It was moved, seconded and passed that the hour of
the regular meeting of Council be changed from 4 p. M. to g P. M.
during the summer-season.
There being no further business Council adjourned,

The regular meeting of Town Council was held tonight
at 8 P. M. in the Council Room and was attended by Mayor Dutton,
who presided, Councilmen Peters, Brown, Lovell, Meddim,.Town Attor-
ney Solms, Shpt. Reed, Chief MoCutchen, Mr. J. W. Lang and Mr. Mel -
vin Hiers.
Supt. Reed stated that there was several pieces of sur-
plus property, 1- A 6 Cylinder Motor (Continental) 2- A Vibrator,
he suggested that they be sold, he was instructed to contact Mr.
J. J. Hutton relative to disposing of these items.
Mr. Reed stated that in connection with the proposed
1§111y the Town, of a water main down 15th Street to furnish
water to the cottages formerly owned by Hotel Tybee that at the
present time a main is already there, which is owned by the Hotel,
he suggested that the Town acquire this main from them. Council
Mr. Melvin Hiers protested against the erecting of a
building on property adjacent to his Lot , Ward 4, as being
to close to the building line. Mr. Lang stated that the building
is 32' wide, and attached to it is a 11' 811 car port, then the
eaves extend out an additional 2', Mr. Hiers stated that he pro-
tested against this when the foundations were poured. After some
discussion the Mayor ordered that the owner of the property as
well as his contractor be placed on the docket for violating the
building code.
Mr. Reed asked what was to be done as regards Mr. A. P.
Solomon moving away from the property formerly occupied by him
on Butler Avenue & 2nd street, he stated that apparentyly electri-
cal fixtures had been removed from the buildings and that a pipe
rack, comparator, and ch3Orinator were missing, also plumbing
fixtures and a switch box had been removed by Mr. J. W. Rentiers
under orders of Mr. Solomon, also that he had been using the
Town's electrical service for about four months. Councilman
Meddin moved that the following committee check on this matter,

Councilmen Brown, Lovell and Hosti, Mr. Reed and Mr. Solms, Mr.
Solms would be requested to be present.
Chief McCutchen stated that he needed fourteen 30 MPH signs
and also four 15 MPH signs to be placed on Jones Avenue. He was in-
structed to ge after past due licenses.
Councilman Brown wanted to know if the collections in the
parking meters were good after 5, p. M. chief McCutchen said they
were very good. The Chief suggested that several parking meters
be placed on 16th Street near the Red Barn location.
Mayor Dutton instructed Mr. Lang to be more strict as re-
gards to the building code.
Councilman Meddin moved that bills for the month of May
amounting to $3695.55 be paid likewise bills for the Water Worts. ;,
System amounting to 4122.03 be paid. It was seconded and the mo-
tion passed.
Councilman Lovell stated that Thomas & Hutton were request-
ing payment on the 0000.00 they claim is due them. It was decided
to hold up payment at this time.
A petition was presented by a number of property owners
living in the vicinity of the property of Sam Blumenthal located
on Tybee Inlet on which is located a building used for the shuck
in_g of oysters and operated by Arthur Thomas, the petitioners pro-
tested against flies, bad odors and also feel that it is a nui-
sance and health menace to the property owners and residents in
that section and asked that this condition be corrected. The mat-
ter was referred to the Town Attorney.
It was moved, seconded and passed that the following
Ordinance concerning speeding on Butler Avenue, be passed.

AN ORDINANCE
AN ORDINANCE TO PROVIDE A SPEED LIMIT OF 15 MITES
PER HOUR ON JONES AVENUE, SOMETIMES KNOWN AS 3RD
AVENUE, FROM 1ST STREET TO 6TH STREET; PRESCRIBING
.THE PENALTY FOR THE VIOLATION THEREOF; AND FOR
OTHER PURPOSES.
BE IT ORDAINED by the authority of the Mayor and
Councilmen of Savannah Beach, Tybee Island, and
it is hereby ordained by authority of the same as
follows:
SECTION 1. That it shall be unlawful for any person or
persons to operate, drive or otherwise cause to be driven any
motor vehicle of any type whatsoever at a speed in excess of
15 miles per hour on Jones Avenue, sometimes known as 3rd
Avenue, from 1st Street to 6th Street.
SECTION 2. Any person violating the provisions of this
ordinance, upon conviction thereof, shall be subject to be fined
not to exceed x;;100.00 and imprisoned not to exceed 30 days,
either or both.
SECTION 3. That all ordinances or parts of ordinances
conflicting with the provisions of this ordinance are hereby
repealed.

