Page 12 of 63 6-1 PL-12-104 City of Moab Planning and Zoning Department Correspondence August 16, 2012 Memo To: Honorable Mayor and Members of Council From: Jeff Reinhart, Planner9 Subject: Review of a Boundary Line Adjustment for Properties Located at 396 W 200 S and 426 W 200 S in the RA-1 Residential Agriculture Zone, as Submitted by Philip and Jeanette Kopell Background The affected property consists of two lots containing a total of 8.47 acres. Currently one parcel consists of approximately 2.47 acres and the second 6.00 acres. Relocation of the property line will create a parcel at 1.00 acre and a second at 7.47 acres. Both of the proposed lots meet or exceed the RA-1 lot size requirement of one (1) acre. Discussion This application is being reviewed under code Section 16.08.050, and a public hearing is not required for approval. The relocation of the existing lot line meets all of the requirements of the code: • Approval does not increase the number of lots; • The lots conform to the dimensional requirements of the R-2 zone for lot width and area • Both properties are under single ownership. This property line realignment also complies with State Code Chapter 10-9a-608(2) that allows a subdivision plat to be amended without a public hearing before the Land Use Authority if: (a) the petition seeks to: (i) join two or more of the petitioner fee owner's contiguous lots; (ii) subdivide one or more of the petitioning fee owner's lots, if the subdivision will not result in a violation of a land use ordinance or a development condition; (iii) adjust the lot lines of adjoining lots or parcels if the fee owners of each of the adjoining lots or parcels join in the petition, regardless of whether the lots or parcels are located in the same subdivision; (iv) on a lot owned by the petitioning fee owner, adjust an internal lot restriction imposed by the local political subdivision; or Page 13 of 63 Moab City Council Kopell Amended Plat PL-12-104 2 of 2 (v) alter the plat in a manner that does not change existing boundaries or other attributes of lots within the subdivision that are not: (A) owned by the petitioner; or (B) designated as a common area; and (b) notice has been given to adjacent property owners in accordance with any applicable local ordinance. I am the owner of both properties. Both properties have greenbelt tax exemptions attached to them I would like to combine all of the greenbelt land onto one parcel. This would allow for easier management of the city flood zone at the confluence of mill and pack creeks, as fewer homeowners would be involved. I do intend to sell the house at 426 West 200 South on a conforming 1 acre lot, (RA-1). I am planning on building one house at 396 West 200 South, but there is no intention of further development at this time. Therefore, I am requesting that 1.5 acres of land be removed from 426 West 200 South(parcel A), and be added to the lot at 396 West 200 South(parcel B). Please see the attached plat for details. Receipt No. �.k c n MODIFICATIO N OF PROPERTY OR SUBDIVISION LINES BY EXCHANGE OF TITLE Utah State Code 10-9a-608(7)(b) This section of the Utah Code allows for the exchange of portions of property without having to amend existing subdivision lines if: (1) The property lines are adjacent; and, (2) No new lot results from the exchange of property lines; and, (3) The "exchange" is approved by the Moab City Council; and, (4) The legal descriptions of both the original parcels and the parcels created by the exchange of title is attached as exhibits and to this form; and, (5) This exchange is signed by all the property owners affected by the exchange, the Mayor for the City Council and is noticed in accordance with Utah State Code Title 57-2a `Recognition of Acknowledgements Act' ; and, (6) The document having satisfied all of the above conditions is to be recorded at the Grand County Recorders Office, 125 East Center, Moab, Utah, within thirty (30) days of approval by the Moab City Council. The application for this plat amendment satisfies the dimensional requirements of the PUD regulations and the approved plat. Here is a summary of the changes, followed by a detailed list of the lot line changes. The ultimate goal is to "clean up" the plat. After we received final plat approval and proceeded with surveying, we noticed a few details, such as a lot encroaching into a pathway and carport structures closer than five feet to adjacent lots, thus requiring construction of firewalls. We have adjusted lot lines to remedy those issues. We have been working with a new engineering firm for the roads, parking and paving. Trying to match up the previous engineering design with the new design has been a challenge. As a result, some of the lot boundaries along the edges of the pathways created a "no man's land," meaning that there were small strips of land that were neither pathway nor lot. We have adjusted lot lines to remedy those issues. We have added language to the plat reflecting