill can be passed and the process of repairing the sirens can move forward. There were no objections to the request to suspend the rules. Interim City Administrator Drew Hilpert stated that staff had requested this remain on the informal calendar until some final details can be worked out. RESOLUTIONS There were no Resolutions presented at this time. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS There were no presentations made at this time. 9 REGULAR COUNCIL MEETING, JANUARY 21, 2014 COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY There were no comments made at this time. NEW BUSINESS Councilwoman Carrie Tergin made comments regarding the Transit issues and requested that the Council consider scheduling some meetings with the citizen group interested in that. Councilman Scrivner stated that process had begun and that it will be brought forward after a couple of other major issues such as the conference center and the hiring of a new City Administrator are resolved. Councilman Carlos Graham made comments regarding the Faith Voices of Jefferson City Founding Convention, and stated it will be held on the same evening as the annual Lincoln University Martin Luther King, Jr. celebration in Richardson Auditorium. He indicated he would try to make it to both events and invited citizens to both as well. UNFINISHED BUSINESS There was no unfinished business brought forward. APPROVAL OF CLOSED SESSION MINUTES A motion was made by Councilman Rick Prather to approve the minutes of the January 6 and January 13, 2014, Closed Sessions to include the annotation by Councilman Hussey which showed his absence from the January 13 meeting. The motion was seconded by Councilman Carlos Graham, and approved unanimously by the following roll-call vote: Aye: Branch, Bray, Graham, Henry, Hussey, Mihalevich, Prather, Scrivner, and Tergin Nay: None GO INTO CLOSED SESSION 10 REGULAR COUNCIL MEETING, JANUARY 21, 2014 Mayor Struemph stated that, pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion for the Council will go into Closed Session to discuss the following: a. Personnel [Sec. 610.021(3)] A motion was made by Councilman Scrivner to go into Closed Session for the stated reasons, seconded by Councilman Prather, and approved by the following roll-call vote at 8:00 P.M.: Aye: Branch, Bray, Graham, Henry, Hussey, Mihalevich, Prather, Scrivner, and Tergin Nay: None