Resolution be adopted.
AN ORDINANCE
AN ORDINANCE TO PROHIBIT THE DIVING OR JUMPING FROM
ANY STRUCTURE, BUILDING OR PIER INTO THE ATLANTIC
OCEAN BY ANY PERSON OR PERSONS WITHIN THE CORPORATE
LIMITS OF SAVANNAH BEACH, TYBEE ISLAND; TO PROVIDE
A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AND
FOR OTHER PURPOSES.
BE IT ORDAINED by the authority of the Mayor and
Councilmen of Savannah Beach, Tybee Island, and it
is hereby ordained by authority of the same as
follows:
SECTION 1. That it shall be unlawful for any person or
persons to dive, jump or in any other manner catapult his or her
body from 'che concrete seawall and /or walkway or any part of the
same, or from any groin, or any pier or any other structure
erected along the Atlantic Ocean from the point of Tybee Inlet
and the Atlantic Ocean northwardly to the point near the old Fort
Screven Reservation where the Savannah River and Atlantic Ocean
meet within the corporate limits of Savannah Beach, Tybee Island.
SECTION 2. Any person violating the provisions of this
ordinance, upon conviction thereof, shall be subject to be fined
not to exceed 0100.00 and imprisioned not to exceed 30 days,
either or both.
SECTION 3. That all ordinances or parts of ordinances
conflicting with the provisions of this ordinance are hereby re-
pealed.

Ordinance be adopted.

AN ORDINANCE AIa,:amING THE ORDINANCE PROVIDING
THE RATE OF LICENSES FOP. DOING BUSINVESS IN THE
TON OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA,
FOR THE FISCAL YEAR ENDING APRIL 30, 1952;
FIXING T Eli PENALTY FOR THE VIOLATION; AND FOR
OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen
of the Town of Savannah. Beach, Tybee Island,Geo_rgia, in Council
assembled, and it is hereby ordained by the authority of the same
that Section 1 of the Ordinance providing the rate of license for
doing business in the Town of Savannah Beach, Tybee Island, Georgia,
for the fiscal year ending April 30, 1952, be and the same is here-
by amended in the following particulars:
(a) Any person, firm or corporation
operating an amusement arcade (machines only) - 125.00
(b) Each and every person, firm or corporation
engaged in operating a baseball game whereby
baseballs are thrown or pitched by a machine
so that a person i:7ayy strike the same with
a bat, resembling regulation baseball batting
practice - 25.00
(c) Each and every person, firm or corporation
operating a Miniature Golf Course - 25.00
SECTION 2. All ordinances, and parts of ordinances,
in conflict herewith are hereby repealed.

It was moved, seconded and passed that the following
Resolution be adopted.
A RESOLUTION

WHEREAS, the Honorable Alexander R. MacDonell, Judge of
the City Court of Savannah and Judge, Pro Hac Vice, of the
Superior Court of Chatham County, Georgia, departed this life on
Wednesday, June 13, 1951; and,
WHEREAS, Judge MacDonell, as he was respectfully and
affectionately known to all people, was an outstanding leader in
the civic affairs, business and development of Chatham County,
Georgia, and his native City of Savannah. His career on the bench
was an example of dignity and sincerity to the citizens of our
community as well as a perfect example of the requirements of the
office of a Judge. He was always held in highest esteem and will
forever be remembered with warm affection by the citizens of our
community; and,
WHEREAS, Judge MacDonell was the leader of such organiza-
tions as the Savannah Kiwanis Club, Military Order of World War,
University of Georgia Club, Cosmos Club, St. Andrews Society,
Georgia Historical Society and many others as well as a very active
member of the Masonic Bodies, and through these organizations he
materially increased the welfare of his City and County.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, in Council assembled,
that in the death of the Honorable Alexander R. MacDonell, the Town
of Savannah Beach has lost one of its most valued and faithful
friends, and that the sympathies of the Mayor and Councilmen and
those of the citizens of the Municipality be extended to the family
of Judge MacDonell;

BE IT FURTHER RESOLVED that a copy of this Resolu-
tion be spread upon the Minutes of Council and that a copy
hereof be sent to the wife and family of Judge MacDonell.