how and when carports will be constructed. Donna Metzler wrote the language for the plat note. The reason for this is because there was disagreement between us (MLC) and city staff regarding carport construction in the Subdivision Improvements Agreement. The resulting language is a compromise for ensuring that the remaining carports are constructed as lots are sold. The number addresses have been provided by builder inspector, Jeff Whitney, based off the grid. Street names and number addressing have been approved by the building inspector and fire chief. As you may know, the City was approached in the 90s by an informal community group with the idea of building a BMX track on newly -acquired property adjacent to the 500 West Bridge known as Anonymous Park. The idea was that volunteers would provide regular grooming of the area. With volunteer assistance, the track and jumping line were built. City maintenance and improvements, along with volunteer maintenance, have kept the track in about the same condition since 1995. The extent of city and volunteer maintenance has ebbed and flowed over the years, with some criticism of the maintenance of the area. The Club Red Teen Center has held BMX competitions at the site, and the BMX park has been used by local teens and adults since its original construction. Last fall Chile Pepper conducted a jump competition and delivered and contoured dirt for landing pads. They brought in their own wood ramps, which they removed after completion of the competition. In March of this year, the Moab Bike Park Committee approached the City with an idea to build an expanded jump track, BMX course, flow trail and skill building area at the current BMX site, encompassing much of Anonymous Park off of the 500 West Bridge. Jeff Foster, David Olsen and I met with representatives from this committee and began working with them to address issues of maintenance, safety, liability, funding, construction of ramps, etc. We asked the committee to provide additional information and to submit a more formal proposal. The committee did as requested and submitted a more formal proposal on May 31, 2012. The proposal entailed a fairly comprehensive, several phased project that would be completed in approximately one year. The overall project, as stated in the proposal, would consist of the construction of new dirt jumps and pump tracks, a flow trail and skill building area and a BMX track suitable for racing. Please see the attached proposal for more details on these different proposed project elements. Note that the proposal involved some of the work to be done by a contractor, and some of the work to be ADM-MEM-12-08-002 Page 46 of 63 6-3 completed by volunteers. The proposal described grant and other monies that the Committee would bring to the project. The proposal also entailed the Committee's taking on basic maintenance responsibilities, with the idea that the City would take over maintenance at some point. The proposal was quite ambitious. At about this same time, we were approached by the slack -lining group about possible locations, and this was added into the mix of considerations for the site. Based on research into other communities, other tracks, insurance requirements, as well as site visits, conversations with committee members and conversations among staff, along with an understanding of some past maintenance challenges at the site, City staff determined that it would be best to start with a smaller scale "pilot project" rather than trying to implement the full-scale proposal put forth by the Committee. Staff also determined that some of the proposed jumps and structures were not suitable for the site at this time given the level of maintenance, quality control and oversight that would be possible. Staff also determined that intensive city maintenance of the site would not be possible at this time. Based on the foregoing, city staff worked with the Committee in putting together a Phase I Project. Phase I would consist of upgrading and expanding the existing dirt jump track, building a pump track, and improving the existing BMX track. The attached aerial photo shows the area that would be affected by Phase I. In order to implement Phase I, the City and the Committee put together an agreement which delineates the responsibilities associated with the project. After further review, it was determined that the agreement should be with an established group rather than with an informal committee. The Committee agreed. The City contacted the Moab Trails Alliance (MTA) to see if they would take on the financial, planning, coordination and maintenance responsibilities entailed in the agreement. MTA agreed. Note that many of the bike park committee members are associated with MTA. The agreement with MTA calls for City approval of project plans for Phase I, oversight of the site, signage and project control. It stipulates that the MTA will maintain the property through a consortium of local bike shops, and