October 11, 1951
The regulgr meeting of Town Council was held today in
the Council Room at 4 P. M. and was attended by Mayor Dutton,
who presided, Councilmen peters, Brown, Strong, Lovell, Town
Attorney Solms, Supt. Reed, Chief MoCutchen,'Bldg. Insp. Lang
and Mr. Edmund Solomon.
Supt. Reed reported that the Water Works System was
functioning alright, that the Auditorium should be adequately
heated and also that the Town Hall needs a Dring Fountain.
It was moved, seconded and passed that the matter be referred
to Councilman Lovell-with authority to act.
The Town Attorney was instructed to write to Mr. J. J.
Collins in reference to his petition protesting against the
construction of a ramp by the Public Dock.
The Mayor informed Council that when the Town gets
more prisoners work will start on laying water works mains.
'The Mayor informed Council that a committee consisting
of Councilman Lovell, Town Attorney Solms, Mr. J. J. Hutton
and Dr. Glenn discussed the condition of the Sewer System and
they seemed to think that the trouble is infiltration in some
of the lines and advised having Thomas & Hutton make a survey
to ascertain the remedy. It was moved, seconded and passed
that Thomas & Hutton be employed to make'the survey and that
the Mayor be authorized to negotiate a contract with them.
Councilman Lovell wanted to know what had happened
to the new fire truck that was purchased last year, Supt.
Reed said that he was getting it ready now.
Chief MoCutchen asked what should be done about the
Parking Meters, the Mayor said that they should be taken down.
Chief MoCutchen asked what was to be done about heating the
Jail and police Headquarters, the matter was referred to
Councilman Lovell to confer with M. 0. Seckinger. The Mayor
asked the Chief what was wrong with the police Car as it does
not seem to be running properly, Chief McCutchen stated that
the motor cycle should be stored for the winter, the cost for
storage at Cleary's would be about $30.00, he was instructed
to contact Cleary relative to this and also to see Councilman
peters.
Councilman Brown suggested that a meter reader be
employed to assist Supt. Reed. It was decided to hold off on
this.

Mr. Edmund Solomon offered to contract with the
Town for all of the salvage material left at the Garbage Dump
on a yearly basis for a fee of %'50.00 per year, he to do all
loading and hauling. It was moved, seconded and passed that a
contract be entered into for this purpose and that Supt. Reed
would supervise the removal of it.
In_ the matter of the request for the transfer of the
1951 license of Bones Fishing Camp to Mice Notrica, Councilman
Strong is handling this.
Town Attorney Solms informed Council that he had
written all parties who claim an interest in the oyster shells
purchased by the Town from Sam Blumenthal.
Councilman Meddin moved that bills for General Gov-
ernment for the month of September amounting to $159.05 and
bills for the Water Works Dept. for September amounting to
$404.99, be paid. The motion was seconded and passed.
The Mayor informed Council that he discussed with
Mr. Bacon of the State High way Dept. the widening of Butler
Avenue south of 16th Street and that the High Way Dept. re-
commended paving it 261 feet wide, the Town will have to lay
water mains and will also have to fill in some low spots to
raise the street the proper level.

Resolution be adopted.

resolution be adopted.
A RESOLUTION
WHEREAS, Lawrence 0. Gann has petitioned to the Mayor and
Councilmen of Savannah Beach, Tybee Island, Georgia, requesting a
conveyance of a lot near Chimney Pot Creek, U. S. Highway #80; and,
WHEREAS, the exact location and the boundaries of the said
lot are too vague and indefinite; and whereas, the said Lawrence O.
Gann agrees to pay the Municipality the sum of Two Hundred (000.00)
Dollars for the said lot which lies in the marsh lands.
NOW TETPLEFORE, BE IT RESOLVED, by the Mayor and Councilmen
of Savannah Beach, Tybee Island, in regular meeting assembled and it
is hereby resolved by authority of the same that the request for con-
veyance for said lot be approved subject to a survey to be furnished
to the Municipality by the said Lawrence 0. Gann prior to execution
and delivery of said deed.
BE IT FURTHER RESOLVED that a copy of this resolution be
spread upon the minutes of Council and that a copy be sent to Mr.
Lawrence O. Gann.

