HomeMy Public PortalAboutRES 82/06RESOLUTION NO. 82 -6 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULFSTREAM, FLORIDA, EXPRESSING ITS STRONG OPPOSITION TO THE TRANSFER TO THE CITY OF DELRAY BEACH OF THE RESPONSIBILITY FOR OPERATION AND MAINTENANCE OF NORTHEAST EIGHTH STREET FROM SWINTON AVENUE TO SR AIA INCLUDING THE DRAWBRIDGE OVER THE INTRACOASTAL WATERWAY AND URGING RECONSIDERATION AND THE RESCINDING OF THIS TRANSFER; PROVIDING FOR FURNISHING COPIES OF THIS RESOLUTION. WHEREAS, the Town Commission is in receipt of certain information from the City of Delray Beach, Florida, stating that it has received correspondence from the Palm Beach County Department of Engineering informing that, pursuant to Florida Statutes Section 335.04, the Board of County Commissioners of Palm Beach County has adopted Resolution R -81 -621 transferring certain roads "functionally classified" as city streets from the County to the City of Delray Beach, Florida; and, WHEREAS, this proposed transfer of streets from the County will result in the transfer of responsibility to the City of Delray Beach for maintenance and operations of certain streets, including Northeast Eighth Street from Swinton Avenue to SR AIA, which includes a drawbridge over the Intracoastal Waterway; and, WHEREAS, the estimated annual cost for operation and minor repairs to the Eighth Street bridge is $120,000.00, which is approximately .1 mil of the City of Delray Beach's total property tax; and, WHEREAS, such an expense will impose an extreme hardship on the City's taxpayers, and may force the City of Delray Beach to undertake drastic measures to abate this additional expense; and, WHEREAS, this section of Northeast Eighth Street, including the drawbridge, serves primarily to link U.S. 1 with SR AIA, is used as the primary access point for the residents of the Town of Gulfstream, and serves only a secondary function as a city street for the City of Delray Beach; and, WHEREAS, apparently there is no other drawbridge in Palm Beach County that is required to be maintained and operated by a municipality, with the attendant overly burdensome cost; and, WHEREAS, the Town Commission of the Town of Gulfstream, Florida, wishes to express its strong opposition to the transfer of maintenance and operation responsibility from the County to the City of Delray Beach of Northeast Eighth Street, with its drawbridge, and to urge that Palm Beach County rescind that portion of their Resolution No. R -81 -621 attempting to transfer Northeast Eighth Street to the City of Delray Beach. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULFSTREAM, FLORIDA, AS FOLLOWS: Section 1. That the Town Commission of the Town of Gulfstream, Florida, does hereby express its strong opposition to the transfer from Palm Beach County to the City of Delray Beach of the responsibility for the operation and maintenance of Northeast Eighth Street from Swinton Avenue to SR AIA, including the drawbridge over the Intracoastal Waterway, and hereby urges the Board of County Commissioners of Palm Beach County to reconsider this matter and to rescind that portion of their Resolution No. R -81 -621 which attempts the transfer of the subject public right of way. Section 2. That the Town Clerk is hereby authorized and directed to furnish copies of this Resolution to each member of the Board of County Commissioners of Palm Beach County, the County Administrator, the County Engineer, the City of Delray Beach, and all other appropriate public officials and agencies.