provides for how volunteers will be involved with the Project. It also says that the Project will be reviewed to determine if proceeding with future phases is appropriate and desirable. Please note that we found an alternate location for the slack -liners that does not conflict with this project. City staff recommend approval of the attached agreement with MTA for the construction and maintenance of Phase I of the Bike Park Project. ADM-MEM-12-08-002 Page 47 of 63 6-3 Agreement Agreement by and between the City of Moab and Moab Trails Alliance to Establish Terms for Upgrading, Building, and Maintaining Phase 1 of the Proposed Bike Park at Anonymous Park. This agreement is made and entered into by and between the City of Moab, a Utah Body Politic, (hereinafter referred to as "City"), and the Moab Trails Alliance, (herein after referred to as "MTA"). THIS AGREEMENT is made and entered into based upon the following representations made by the parties to each other: 1. The City of Moab is a duly created and existing body politic of the State of Utah and has the legal authority and power to enter into this Agreement and to execute the same by and through the undersigned Mayor of the City. 2. MTA is a registered 501 (c) (3) non-profit organization that works to expand cycling opportunities in Grand County for all abilities. MTA is authorized to enter into this Agreement and to execute the same. PURPOSE OF THIS AGREEMENT: This agreement is entered into as a result of MTA's desire to upgrade and expand the bike facilities at Anonymous Park, located west of 500 West Street near the 500 West Bridge (hereinafter known as "the Property.") AGREEMENT PERIOD: This agreement shall be effective after the signing of this agreement and shall remain in effect until 90 days written notice of either party. Other agreements may be entered into in order to fully execute the terms and conditions of this agreement. PROJECT DESCRIPTION: Phase 1 of the project, (hereinafter known as "the Project") includes upgrading and expanding the existing dirt jump track, building a pump track, and improving the BMX track on the Property. The existing dirt jump track has a beginner and advanced jumping line that MTA would like to build into four jumping lines of increasing size, starting with a beginner jumping line along the east service road. MTA proposes to make an intermediate line and two advanced jumping lines west of the intermediate line. MTA also proposes to build a pump track west of the jump track. MTA proposes to hire a contractor with dirt ramp building expertise to complete the Project. A map of the Project area of work is attached. APPROVAL OF PLAN: MTA agrees to provide the City with a layout and construction plans showing the proposed improvements desired for the Project before work begins on the Project. City staff shall approved the layout and construction plans before work begins on the Project. CITY CONTROL OF PROJECT: MTA acknowledges that the City shall have final control over the Project. MTA agrees to work with the City to improve the site and comply with City regulations and standards. MTA agrees to follow the instructions of Page 48 of 63 6-3 City officials (namely the Moab City Community Development Director and Public Works Director) in carrying out the Project. CONTRACTOR TERMS: Before starting work, the contractor performing the improvements shall sign an agreement that addresses project specifications, liability, insurance, and safety and performance standards. The contractor shall abide by all terms and conditions of the agreement. VOLUNTEERS: Both parties acknowledge that volunteers will help build and maintain the park and that the volunteers must sign volunteer agreements provided by the City before they perform any work on the Project. IMPROVEMENTS AND MAINTENANCE: Both parties acknowledge that once the Project is completed, that maintenance of the property is required. MTA has developed a maintenance schedule and agrees to maintain the jumps and keep the Project area safe, clean and weeded through volunteers and the businesses listed in the schedule. The schedule should periodically be updated and approved by City officials. The City agrees to work with MTA to provide for hauling of weeds and debris from the site and to keep the water system to the site operational. Funds could also be donated to a City BMX or Bike Park account to improve and keep the facility maintained. Adequate funding for maintenance may be considered as an alternative to the maintenance schedule. PROJECT FINANCING: The parties agree that all funding for the improvements contemplated in this agreement will be provided by MTA unless alternate funding arrangements are agreed to in writing by both parties prior to the expenditure of funds. All maintenance costs are to be borne by MTA, unless other arrangements are agreed to in writing by both parties. CONTROL OF PROPERTY: The parties understand that the City shall maintain control of the