A RESOLUTION
WHEREAS, Lewis A. East, an outstanding leader in the
City of Savannah and Chatham County, Georgia, as well as a
regular summer resident of Savannah Beach, Tybee Island, de-
parted this life on Monday, September 24, 1951; and
SEAS, Lewis A. Last was respectfully and affectionately
known to the people of Savannah Beach, Tybee Island, was extreme-
ly active in civic affairs, business and development of his City
of Savannah, as well as his County, and was also always interested
and assisted materially whenever called upon for the furtherance
of the general welfare of Savannah Beach, Tybee Island. All of
which held him in the highest esteem in the minds and hearts of
the citizens of this Municipality and for which he will ever be
remembered with warm affection by the officials and citizens of
our community; and,
NOW, THEREFORE, BE IT RESOLVE.[ by the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, in Council assembled
that in the death of Lewis A. East, the Town of Savannah Beach,
Tybee Island, has lost one of its most valued, faithful and stead-
fast friends, and that the sympathies of the Mayor and Councilmen
and those of the citizens of the Municipality be extended to the
family of Lewis A. East;
BE IT FURTHER RESOLVED that a copy of this Resolution be
spread upon the Minutes of Council and that a copy hereof be sent
to the wife and family of Lewis A. East.

AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING
THE WATER DEPARTMENT: PRESCRIBING IN. THE. RULES
AND REGULATIONS. FOR, THE OPERATION OF THE WATER
WORKS AND WATER DEPARTMENT; PROVIDING FOR THE
ELECTION_OF A MANAGER. AND. SUPERINTENDENT; ESTAB-
LISHING THE RATES FOR WATER SERVICE AND, WATER
SUPPLY; ,PROVIDIN G_FOR HEALTH REGULATIONS PER-
TAINING TO THE.WATER SYSTEM; ALL IN.ACCORDANCE
WITH THE :PROVISIONS OF AN ACT ADOPTED IN 1922
AND THE ACTS 'AMENDING_THE SAME;. AND .FOR OTHER
PURPOSES„

BE IT ORDAINED by the authority of the Mayor.. and
Councilmen of .the Town of Savannah Beach, Tybee
Island, Georgia, in Council assembled, and it is
hereby ordained by authority of the same.
SECTION 1. That Subsection (f) of SECTION 3 of the Water
Ordinance heretofore adopted, be and the same is hereby amended to
rea as follows: "SECTION 3, Subsection (f) - Issue orders to cut
off water for failure to pay rent and to turn water back on when
fee is paid."
SECTION 2. That Subsection (1) of SECTION 5 of the afore -
said Water Ordinance is hereby amended to read as follows: "SECTION
5 ubsection (f) Cut off or turn on water on various properties
upo notice from Manager of the Water Department ".
SECTION 3. That Section 8 of the aforesaid Water Ordinance
is mended_by eliminating the last two sentences and adding thereto:
"Al commercial users shall install water meters not later than
May 1, 1952 ".
SECTION 4. That Section 9 of the aforesaid Water Ordinance
is ended._to read as.foliows: "T e residential water users shall be
cha ged and furnished water on a_flat rate basis unless the said resi-
denOal water user shall elect at his own option to install a water
met r on his premises or Water Department can install at residential
exp nse in the event the resident violates the regulations governing
the use of water".
SECTION 5. That Section 10 of the aforesaid Water Ordinance
is ended_to read as.f ollows: For the purposes of this ordinance
and for classification and designation of commercial users and resi-
den ial users, the following definitions are hereby adopted, subject
to he reasonable interpretation of unusual instances and /or border -
lin cases which are left to the decision of the Water Department,
wit the final decision resting with the Mayor and Councilmen of said
Municipality.
(a) A commercial user of water is any person, firm or
cor oration_ owning, occupying, leasing or otherwise holding land,
bui dings, structures or premises to which water is furnished by the
mun cipality and on which a business is operated.

