HomeMy Public PortalAbout2004-119 (07-20-04)RESOLUTION NO. 2004.119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA APPOINTING THE LYNWOOD CITY CLERK AS THE IMPARTIAL PERSON TO TABULATE THE LIGHTING ASSESSMENT DISTRICT BALLOTS AND THE LANDSCAPE ASSESSMENT DISTRICT BALLOTS WHEREAS, on May 18, 2004, the City Council adopted a resolution titled "A Resolution of the City Council of the City of Lynwood, declaring its intention to order the levy and collection of annual assessments for Fiscal Year 2004-2005 within Lynwood Lighting Maintenance Assessment District pursuant to the Landscaping and Lighting Act of 1972" as amended (Commencing with Streets and Highways Code Section 22500 et. Seq.), fixing the time and place for hearing protests and objections; and authorizing staff to send out voting ballots as required by law"; and WHEREAS, on May 18, 2004, the City Council adopted a resolution titled, "A Resolution of the City Council of the City of Lynwood, declaring its intention to order the levy and collection of annual assessments for Fiscal Year 2004-2005 within Lynwood Landscape Maintenance District Pursuant to the Landscaping and Lighting Act of 1972" as amended (Commencing with Streets and Highways Code Section 22500 et. Seq.), fixing the time and place for hearing protests and objection, and authorizing staff to send out voting ballots as required by law"; and WHEREAS, on June 1, 2004, the City Council of the City of Lynwood approved a resolution titled, "A Resolution of the City Council of the City of Lynwood adopting the Proposition 218-Assessment Ballot Proceedings Procedures"; and WHEREAS, pursuant to California Government Code Section 53753 (e)(1), the City Council must appoint an impartial person to tabulate the Lighting and Landscaping Assessment Ballots; and WHEREAS, in order to comply with deadlines for the Assessment Districts' billing, the tabulation process must be done as expeditiously as possible, but in no case more than five business days. NOW, THEREFORE, the City Council of the City of Lynwood, California, does hereby resolve as follows: The Lynwood City Clerk is hereby appointed as the impartial person to tabulate the Lighting Assessment District Ballots and the Landscape Assessment District Ballots. The City Clerk shall tabulate the Lighting Assessment District Ballots and the Landscape Assessment District Ballots in an expeditious manner, not to exceed five business days. The City Clerk shall certify the balloting results at the completion of the process and shall report said results to the Council at the first meeting following the completion and certification.