Property. The City Manager, Public Works Director and City Community Development Director reserve the right to curtail or modify the use of the property to address safety and functionality. SIGNAGE: Both parties acknowledge that signage is needed for the additional amenities proposed for the site. MTA agrees to develop, purchase and install signs needed for the site. The City shall approve the message and quality of signs before they are installed, and shall approve installation locations and methods. EVALUATIONS: Both parties acknowledge that before future phases of bike park improvements are considered, that ongoing evaluations will be conducted by City officials and MTA to assess the safety and quality of the constructed jumps and maintenance and use of the facility. The City may consider additional phases to the Project should the terms and conditions of this agreement be adequately met and the City deems that additional improvements are in the best interest of the community. At a minimum, the Project shall be evaluated annually. ADMINISTRATION OF AGREEMENT: This Agreement shall be administered by one representative of MTA and the City Manager, in conjunction with the City Page 49 of 63 6-3 Community Development Director and the City Public Works Director. MTA shall appoint one representative and an alternate and shall communicate the names of the individuals to the City Manager. Prior to the start of construction of the Project, the City Manager and the MTA representative shall communicate at least once per week to discuss the Project and to finalize any administrative details. After the start of construction, the City Public Works Director and the City Community Development Director shall act as project liaisons on behalf of the City. MTA shall communicate with a City Project liaison at least once per week during Project Construction. After construction, the MTA representative and the City Manager shall meet on an as -needed basis to administer the terms of this agreement. We (the committee), understands that resources are currently limited in respect to upkeep and maintenance for such a park at this time and that the City of Moab is not able to include this maintenance in the current budget. We have discussed what we can commit to in keeping the bike park an enjoyable place for our youth as well as adults of our community and visitors as well. The following is our maintenance plan and schedule for the bike park: a.) Firstly, we have seven businesses in town that have committed to offering labor hours to the park. With this commitment there will be 7 to 15 people available to do the needed maintenance. b.) Maintenance will be March 15m thropei November 15'h each year. Maintenance throughout the winter will be based on usage and weather conditions. c.) The maintenance will occur weekly on Wednesdays and Sundays. With this schedule there will be 6 to 8 hours weekly committed to the bike park. d.) The maintenance plan will include keeping weeds under control, insuring that the area is kept clear of garbage and utilizing shovels and rakes to keep the area safe and rideable for all users. e.) In the spring time, we would request the City to provide a supply of Roundup to help with early weed abatement. f.) With the weed abatement and garbage pickup, we would request that the City be available to haul off the weeds and garbage weekly and continue to provide garbage cans and recycle bins. g.) We also need access to water. It is our understanding that there is a potential break in the water line at the park. We would request that the City repair the break. Having access to water is crucial in maintaining the bike park. Our Mission: It is the hope and mission of the local cycling community to be able to provide a bike specific park for the community of Moab. Bike parks are being planned and developed in numerous communities throughout the United States. Having such a park will enhance the experience of our youth, families as well as visitors to Moab. These types of facilities have helped to create cohesion within a community or neighborhood, enhance people's lives as well as increase the value or appeal of a neighborhood. Other communities that have created such parks see them provide a positive experience for kids, moms, dads as well as young to middle-aged adults. These parks help bring people together in a fun and active environment. With Moab being an international destination that is viewed for its spectacular mountain biking and road biking, there is a need for a bike park with dirt jumps, pump tracks, skills area and a flow trail. These types of parks increase a rider's skill level as well as provide for a healthy and active way to spend ones time. Current Conditions: The current jumps and bmx track at Anonymous Park are in need of redesign. They were built several years ago and were built improperly. The designs of bike parks have come a long way since the dirt jumps and bmx track were built over 8 years ago. With