HomeMy Public PortalAboutOrdinance 67-2371 ORDINANCE NO. 67 -237 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 4242 OF THE TEMPLE CITY MUNICIPAL CODE, ESTABLISHING A JUVENILE LOITERING LAW APPLICABLE TO PERSONS UNDER THE AGE OF EIGHTEEN YEARS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. Section 4242 of the Temple City Municipal Code is hereby amended and new Sections 4242.1, 4242.2 and 4242.3 are hereby added to the Temple City Municipal Code - all to read as follows: Section 4242. Every person under the age of eighteen years who loiters about the public streets, avenues, alleys, parks, or other public places in the City, between the hour of 10 :00 o'clock P.M. and the time of sunrise of the following day when not accompanied by his parent or legal guardian hav- ing legal custody and control of such person, or by the spouse over twenty -one years of age of such person, is guilty of a misdemeanor. Section 4242.1. Every parent, guardian', or other person having the legal care, custody, or control of any person under the age of eighteen years who knowingly aids, abets, or encourages such person to violate any provision of Section 4242 is guilty of a misdemeanor. Section 4242.2. The word "loiter" as used in Section 4242 is defined to mean to idle, to loaf, to stand idly by, or to walk, drive or ride about aimlessly with- out lawful purpose. Section 4242.3. Nothing in Section 4242 or 4242.1 shall be construed as in any way limiting the power or right of law enforcement officers to make such investi- gations, detentions, or arrests as such law en- forcement officers would be permitted to make had such Sections not been enacted. SECTION 2. PENALTY. Any person, firm or corporation violating this Ordinance shall be guilty of a misdemeanor any upon conviction thereof shall be punishable by a fine of not more than $500, or by imprisonment in the City or County Jail for a period of not to exceed six (6) months, or by both such fine and imprisonment. -1- • 657 Ord. 67 -237, page 2 SECTION 3. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City.