It was moved, seconded and passed that the following
Resolution be adopted.
A RESOLUTION
WHEREAS, As C. CARTER has petitioned to the Mayor and
Councilmen of Savannah Beach, Tybee Island, Georgia requesting
a conveyance of one -half of the old right -of -way of the Central
of Georgia railroad which is adjacent to Lots 1, 2 and 3 in
Garden Ward in said Municipality, which lots are owned by the
said A. C. Carter,
NOW, THEREFORE, be it resolved by the Mayor and Council.*
men in a regular meeting of Council assembled and it is hereby
resolved by authority of the same that the petition and request
of A. C. Carter be and the same is hereby approved and,
BE IT FURTHER resolved by the Mayor and Councilmen that
the Mayor be and is hereby authorized and directed to execute
a quit claim deed for and in consideration of the sum of 01.00
to the said A. C. Carter and the Clerk of Council is hereby
authorized and directed to attest the said deed and affix the
corporate seal thereto conveying to the said A. C. Carter the
following described property. Subject, however, to an ease-
ment also hereinafter described, to -wit: _
ALL that certain lot, tract or parcel of land situate;
lying and being in the Town of Savannah Beach, Tybee Island,
Georgia, known as a portion of the Southern one -half of the
abandoned railroad right -of -way of the Central of Georgia
railroad, which said portion of said abandoned right -of -way
lies adjacent to Lot Number One (1), Lot Number Two (2) and
Lot Number three (3), Garden Ward, and which has a common
boundary with said Lots Numbers One (1), Two (2) and Three (3),
Garden Ward, of Two Hundred Forty -four point Nine (244.9) feet
with depth from the center line of said right -of -way to the
common boundary line with Lots Numbers One (1), Two (2), and
Three (3), Garden Ward, of Fifty (50) feet which is more parti-
cularly described by being outlined in red ink on a plat made
by S. R. Kehoe, Jr,, for A. C. Carter on January 10, 1951, a
copy. of which said plat is hereto attached and made a part
hereof, the original of said plat being recorded in plat record
book , folio , in the office of the Clerk of
the Superior Court, Chatham County, Georgia.
Subject, however, to an easement or right -of -way reserved
by the said party of the first part, which said easement or right -
of -way is the northern fifteen (15) feet of said portion of the
abandoned railroad right -of -way hereby conveyed and which ex-
tends the full length of the-property, that is, Two Hundred Forty -
four point Nine (244.9) feet.

The regular meeting of Town Council was held at S P. M.
in the Council Room and attended r:by Mayor Dutton, who presided,
Councilmen peters, Brown, Strong, Lovell, Meddin, Supt. Reed,
Chief McCutchen, Inspector Lang and Mr. M. C. ;Matthews.
Mr. Matthews requested permission to drill a 3 inch arte-
-slan well on his property at Estill Station. Permission was grant-
ed. Mr. Matthews was excused.
Mr. Reed reported that the Water Works System was operat-
ing properly that at the present time he has 19 State prisoners
and 4 Brown Farm prisoners. He stated that last month 31,000, 71+0,
000 gallons of water was pumped
The Mayor stated, that he had spoken to Mr—Don Livings-
ton relative to Hotel Tybee turning over to th.e.:Town the water
main on the north side of 15th Street, Mr. Livingston agreed to
40 this if the Town would.give free water rent for this year,
Councilmanlleddin moved that the Town allow free water rent for
each unsold building on 15th Street for this year only in return
.for the conveyance of this main to the Town, the motion was second-
ed and passed.
Thomas & Hutton requested that payment be made on the
amount they claim that is due at this time, $4000.00., After
some discussion it was decided to appoint a Committee consisting
of Councilman Meddin, Lovell, Town Attorney Solms and Supt. Reed
with power to act, to see Thomas & Hutton with the view of gett-
ing.the matter adjusted.
Councilman Brown in discussing the Layne Atlantic. Co.
who were engaged by Thomas & Hutton. to install automatic controls
on the Water Works System at a cost of $2500.00 moved that.a
Committee be appointed to handle the matter with power to act,
the motion was seconded and passed.
Supt. Reed called attention to the coal ranges at the
Convict Camp having outlived their usefulness and suggested that
gas ranges be installed, which would reduce cost of operation.
He was requested to check on the matter.