the new plan for the area, the jumps, pump track and skills area have been well thought out and will be weld designed which will offer riders of all abilities something to ride and test their skills on. In addition, with a newly designed park that OUT community will want to utilize; weeds, trash and the overall presentation of this area will be greatly improved. The new plan calls for clearing of more of the invasive trees and non-native vegetation which will also help to increase the aesthetics of the park. The pump tracks will be designed as a strength and skill building area. The obstacles will be constructed from wood, dirt, and rock designed to increase any skill level riders' abilities on skinnies(narrow wooden beams/logs), drops(1-5 foot wooden drops), and rock obstacles. Estimated build time for Phase 2 is 1-2 months. Phase 2 completion is Spring 2013. Table Top Jump: A Table Top Jump is a jump that the takeoff of the jump and the Landing of the jump are one connected mass of dirt. This type of jump has no gap or relief in between the Take off and the Landing making it the ideal jump for learning how to jump Table Top dump on. The problem with a tabletop jump is that it takes a huge quantity of dirt compared to a Gap Style Jump. Also it has been shown that when building large jumps this way, example; five foot high takeoff with lengths between ten and fifteen feet, that injuries are more likely due to a beginner level rider being able to go off a jump way bigger than they are capable of, thus throwing them higher in the air than they are accustomed to and landing flat on the top or even being thrown off one of the sides and missing the top completely. This form of jump will be used in our beginner line as it is the best way to learn how to jump a set distance with minimal consequence. camtel tium,p dump stir s-lr Camel Hump Jumps: A Camel Hump Jump is like a Tabletop Jump except the top of the jump between the takeoff and the landing is one foot lower. This style of jump is a step toward $t+ g' Take OFF I learning how to jump a gap jump without the consequence of `� 111 falling to the ground if the rider does not make the gap. If the rider comes up short it will be a more violent landing, but you can still ride through the jump. Gap jumps_ Gap Jumps also known as double jumps, utilize Gap dump takeoff and landing ramps, made from dirt, with a gap or chasm in between. Riders must jump from the takeoff and clear the gap to reach the landing. This style of jump is ideal for more experienced riders as it gives another level of difficulty to the jump. It also stop beginner riders from riding over the jumps which can destroy the lip or take off of the jump. For expert level jumps, Gap Jumps are necessary primarily for safety reasons but also to maintain cost efficiency. �-- a -zo' T 4'4' Take OFF LANDING LANDING Size: In Anonymous Park we wish to build Gap Jumps with takeoff jumps between four feet and six feet high with a gap as small as eight feet and growing up to twenty feet. Gap size is measured from the top of the takeoff jump to the shortest distance a rider can safely land on the Landing Ramp. The size differences depend upon the location of the jump in a line of jumps and the difficulty level of that line of jumps. Examples of Gap Jump Sizing: Intermediate jump line: 4' lip, 8' gap, second jump 5' lip with 10' gap, third jump, 5' lip with 12' gap. Advanced Jump Line: 5' lip, 10' gap, second jump 6' lip 12' gap, third jump 6' lip 15' Jump Variations: Step Down jump is like a Gap Jump in form and construction except the landing of the jump is LOWER than the takeoff of the jump. Step Up jump is like a Gap Jump in form and construction except the landing of the jump is HIGHER than the takeoff of the jump. Wood: Building wooden takeoff ramps is an option. This would require less maintenance and the lip of the jump will not break down like dirt. However building ramps from wood and concreting them into the ground is much more labor intensive, cost much more, and the jumps need to be constantly inspected to make sure they are safe to jump. Wall Ride: At the end of the jump line we wish to separate the BMX start box from the dirt jump area. We feel the best way to do this is with a wall ride. A wall ride is a wooden structure that stands near vertical and has dirt banks at the bottom allowing a rider to jump up and ride the wall. This will create a barrier to stop riders from continuing onto the BMX track or riding backwards up the jump lines. Wallride will be approximately twelve feet wide by six feet tall. A pump track is a short circuit track built into a small area that is designed to allow the rider to ride the course continuously without pedaling by using weight shifts (pumping) over rollers and through bermed turns. Track consists of a smooth track surface, dirt rollers one to two feet high that the rider pumps to gain speed and bermed turns to help the rider carry and gain momentum around the track.
