AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District for
the purpose of construction of sewers and related appurtenances in the project known as Stanwood
Dr. and Belwood Dr. Storm Sewer and Bank Stabilization (11442) in the City of No rmandy,
Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further
condemnation efforts related to the project, including but not limited to the purchase and/or the
filing of all necessary court pleadings or documents to commence and prosecute formal legal
proceedings for the acquisition of said easements and temporary construction easements .
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of Normandy, St. Louis County, Missouri within the Baden Watershed wherein numerous people
live and work; and
WHEREAS, stormwater gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and the
residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditio ns.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous conditions,
it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise
easements and temporary construction easements in real property for the construction of sewers
and related appurtenances in the project known as Stanwood Dr. and Belwood Dr. Storm Sewer
and Bank Stabilization (11442) hereinafter set forth, said easements and temporary easements
being more particularly described below:

VARIABLE WIDTH SEWER EASEMENT across a tract of land being Lot 28 in Block 6 of
“Berdell Hills”, a subdivision recorded in P.B. 34, page 61 of the St. Louis County Records, City
of Normandy, St. Louis County, Missouri and being more particularly described as follows:
VARIABLE WIDTH SEWER EASEMENT; BEGINNING at a point being the Northeast corner
of Lot 28 in Block 6 of “Berdell Hills”, a subdivision recorded in P.B. 34, page 61 of the St. Louis
County Records, said point also being in the South right-of -way line of Stanwood (50’W) Drive;
THENCE leav ing said South right-of-way line and along the Eastern line of said Lot 28 South 26
degrees 59 minutes 52 seconds East a distance of 120.36 feet to a point being the Southeast corner
of said Lot 28; THENCE along the most Southern line of said Lot 28 South 60 degrees 51 minutes
44 seconds West a distance of 2.50 feet to a point; THENCE leaving said most Southern line of
Lot 28 North 26 degrees 59 minutes 52 seconds West a distance of 19.23 feet to a point; THENCE
North 82 degrees 50 minutes 42 seconds West a distance of 3.02 feet to a point; THENCE North
26 degrees 59 minutes 52 seconds West a distance of 30.00 feet to a point; THENCE North 63
degrees 00 minutes 08 seconds East a distance of 2.50 feet to a point; THENCE North 26 degrees
59 minutes 52 seconds West a distance of 69.57 feet to a point in the South right-of -way line of
Stanwood (50’W) Drive; THENCE along said South right-of -way line along a curve to the left
having a radius of 70.00 feet, a chord bearing of North 64 degrees 01 minutes 32 seconds East, a
chord distance of 2.50 feet, and an arc length of 2.50 feet to the POINT OF BEGINNING.
ALSO a VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT for use during the
construction of any sewer in the above described SEWER EASEMENT, said VARIABLE WIDTH
TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT; BEGINNING at a
point being the Northwestern corner of Lot 28 in Block 6 of “Berdell Hills”, a subdivision recorded
in P.B. 34, page 61 of the St. Louis County Records, said point also being in the South right-of -
way line of Stanwood (50’W) Drive; THENCE along said South right-of -way line along a curve
to the left having a radius of 70.00 feet, a chord bearing of North 86 degrees 40 minutes 59 seconds
East, a chord distance of 20.16 feet, and an arc length of 20.22 feet to a point; THENCE leaving
said South right-of-way line South 13 degrees 05 minutes 32 seconds West a distance of 41.19 feet
to a point; THENCE South 12 degrees 49 minutes 57 seconds East a distance of 61.53 feet to a
point; THENCE North 60 degrees 32 minutes 26 seconds West a distance of 55.23 feet to a point;
THENCE South 26 degrees 59 minutes 52 seconds East a distance of 13.25 feet to a point;
THENCE South 82 degrees 50 minutes 42 seconds West a distance of 3.02 feet to a point;
THENCE South 26 degrees 59 minutes 52 seconds East a distance of 19.23 feet to a point in the
most Southern line of said Lot 28; THENCE along said most Southern Line South 60 degrees 51
minutes 44 seconds West a distance of 47.12 feet to a point being the most Southern point of said
Lot 28; THENCE leaving said most Southern line and along the most Southwestern line of said
Lot 28 North 71 degrees 45 minutes 16 Seconds West a distance of 60.92 feet to a point; THENCE
North 04 degrees 57 minutes 38 Seconds East a distance of 105.58 feet to the POINT OF
BEGINNING.
TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of
the above described sewer construction.