(b) A residential user of water is one who occupies the
land or premises to which water is furnished as his dwelling place,
or adobe, residence, temporary residence. The rates for water
service are as follows:
1. Family cottages not having in use more than
six fixtures the sum of 00.00 per year; and for each
additional fixture the sum of X2.50 per year. There
is no proration of the yearly water rate.
2. Two family cottages not having in use more than .
eight fixtures the sum of $37.50 per year; and for each
additional fixture the additional sum of $2.50 per year.
There is no proration of the yearly water rate.
3. If a water user notifies the Water Department
in writing prior to May 1st that the property will
not be used during the ensuing year a charge of $12.00
per annum is to be made payable in advance. In the
event that property is used this sum shall apply to
the regular rate, which shall immediately become due.
(c) The following schedule of meter rates shall apply to
those persons, firms or corporations using water meters. There
will be a minimum monthly charge of $2.50, regardless of whether
or not any water is used; this said charge of $2.50 shall cover
the cost of the first 5,000 gallons or less used by said customer.

The consumers of water on a meter basis shall pay
monthly. A discount of 10% will be allowed if paid within 10 days
of date of bill.
(d) The fiscal year for the Water Department shall com-
mence on May 1st of each year and end on the .following April 30th
of the next year.
(e) Flat rate users who do not pay for water by July
10th will be sent a notice that their water will be cut off if
not paid; after 10 days, if not paid a second notice by registered
letter shall be sent out that water is to be cut off if not paid
Immediately.

(f) Meter users who have not paid their bill by the 1st-
of the month following, shall be sent a notice by registered letter
that water is to be cut off if not paid immediately.
SECTION 6. That Section 11 of the aforesaid Water Ordinance
is amended by adding thereto another paragraph to be known as 11 (b)
which is as follows: "Section 11 (b) Meters will be provided at
cost plus tapping fee on new jobs and at cost of meter plus costs
of installation in cases where tapping fee has already been paid".
SECTION 7. The aforesaid Water ordinance is amended by
eliminating in its entirety Subsection (a) of Section 12 of the
aforesaid Ordinance.
SECTION g. Any person violating the provisions of this
ordinance, upon conviction thereof, shall be subject to be fined
not to exceed $100.00 and imprisoned not to exceed 30 days, either
or both.
SECTION 9. That all ordinances or parts of ordinances
conflicting with the provisions of this ordinance are hereby re-
pealed.

It was moved, seconded and passed that the following
. Resolution be adopted.
A RESOLUTION
WHEREAS, U. S. Highway 80, which terminates at Savannah
Beach.,.. Tybee Island, Georgia, has such an excessive- amount of
traffic.that it congests the highway and streets within the
limits of said Town, which is the easternmost point of U. S.
Highway 80; WHEREAS, U. S. Highway 80 runs in a southwardly direction
on Bu_t1er_Avenue from the intersection of Butler Avenue and
First Street within the Municipality limits which is a two lane
divided separately by a grass plot, until it reaches a point
at 16th Street, which is the beginning of a loop, and at which
point it continues -in a eastwardly direction to the Strand or
Beach along which said highway continues in a southwardly dir-
ection to 18th Street to Butler Avenue from which point it con-
tinues in a northwardly direction along Butler Avenue to 16th
Street, the point of beginning of said loop; and,
WHEREAS, Butler Avenue from 16th Street southwardly to 18th
Street, is_a_ hard surfaced road being only 16 feet in width; and,
SEAS, the said right of way of Butler Avenue from 16th
Street- to_l$th Street is 80 feet in width, which leaves consider-
able space for the expansion of the said highway; and,
BE IT FURTHER RESOLVED by the Mayor and Councilmen of
Savannah. Beach. that .the _ Mayor be and is hereby directed and au-
thorized to request the State Highway Department -to take the
necessary action to widen and extend the said U. S. Highway 80,
from 16th Street to 18th Street from the present width of 16 feet
to a width of 26 feet.
BE IT.FURTHER RESOLVED that a copy of this resolution be
sent to the ..Honorable James Gillis, Director of the State Highway
Department with a request that the State Highway Department give
favorable action to the same.