A 20 FEET WIDE ACCESS EASEMENT across a tract of land being Adjusted Tract 1 of “B.A.P.
Of Lutheran High School North”, a subdivision recorded in P.B. 350, Pages 229-230 of the St.
Louis County Records, City of Norwood Court, St. Louis County, Missouri and being more
particularly described as follows:
A 20 FEET WIDE ACCESS EASEMENT, BEGINNING at a point being the most Southern
corner of Adjusted Tract 1 of “B.A.P. Of Lutheran High School North”, a subdivision recorded in
P.B. 350, Pages 229-230 of the St. Louis County Records, said point also being in the Northeast
right-of -way line of Interstate Highway 70; Thence along said Northeast right-of -way line the
following courses: a curve to the right having a radius of 3669.83 feet, a chord bearing of North
46 degrees 40 minutes 00 seconds West, a chord distance of 112.99, and an arc length of 112.99
feet to a point; THENCE North 45 degrees 47 minutes 04 seconds West a distance of 786.35 feet
to a point; THENCE North 46 degrees 48 minutes 12 seconds West a distance of 207.85 feet to a
point; THENCE along a curve to the left having a radius of 2060.08 feet, a chord bearing of North
51 degrees 15 minutes 26 seconds West, a chord distance of 177.77, and an arc length of 177.83
feet to a point being the Southwest corner of said Adjusted Tract 1; Thence leaving said Northeast
right-of -way line of Interstate Highway 70 and along the West line of said Adjusted Tract 1 North

County, Missouri and being more particularly described as follows:
A VARIABLE WIDTH ACCESS EASEMENT, COMMENCING at a point being the most
Southern corner of Adjusted Tract 1 of “B.A.P. Of Lutheran High School North”, a subdivision
recorded in P.B. 350, Pages 229-230 of the St. Louis County Records, said point also being in the
Northeast right-of-way line of Interstate Highway 70; Thence along said Northeast right-of -way
South 00 degrees 22 minutes 29 seconds West a distance of 40.23 feet to the TRUE POINT OF
BEGINNING; Thence South 00 degrees 22 minutes 29 seconds West a distance of 29.37 feet to a
point; THENCE South 89 degrees 09 minutes 55 seconds East a distance of 51.50 feet to a point;
THENCE North 00 degrees 50 minutes 24 seconds East a distance of 6.47 feet to a point; THENCE

North, Range 6 East, and conveyed to Lutheran High School Association of St. Louis, by D.B.
13809, Pg. 1589 as recorded with St. Louis County Recorder’s Office, St. Louis County, Missouri
and being more particularly described as follows:
CENTERLINE of a 25 FEET WIDE ACCESS EASEMENT, COMMENCING at a point being
the Southeast intersection of Lucas & Hunt (80’W) Road and a Public Road (30’W); THENCE
along the South Right-of-way line of said Public Road (30’W) North 89 degrees 09 minutes 59
seconds West a distance of 259.70 feet to the TRUE POINT OF BEGINNING; Thence leaving
said South right-of -way line along a curve to the left having a radius of 108.36 feet, a chord bearing
o f South 40 degrees 22 minutes 43 seconds West a distance , a chord distance of 57.95 feet, and
an arc length of 58.66 feet to a point; THENCE South 24 degrees 56 minutes 17 seconds West a
distance of 95.53 feet to a point; Thence along a curve to the right having a radius of 142.14 feet,
a chord bearing of South 58 degrees 04 minutes 25 seconds West, a chord distance of 122.68 feet,

a radius of 3657.33 feet, a chord bearing of North 52 degrees 18 minutes 16 seconds West , a chord
distance of 270.12, and an arc length of 270.18 feet to the POINT OF TERMINUS.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue
with the condemnation process by preparing and/or filing all necessary court pleadings a nd
documents to institute and prosecute legal action s in condemnation to acquire all easements for
the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St.
Louis Sewer District and the laws of the State of Missouri for the appropriation of private property
rights as herein above set out.
